Before the Court is: (1) appellants' February 21, 2017 "Motion to Abate Appeal and March 8, 2017, Oral Argument in Light of Opinion in Cause No. 05-15-00102-CV"; and (2) appellees' March 6, 2017 response to that motion. On March 8, 2017, the Court heard oral argument on the February 21, 2017 motion to abate the appeal and the response as well as the merits of the appeal. The case was submitted on March 8, 2017.
After considering appellants' February 21, 2017 motion to abate, the March 6, 2017 response to the motion, and the argument of counsel, the Court DENIES the portion of appellants' February 21, 2017 motion, seeking to abate oral argument as moot. The Court GRANTS the portion of appellants' February 21, 2017 motion, seeking to abate the appeal. The appeal is ABATED until further order of this Court, reinstating the appeal.
