ORDER

The defendant Anthony Delano Hylton, Jr. is charged in Count Three of the superseding indictment with Felon in Possession of a Firearm, in violation of Sections 922(g)(1) and 924(a)(2) of Title 18 of the United States Code. The court has heard the evidence and based upon the evidence presented to the court finds and concludes that the government has proven the following elements beyond a reasonable doubt:

First, the defendant Anthony Delano Hylton, Jr. knowingly possessed a Rock Island Armory .45 caliber semi-automatic handgun, bearing serial number RIA1728332 on December 5, 2016, in Las Vegas, Nevada, in the District of Nevada;

Second, the Rock Island Armory .45 caliber semi-automatic handgun had been shipped or transported from one state to another; and

Third, at the time the defendant Anthony Delano Hylton, Jr. possessed the Rock Island Armory .45 caliber semi-automatic handgun, the defendant had been convicted of the crime of Battery With Substantial Bodily Harm which was punishable by imprisonment for a term exceeding one year.

Accordingly, the court finds the defendant Anthony Delano Hylton, Jr. guilty of being a Felon in Possession of a Firearm as charged in Count Three of the superseding indictment.
