SECOND STIPULATION AND CONSENT ORDER EXTENDING TIME TO RESPOND TO COMPLAINT TO AVOID PREFERENTIAL TRANSFERS, TO RECOVER PROPERTY AND FOR RELATED RELIEF

ROBERT A. GORDON, Bankruptcy Judge.

WHEREAS Tiger Direct, Inc. and SYX Services Inc. (the "Defendants") have been validly served with the Complaint to Avoid Preferential Transfers, to Recover Property and for Related Relief, filed by Edward T. Gavin, the duly appointed Trustee of the FPI Liquidating Trust (the "Trustee," and together with the Defendants, the "Parties") against the Defendants on December 26, 2012 (the "Complaint"), by undersigned counsel, by and on behalf of the FPI Liquidating Trust; and

WHEREAS, the Defendants requested a further extension of time to file an answer, motion or otherwise respond to the Complaint so that the Parties can continue settlement discussions; and

WHEREAS, the Trustee has no objection to such extensions and postponements as set forth in this Stipulation; and it appearing to the Court that there is good cause to do so,

It is hereby ORDERED that the deadline for the Defendants to respond to the Complaint is hereby extended to February 22, 2013.
