After due consideration of the objection filed, I herewith approve the Report and Recommendation of Magistrate Judge Andrea K. Johnstone dated February 15, 2018, and grant respondent's motion to dismiss (Doc. No. 8) and deny petitioner's motion for summary judgment (Doc. No. 9).
