Upon the facts,
12 T.C. 232">*232 These proceedings were brought for a redetermination of deficiencies determined in petitioners' income 1949 U.S. Tax Ct. LEXIS 269">*270 taxes for the year 1944 as follows:

All assignments of error set forth in the petitions, except one, have been settled by agreement. Only a single issue, therefore, common to all the parties, is presented: Are the petitioners, who transmitted checks to the State of Louisiana in amounts equal to their estimated tax liabilities for the year 1944 shortly before the close of that year, entitled to claim deductions in their respective 1944 Federal income tax returns for state income taxes paid. The tax returns for the year involved were filed with the collector of internal revenue for the district of Louisiana, at New Orleans.
FINDINGS OF FACT.
Petitioners Lillian Bacon Glassell and A. C. Glassell are husband and wife. They reside at Shreveport, Louisiana. Petitioner A. C. Glassell, Jr., is a resident of Shreveport, Louisiana.
Petitioners' books are kept on the cash receipts and disbursement basis, and their 1944 Federal income tax returns were made out on that basis.
The bookkeeper for each of the petitioners computed an estimate of their state income tax liability for the year 1944. Such1949 U.S. Tax Ct. LEXIS 269">*271 computation in the case of A. C. Glassell and Lillian Bacon Glassell revealed a tax due from both in the amount of $ 39,286.48, and in the case of A. C. Glassell, Jr., showed a tax due in the amount of $ 32,741.50. The bookkeeper made out checks for these amounts and on December 29, 1944, gave them to the state collector. At the same time he handed to 12 T.C. 232">*233 the state official forms which contained the notation "Tentative Return." A. C. Glassell and Lillian Bacon Glassell filed separate state tax returns and in each there was shown a tax computation in the amount of $ 19,643.24. The state official accepted petitioners' checks as payments of their 1944 state income taxes and gave the bookkeeper a receipt for the amounts of the checks. The receipts contained a notation "For 1944 Income Tax." The checks were both drawn on a Shreveport bank, which they cleared on January 11, 1945.
In May 1945 each of the petitioners filed a 1944 State of Louisiana income tax return. These returns showed the following taxes due to the state from the petitioners:

The difference in the amounts between1949 U.S. Tax Ct. LEXIS 269">*272 the estimated income tax and tax due, which for A. C. Glassell, Jr., was in the amount of $ 948.18, and for A. C. Glassell and Lillian Bacon Glassell was in the amount of $ 1,116.04, was remitted to the state collector in May 1945.
In his 1944 Federal income tax return A. C. Glassell, Jr., claimed a deduction of $ 35,432.69 for Louisiana income taxes paid. This included the $ 32,741.50 check given on December 29, 1944, and 1943 state income taxes paid during the year 1944. In their 1944 Federal income tax returns filed by A. C. Glassell and Lillian Bacon Glassell deduction on a community basis was claimed for state taxes paid in the amount of $ 41,281.44. This comprised the $ 39,286.48 paid to the state collector on December 29, 1944, and Louisiana income taxes for 1943 which were paid in 1944.
The Commissioner disallowed as a deduction the amount of $ 32,741.50 claimed by A. C. Glassell, Jr., and the amount of $ 39,286.48 claimed on a community basis by A. C. Glassell and Mrs. A. C. Glassell for state income taxes paid.
OPINION.
The respondent argues that petitioners may not claim deductions for the state taxes paid prior to the time when "such taxes actually became legally due"; 1949 U.S. Tax Ct. LEXIS 269">*273 that such taxes did not become due until on or after January 1, 1945; and that the checks given to the state collector on December 29, 1944, by the petitioners were merely deposits and, as such, were not deductible. Petitioners, on the other hand, contend that, because they kept their books and filed their returns on the cash receipts and disbursement basis, the amounts paid to the state as taxes in 1944 are properly deductible in that year.

Under the code of that state every individual having a net income of $ 1,000 or over, if single, and every individual 1949 U.S. Tax Ct. LEXIS 269">*274 having a net income of $ 2,500 or over, if married, and every individual having a gross income of $ 5,000, regardless of his net income, is required to file a return setting forth his items of gross income and his deductions. Louisiana General Statutes, Dart., sec. 8587.20. The statute further establishes that returns made on the basis of the calendar year are to be filed with the collector on or before the 15th day of May following the close of the calendar year. Sec. 8587.22. Section 8587.25 (f) of the Louisiana statute states that upon the payment of any tax imposed by the state law the collector shall, upon request, give a receipt to the person making such payment. It is provided in section 8587.25 (g) that payment of the tax under the state statute may be made by, among other means, a check. Subsection (d) of that section reads as follows: "(d) A tax imposed by this act, or any instalment thereof, may be paid at the election of the taxpayer, prior to the date prescribed for its payment."
Louisiana taxing officials interpret subsection (d) to mean that a taxpayer may pay his tax, or a part of it, prior to the close of the taxable year. We think that interpretation is proper.
1949 U.S. Tax Ct. LEXIS 269">*275 Petitioners, acting in accordance with that law, elected to pay their taxes on December 29, 1944, when the amounts thereof were reasonably ascertainable. The state taxing officials accepted petitioners' checks as payments of their 1944 income taxes and gave them receipts therefor which contained the notation "For 1944 Income Tax." It is therefore our opinion, in the light of the facts and law of this case, that petitioners' payments of December 29, 1944, constituted payments of taxes within the meaning of the Internal Revenue Code. And, since petitioners kept their books and filed their returns on the cash basis, such payments are deductible in the year 1944. This result is in accordance with

We hold that the petitioners made payments of taxes on December 29, 1944, which, therefore, are deductible from their gross income for that year. It follows that respondent erred in his determination.
