This matter came before this Court for trial on December 15, 2010. Plaintiff Paul Michael Medlin, Jr. (the "Plaintiff") was represented by the Debt Relief Law Firm of Missouri, more specifically by Michael McCrary and Robert Cornejo. Defendant The Wellington Group, Inc. (the "Defendant") was represented by Spencer Fane Britt & Browne LLP, more specifically by Nicholas A. Franke and Laura Uberti Hughes. Counsel made argument, testimony of witnesses was heard and exhibits were received. This Court also asked Plaintiff and Defendant whether they requested additional findings of fact, and neither party so requested. Based on this Court's findings of fact and conclusions of law as set forth on the record at the trial held on December 15, 2010, pursuant to Federal Rule of Civil Procedure 52, as adopted by Federal Rule of Bankruptcy Procedure 7052, it is hereby
