ORDER

Defendant Jerry Ward Mattson, III, by and through his counsel of record, Mark D. Meyer, has moved for psychiatric or psychological evaluations to determine Defendant Jerry Ward Mattson, III's competency to stand trial, and to determine his sanity at the time of the alleged offenses. The Government does not oppose the motion.

Having reviewed the record herein, and for good cause shown, IT IS HEREBY ORDERED that the Unopposed Motion For Psychiatric or Psychological Examination (Doc. 51) is GRANTED.

Defendant Jerry Ward Mattson, III, shall undergo an evaluation to determine his competency to stand trial and his sanity at the time of the alleged offenses. 18 U.S.C. § 4242.

The United States Marshals Service is directed to request that the Bureau of Prisons designate the federal facility where Mattson will be evaluated.

The United States Marshals Service shall notify the Court when it receives notice of the facility that has been designated.

All pretrial deadlines, and the jury trial set for October 17, 2016, are VACATED as to Defendants Jason Avery Mattson and Jerry Ward Mattson, III, to be reset, if appropriate, by further order of the Court

All the time between the date of this Order and the date the evaluator delivers the evaluation report to the Court is excluded from speedy trial calculation as to both Defendants Jason Avery Mattson and Jerry Ward Mattson, III 18 U.S.C. § 3161(h)(1)(A); United States v. Stone, 813 F.3d 1536, 1538-39 (9th Cir 1987).

The Clerk is directed to notify the parties and the United States Marshals Service of the entry of this Order.
