STIPULATION TO DISMISS AND REQUEST TO RETAIN JURISDICTION; [PROPOSED] ORDER

Plaintiff Rockstar, Inc. and Defendant Celsius Holdings, Inc. (the "Parties") have settled this action pursuant to a written settlement agreement. Therefore, pursuant to Local Rule 7-1, the Parties stipulate and respectfully request that the Court dismiss this Action with prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii).
