STIPULATION AND ORDER TO EXTEND TIME TO RESPOND TO MOTION TO ALTER OR AMEND JUDGMENT UNDER FRCP 59(e)

COMES NOW Plaintiff, THE BANK OF NEW YORK MELLON, FKA THE BANK OF NEW YORK AS SUCCESSOR IN INTEREST TO JP MORGAN CHASE BANK NA AS TRUSTEE FOR STRUCTURED ASSET MORTGAGE INVESTMENTS II INC. BEAR STEARNS ALT-A TRUST 2005-9, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-9, and Defendants, AIRMOTIVE INVESTMENTS, LLC. and LAS VEGAS DEVELOPMENT GROUP, LLC, by and through their undersigned counsel, and hereby stipulate and agree as follows:

1. On March 5, 2019, Plaintiff filed a Motion to Alter or Amend Judgment Under FRCP 59(e) herein [ECF #87]. Responses to said Motion are presently due on March 19, 2019. 2. Defendants' counsel have been required to devote time and attention to numerous other pending legal matters since the filing of the Motion to Alter or Amend Judgment Under FRCP 59(e) which have detracted from the time available prepare a response. In addition, the Defendants' counsel has been out of the office attending jury service and other personal matters that has detracted from the time available to prepare a response. 3. Based upon the foregoing, Defendants have requested and shall be granted an extension of time until April 2, 2019, in which to respond to the Plaintiff's Motion to Alter or Amend Judgment Under FRCP 59(e). 4. This Stipulation is made in good faith and not for purpose of delay.

IT IS SO ORDERED.
