STIPULATION AND ORDER TO EXTEND DEFENDANT WELLS FARGO'S TIME TO RESPOND TO PLAINTIFF'S COMPLAINT

It is hereby stipulated by and between Plaintiff Thomas Misday ("Mr. Misday"), through his attorneys David Krieger and Jennifer Isso, and Defendant Wells Fargo Bank, N.A. ("Wells Fargo") (incorrectly identified in the Complaint as Wells Fargo Financial National Bank), through its attorneys, the law firm of Snell & Wilmer L.L.P., as follows:

Per prior order of this Court, Wells Fargo's response in this matter is currently due January 29, 2016. Both parties are still researching the facts and circumstances surrounding the allegations and potential defenses in this case, and several cases were consolidated into this matter on January 7, 2016. The parties are also actively discussing a possible settlement. Plaintiff has filed a motion to amend the complaint. No parties have yet opposed that motion. In the interest of conserving client and judicial resources, Mr. Misday and Wells Fargo stipulate and agree that Wells Fargo shall have until March 15, 2016, in which to file its responsive pleading to the complaint on file. This is the parties' first request for an extension of time since the filing of the motion to amend the complaint, and is not intended to cause any delay or prejudice to any party, but is intended so the parties may discuss settlement.

ORDER

IT IS ORDERED THAT Wells Fargo Bank, N.A.'s time to respond to Plaintiff's Complaint shall be extended to on or before March 15, 2016.

IT IS SO ORDERED.
