MEMORANDUM OPINION
DAVID PURYEAR, Justice.
Appellant DHJB Development and all appellees have reached a settlement agreement that resolves the claims and issues in this case and renders moot the appeal of the remaining appellant, Texas Commission on Environmental Quality. Consequently, DHJB Development and appellees have filed a joint motion to vacate the district court's judgment without regard to the merits. The motion further requests that we not only dismiss the appeal in this Court but that we also dismiss the case in the court below. Texas Commission on Environmental Quality has filed a response asking for identical relief. Accordingly, we vacate the trial court's judgment and render judgment dismissing the underlying case.
