STIPULATED ORDER OF DEPOSIT, INVESTMENT, DISCHARGE AND DISMISSAL

TIMOTHY S. BLACK, Judge.

Upon the Stipulated Motion of Plaintiff MetLife to permit Plaintiff to deposit disputed group life insurance benefits (referred to in the Stipulated Motion as the "Plan Benefits") at issue in this interpleader, payable under the General Motors Corporation Basic Life insurance Plan (the "Plan") as a result of the death of Jesse Booker (the "Decedent") in the sum of Ten Thousand Dollars ($10,000) plus any applicable interest, into the Registry of the Court and to invest those funds into an interest bearing account, it is hereby

ORDERED that the Clerk accept for deposit into the Registry of the Court the deposit made by MetLife in this cause in the amount of Ten Thousand Dollars ($10,000), plus any applicable interest, and it is further

ORDERED that the Clerk promptly invest those funds into an interest bearing account maintained by the Clerk in an approved depository in accordance with S.D. Ohio R. 77.2 and deduct a registry fee as a percentage of the income earned on the investment over the period such sums remain deposited and invested; and it is further

ORDERED that upon deposit of the Plan Benefits into the Court's Registry, Plaintiff MetLife is dismissed with prejudice as a party to this action; that MetLife, General Motors Corporation, and the Plan are hereby released and discharged from any further liability or obligations for the Plan Benefits plus any applicable interest payable under the Plan as a result of the death of the decedent; and that Defendants are enjoined and restrained from instituting any action or proceeding in any state or United States court against MetLife, General Motors Corporation, or the Plan for the Plan Benefits, plus any applicable interest, payable as a consequence of the death of the Decedent; and

IT IS ORDERED that Plaintiff MetLife will pay its own attorneys fees and costs.
