ORDER ON MOTION FOR PARTIAL SUMMARY JUDGMENT

The court having entered its Memorandum Decision on Motion for Partial Summary Judgment contemporaneously herewith,

IT IS HEREBY ORDERED that the Motion for Partial Summary Judgment brought by City National Bank, Adversary Docket No. 580, be, and the same hereby is, GRANTED IN PART AND DENIED IN PART.

IT IS FURTHER ORDERED that summary judgment is GRANTED in favor of City National Bank and against Charleston Associates, LLC, on Counts I, II and V set forth in the Amended Complaint for Declaratory Judgment, Sanctions, Compensatory Damages and Punitive Damages filed by Charleston Associates, LLC, Adversary Docket No. 37.

IT IS FURTHER ORDERED that summary judgment is GRANTED in favor of City National Bank and against Charleston Associates, LLC, on the First Claim for Relief set forth in the Counterclaim filed by City National Bank, Adversary Docket No. 54 (hereafter "CNB Counterclaim").

IT IS FURTHER ORDERED that summary judgment is DENIED WITHOUT PREJUDICE on the Second Claim for Relief set forth in the CNB Counterclaim.

IT IS FURTHER ORDERED that summary judgment is GRANTED in favor of City National Bank and against Charleston Associates, LLC, on the Third Claim for Relief set forth in the CNB Counterclaim.

IT IS FURTHERED ORDERED that damages in the amount of $6,851,030.98 are awarded in favor of City National Bank and against Charleston Associates, LLC, on the First Claim for Relief set forth in the CNB Counterclaim.
