SEABOARD COASTLINE RAILROAD vs. BROWARD COUNTY AND DEPARTMENT OF TRANSPORTATION, 75-002070 (1975)

Findings Of Fact Transportation plans for Broward County made as long ago as 1965 provide for roads crossing the SCL tracks at N. W. 48th Street in Broward County and at S. W. 10th Street in Deerfield Beach. Both of these routes are now planned as principal E-W arteries providing four lanes of traffic. Rights of way for these routes both east and west of the SCL tracks have been acquired by the City of Deerfield Beach and by Broward County. Approaches for both of these arteries over the recently completed I-95 running just east of the railroad tracks have also been completed. Two crossings presently provide access from east of the tracks to the area here involved west of the tracks, one at SR 810 to the north and the other at Sample Road some 3 1/2 miles to the south. S. W. 10th Street in Deerfield Beach is just under one mile south of SR 810 also in Deerfield Beach, and N. W. 48th Street is outside the incorporated area of Deerfield Beach one mile south of S. W. 10th Street. The population of Deerfield Beach is approximately 31,000 and some 6,000 persons reside west of the SCL tracks. The largest development in Deerfield Beach west of the tracks is Century Village located south of and adjacent to SR 810. The only entry to and access from Century Village is via SR 810. In the event the crossing at SR 810 is blocked emergency access to Century Village and other areas west of the SCL tracks is via Sample Road or via the next crossing to the north in Palm Beach County some five miles north of SR 810. Fire protection for the unincorporated area of Broward County in the vicinity of N. W. 48th Street west of the SCL tracks is provided from the fire station approximately one mile east of the SCL tracks near SR 810 and US 1 in Deerfield Beach. To reach that area it is necessary to cross the tracks at SR 810, proceed west to Powerline Road, south to Sample Road, east to N. W. 9th Avenue, and north to the area. A similar route would have to be followed by other emergency vehicles either police or medical. Substantial growth of the area immediately west of the SCL tracks between SR 810 and Sample Road has occurred and developments are currently underway to provide numerous homesites, principally trailer park facilities, in this area. Sample Road has been widened to 6 lanes and is estimated to be 300 percent overcapacity if all land use plans predicated for the area are developed. Additional E-W arterial transportation routes are needed. SCL presently has a passing track or siding at the proposed S. W. 10th Street crossing. This siding is 5700 feet long and can accommodate 96 cars. Three-fourths of this track lies north of S. W. 10th Street and approximately 71 cars could be accommodated, on the portion of the siding north of S. W. 10th Street. This 5700 foot section of track is adjacent and parallel to the main track which presently carries 6 passenger and 6 freight trains per day plus approximately 2 switch trains per day. It is used to drop off cars for later pickup, for allowing north and southbound trains to pass, or for a passenger train to pass a freight train. Exhibit 16 was stipulated into evidence to show typical activity at this 5700 foot Deerfield Beach siding. During the period February 22, 1976 to April 13, 1976 the largest number of cars held on this siding at any one time was 68. Similar sidings (generally with greater capacity) exist at various places alongside SCL tracks. The cost of providing a grade separation crossing at the SCL tracks at either N. W. 48th Street or S. W. 10th Street is approximately one million dollars. While such a crossing would obviously be safer than a grade crossing, the cost to benefit ratio for the grade crossing over the grade separation crossing is 4.52 at 48th Street and more than 3 at S. W. 10th Street. The safety index for both of the proposed grade crossings with active safety warning devices is in the range of acceptability - each showing an accident probability of one every 11 years. Annual cost of the signals and warning devices to be installed on the grade crossing is some $21,000 a year while the cost of a grade separation structure is some $63,000 a year. Providing grade separation at S. W. 10th Street would necessitate the approach on the east of the track starting at about the same place the approach on the west side of I-95 starts, thereby effectively blocking any N-S access to S. W. 10th Street between I-95 and the SCL tracks. Although Exhibit 17 was not admitted into evidence one witness testified that the figures thereon, showing the cost of relocating the 5700 feet of siding at Deerfield Beach, were on the conservative side and would probably cost more. However, no evidence was presented that an at-grade crossing would render this siding useless for the purposes intended nor was any evidence offered to show that the value of this siding to SCL would be materially reduced by an at-grade crossing at S. W. 10th Street.

Findings Of Fact Proposal 1.. The proposed railroad crossing is requested on the basis of increased vehicular traffic at Tenth Street and Old Dixie Highway, and projections of still heavier traffic by the year 2000. Current traffic is 13,700 vehicles per day, and the level of traffic is projected to be over 50,000 vehicles per day by 2000. At this time traffic must move from Tenth Street to Old Dixie Highway using the existing crossing at Park Avenue. This necessitates two opposite 90- degree turns to move from one north/south street to the other. These two turns slow the traffic movement at Park Avenue. Expert testimony was received that current traffic has exceeded the design capabilities of the Park Avenues Tenth Street/Old Dixie Highway intersections. Old Dixie Highway and Tenth Street constitute one of the major north/south traffic corridors in Palm Beach County. The proposal would extend Tenth Street south and cross the Florida East Coast Railway (FEC) tracks running directly into Old Dixie Highway. However, the Park Avenue crossing would be retained, because Park Avenue is a major east/west corridor. No study of an off-grade crossing was made, because the County had earlier made a cost analysis of such a crossing at Okeechobee Road, the most heavily traveled crossing in the County, and it was determined not to be cost effective. Because the traffic count was lower at the proposed crossing, a study of the proposal was not undertaken. The proposal is advantageous to the County, which owns much of the proposed right of way. Necessity Clearly, it would be advantageous to correct the traffic tie-up, which does exist, at Park Avenue/Tenth Street/Old Dixie Highway. Necessity to clear up the traffic was demonstrated; however, it was not demonstrated that this crossing would substantially improve the design limits of the area. Under the proposal the Tenth Street/Old Dixie Highway would interconnect more directly; however, the traffic flow north/south would be broken by the east/ west traffic flow on Park Avenue over the existing crossing 235 feet north of the proposed crossing. The intersections and crossings resulting from granting the application would not meet the design needs to handle the projected 52,000 vehicles per day. Convenience It would be convenient for motorists on Tenth Street and Old Dixie Highway to avoid the two opposing 90-degree turns, and to a degree more convenient to motorists traveling east/west on Park Avenue. It would be convenient to the County, which owns a portion of the proposed right of way. However, the FEC would have to remove an existing switching track, railroad users in the area would suffer to a degree from the loss of that track, and it would cost the FEC $70,000 capital cost in replacing the existing tracks and $16,000 to $35,000 annually in increased operating costs. These costs would be passed onto the users and ultimately onto the consumers of those products shipped by rail. The longer switching time caused by movement of the tracks would also adversely affect the operations of one of the primary users of the railroad cars by delaying spotting of empty cars necessary to commencement of its daily operations. Convenience of the motorists on Park Avenue and Tenth Street/Old Dixie Highway would be adversely affected by the 28 train movements over the Park Avenue and proposed crossings each day. Safety The proposal would not enhance safety. The proposed crossing would cross the railroad tracks at substantially less than the 70 degrees recommended in the Department of Transportation's standards. In addition, the proposed crossing would be only 235 feet south of the Park Avenue crossing and approximately 700 feet north of the Lake Park crossing. Three crossings within this distance create greater potential for danger than two crossings. There is more potential for mechanical failure, one more location for a crossing mishap to occur, and greater potential for human error by either engineers or motorists. The engineer, for example, would not have enough room to blow the required whistle signals between the crossings, and would have to observe vehicular traffic at the Park Avenue and proposed crossing at the same time. General No evidence was presented concerning alternative traffic routes, feasibility studies of this specific crossing as an offgrade crossing, or overall benefits and detriments to both highway and railroad users. The proposed crossing would temporarily solve the existing traffic problem but at severe and recurring cost to the FEC and railroad users. While some changes may be necessary to improve traffic flow, the use of the existing switching tracks is necessary to effective and economical use of the railroad by its users. The danger to vehicular and railroad traffic would be increased by the proposed crossing.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, the Hearing Officer recommends that the Department of Transportation should deny the application for the at-grade crossing. The Issue Whether a permit should be issued to close an at-grade crossing in the vicinity of Florida East Coast Railway Company Mile Post 123 + 3,478 feet and Eleanor Street in New Smryna Beach, Florida.

Findings Of Fact The Eleanor Street railroad crossing is within the city limits of New Smyrna Beach, Florida, and serves a residential neighborhood. There are a total of 16 freight train movements north and south in a 24-hour period. There are normally two local freight trains each day. In August of 1966 there was a railroad train/automobile accident in which there were two fatalities and one injury. There is a small manufacturing plant on the west side of Eleanor Avenue which uses subject crossing. The factory has approximately 15 trucks. Motor vehicular count shows that there are between 600 and 900 crossings per day at this railroad crossing. Eleanor Street is a two- way street and the train is a single track. The street is relatively straight on the east side of the track and there is a reverse curve on the west side of the track. The crossing is protected by cross bows and stop signs. To the south of Eleanor Street, several hundred feet, is Wayne Street crossing, which is a two-lane street protected with flashing lights and gates at the railroad crossing. The Wayne Street crossing is heavily traveled with a traffic count of some 2,407 crossings per day. Although there are several crossings in close proximity, ditches and lack of through streets make these crossings inconvenient to those presently using subject crossing. The petitioner desires the crossing be closed, but if it is not closed that flashing bells, lights and gates be installed. The Respondent City does not want the crossing to be closed and states that it has allocated 10 percent of the required funds for installation of proper signalization. The Respondent Department of Transportation does not recommend that the crossing be closed and recommends that the crossing be signalized by a Type I signalization which is roadside mounted flashing lights with bells. Federal funds can he used for this project.

Recommendation Grant the petition to close unless installation of a Type I denomination of signalization is begun within sixty (60) days from date of Final Order. The Issue The issue for determination is whether the request for a permit to close the railroad crossing located at East Dade Avenue in the City of Bushnell, Florida, should be granted.

Findings Of Fact Bushnell received notice of DOT's intended agency action in this matter in the form of a copy of DOT's, INTENT TO ISSUE PERMIT, dated May 23, 1990. The permit would authorize the closing of the East Dade Avenue railroad crossing located in Bushnell. Bushnell filed a petition requesting formal proceedings on June 19, 1990. Bushnell has a population of 1,945, according to unofficial 1990 census figures. Population has increased almost 100 percent from the last census count which revealed the population to be 983. Within the City, there is a total cf six street crossings on CSX's railroad. The railroad traverses the center of the City with one main line and one storage line which permits trains traveling in opposite directions to pass each other. All the crossings fall within .76 of a mile and are located on traffic routes intersecting with the City's main thoroughfares; Main street running parallel to the west side of the railroad and Market street running parallel to the railroad's east side. In addition to the crossing located on East Dade Avenue, the other five crossings in the City are located on East Seminole Avenue, Central Avenue, Bushnell Plaza, Noble Avenue and Belt Avenue. While the East Dade Avenue crossing is un-signalized, the other five crossings are protected by flashing lights, bells and gates. Factors usually considered in determining need for a railroad crossing are locations of schools, hospita1s, fire stations and police stations. Also considered are volume and type of railroad and vehicular traffic; availability of alternate crossings; whether alternate crossings require use of excessively circuitous routes; whether the crossing presents a restrictive view to crossing traffic; the length of time that the crossing is blocked to crossing traffic by train activity; motor vehicular and train speed limits in the area; and the number of accidents occurring at the crossing. There are no hospital facilities within the City. The elementary school is located south of East Dade Avenue near Noble Avenue and Bushnell Plaza. The high school is located north of Belt Avenue and west of the railroad outside of the city. The East Dade Avenue crossing is not included in any school bus route for either school. The City Hall and Police station are located adjacent to Noble Avenue. This location is south of East Dade Avenue and east of the railroad. The East Dade Avenue crossing is not a regularly used route for fire and police vehicles, although it does serve as a main alternate route for those vehicles. The major reason for usage of the East Dade Avenue crossing as an alternate route for fire and police vehicles is the lack of traffic signalization at the intersection of East Dade Avenue with Main and Market Streets. Since Bushnell has no preemptive circuitry for existing traffic signals at the other nearby signalized alternative routes, closing the East Dade Avenue crossing would constitute an excessive restriction to emergency vehicles in the form of inordinate delay in their response time while waiting for traffic lights at more heavily travelled alternative intersections. Such delay would subtract from the limited time available to emergency personnel, commonly known as the "golden hour", to render aid to individuals requiring immediate attention. The Dade Avenue crossing is 580.8 feet, 686.4 feet and 1108.8 feet from Belt Avenue, Noble Avenue and Bushnell Plaza, respectively. In the event that the East Dade Avenue crossing is closed, it is estimated that motorists desiring access to East Dade Avenue from Market Avenue will only need to travel an additional few seconds and use Belt Avenue to then access East Dade Avenue. DOT conducted traffic counts on East Dade Avenue on February 5, 1990 through February 19, 1990. The results show that an average of 367 westbound vehicles use the crossing daily. A total of 178 eastbound vehicles utilize the crossing on a daily basis. An average of 16 trains use the tracks daily, passing through the City at approximately 35 miles per hour. The storage track, located on the west side of the main line, presents an obstacle to observation by an eastbound motorist on East Dade Avenue if a train is on the storage track. The lack of railroad signalization at the Dade Avenue intersection with Main and Market Streets presents a potential for automobiles, waiting at the stop sign on East Dade Avenue for approaching vehicles on Main and Market Streets to pass, to become trapped on the railroad tracks. Further, East Dade Avenue does not provide a direct route to any of the City's points of interest or public facilities. DOT quantifies the relative safety railroad crossings through the assignment of a safety index number to each crossing in the state. In a comparison of railroad crossings, a higher safety index number for one crossing implies a higher level of safety at that crossing. The determination of the safety index number for a crossing includes consideration of traffic volume at the crossing. East Dade Avenue has the highest safety index of any of the six railroad crossings in Bushnell. As determined by DOT traffic counts conducted in February of 1990, the crossing also has the lowest average daily traffic use of any of the six crossings, a determinative factor in accident occurrence. Belt Avenue and Noble Avenue, the two crossings immediately adjacent to the north and the south of the East Dade Avenue crossing have average daily traffic counts of 2,715 and 6,080, respectively. In view of the low traffic count at the East Dade Avenue crossing, closure of that crossing may increase Belt Avenue crossing traffic from 2,715 to 3,023 and Noble Avenue traffic from 6,080 to 6,388. The minor increase in traffic at the Belt Avenue and Noble Avenue crossings in the event of closure of the East Dade Avenue crossing would have no appreciable effect in the safety index presently accorded those two crossings. The Belt Avenue crossing safety index could be expected to decline from 65 to 64.4 and the Noble Avenue index could be expected to decline from 59.8 to 59.6. The CSX railroad contemplates the expenditure of $1,277 a year to maintain the East Dade Avenue crossing. This cost figure includes only the cost of surface maintenance and does not include any cost of maintenance of any future signalization that might be installed at the crossing in lieu of the crossing's closure. Funding has been reserved to signalize the East Dade Avenue crossing in the event the crossing is not closed. The CSX railroad also contemplates that closing the East Dade Avenue crossing will increase the likelihood that trains will be permitted to travel through the City at speeds closer to the line speeds (some as high as 79 miles per hour) realized outside the City, resulting in more economical operation of train engines and thereby yielding some savings to the railroad. No authorization regarding such increased speed limits has been given by DOT or Bushnell to the railroad at the present time. Bushnell's comprehensive plan assumes that the East Dade Avenue crossing will remain open as part of the total traffic circulation element of that plan. The City's comprehensive plan was not reviewed by DOT's diagnostic team in the course of their research regarding whether to recommend closure of she East Dade Avenue crossing, nor did the team hold any consultation with City officials regarding the plan. Closure of the East Dade Avenue crossing would adversely affect existing and proposed local businesses on East Dade Avenue near the intersection with Main and Market Streets because such action would prohibit direct access to Main Street. DOT has established a policy manual, agency procedures applicable to any implementation of the agency's decisions to close railroad crossings. Pertinent procedures in section 1.4.9 of that manual restate rule closure criteria contained in the agency's promulgated administrative rules and emphasizes that no crossing should be closed that serves as a main or alternative route for emergency vehicles. Implementation of any proposed closure of a crossing is to be accomplished in accordance with section 2.3.4 of the manual which also states that a crossing should not be closed if it serves as a main or alternative route for emergency vehicles. This section further prescribes that consultations should be had with city, county and state planning agencies to determine closure compatibility with established growth plans.

Recommendation Based on the foregoing, it is hereby RECOMMENDED that a Final Order be entered denying the requested permit for closure of the East Dade Avenue crossing. The Issue Whether the Petitioner, CSX Transportation, Inc., is entitled to close an at-grade railroad crossing on Country Lane in Santa Rosa County, Florida?

Findings Of Fact The Parties. CSX Transportation, Inc. (hereinafter referred to as "CSX"), operates a railroad which runs essentially east-west through Santa Rosa County, Florida. The Department of Transportation (hereinafter referred to as the "Department"), is charged pursuant to Section 335.141, Florida Statutes, and Rule 14-46.003, Florida Administrative Code, with responsibility for authorizing the closure of public railroad crossings. The Respondents who appeared at the final hearing of these cases live and their addresses in Santa Rosa County are as follows: Clyde L. & Susan S. Godwin 3321 Hudson Bend India B. McLeod 900 North 21st Avenue Earl W. & Zanola R. Gatewood 1361 Tinsley Road Lucille Williams Gatewood 5212 Tinsley Road Mary W. Henderson 3480 Country Lane Clifton D. & Christa Childers 1013 North 16th Avenue Respondents John F. and Katherine H. Edwards live at 2401 Old Military Road, Mobile, Alabama. They own a house on Santa Cruz Boulevard in Santa Rosa County. CSX's Application. On or about April 29, 1993, CSX filed a Railroad Grade Crossing Application (hereinafter referred to as the "Application"), with the Department. DOT Exhibit 1. Pursuant to the Application, CSX sought permission from the Department to close an at-grade railroad crossing (hereinafter referred to as the "Crossing"), located on Country Lane, at railroad mile post SP 664.46 in Santa Rosa County, southwest of Milton, Florida. The Crossing has been designated as "339760G" by the Department. The Crossing runs in a northeast-southwest direction. An "at-grade" railroad crossing is a railroad crossing where the railroad track and a road crossing meet at the same plane or grade. On or about September 24, 1993, the Department issued an Intent to Close Permit approving the Application. DOT Exhibit 2. The Respondents timely filed petitions challenging this proposed agency action. The Crossing. Approximately 8 freight trains use the Crossing daily. Additionally, 2 passenger trains use the Crossing three times a week. The freight trains carry hazardous materials. The evidence, however, failed to prove how often. During a twenty-four hour period, approximately 112 vehicles drove over the Crossing on Country Lane. There are no flashing lights or gates located at the Crossing. There are no plans in the immediate future to add gates or lights at the Crossing. Existing warnings at the Crossing consist of a round, yellow warning sign and a "crossbuck" warning sign just to the north and to the south of the Crossing. These signs, because of trees, are not visible to vehicular traffic on Country Lane until just before reaching the railroad tracks. Traveling to the south on Country Lane, there is little visibility of the tracks due to vegetation. Traveling to the north on Country Lane, there is slightly more visibility. There are sharp drops in elevation on both sides of Country Lane immediately to the north of the railroad tracks. A vehicle could easily become stuck if it were to drive off the road at this location. Passenger trains travel at a maximum speed of 59 miles per hour at the Crossing and freight trains travel at a maximum speed of 49 miles per hour or 25 miles per hour it carrying hazardous material. The Area Surrounding the Crossing. The road that intersects the Crossing is Country Lane: Country Lane runs north-south from County Road 191A in the north to Santa Cruz Boulevard in the south. Country Lane is approximately 1.1 miles long from County Road 191A to Santa Cruz Boulevard. It is approximately .15 mile from County Road 191A to the Crossing. Country Lane is paved from County Road 191A to just south of the Crossing. The rest of Country Lane is a dirt road. Country Lane is approximately 12 to 14 feet wide. There are approximately 14 homes on Country Lane and two short roads that begin and end on County Lane: Hudson Bend Road and Solor Drive. Approximately .20 mile south of 191A, Country Lane intersects with Tinsley Road: Tinsley Road is a poorly paved county road, approximately 12 feet wide. Tinsley Road runs east-west from Country Lane in the east to County Road 281 in the west. There are approximately six houses on Tinsley Road. County Road 191A is a two-lane, paved road that runs northeast- southwest. To the northeast, County Road 191A goes to Milton. To the southwest, County Road 191A intersects with County Road 281. County Road 191A is a two-lane, paved road, approximately 20 to 22 feet wide with 6 feet wide shoulders. County Road 281 runs north-south, from County Road 191A in the north, to the south over a bridge spanning Mulatto Bay, and then runs to the east to County Road 281A. County Road 281 is a two-lane, paved road, approximately 20 to 22 feet wide with 6 feet wide shoulders. County Road 281A runs north-south. In the south, County Road 281A intersects with Interstate 10. In the north, County Road 281A intersects with County Road 191A. It is also connected to County Road 191A, south of its northern intersection with County Road 191A, by County Road 191B. County Road 281A crosses the CSX railroad line that runs to the Crossing. County Road 281A crosses the railroad line by an overpass. Access to Country Lane and the Surrounding Area. Vehicles, including emergency vehicles, coming from the northeast down County Road 191A may access the fourteen houses located on Country Lane, Hudson Bend Road and Solor Drive by using Country Lane and crossing the railroad at the Crossing. If the Crossing is closed, vehicles coming from the northeast down County Road 191A are required to travel to County Road 281, go south on County Road 281 across the railroad to Tinsley Road and then east on Tinsley Road to Country Lane (hereinafter referred to as the "Alternative Route") to access thirteen of the houses on Country Lane, Hudson Bend Road and Solor Drive (the fourteenth house is located to the north of the railroad). It is approximately one fourth of a mile from the intersection of County Road 191A and Country Lane around to Country Lane south of the Crossing via the Alternative Route. Driving the speed limit, it takes just over one minute to drive the Alternative Route. The Alternative Route can accommodate the additional traffic that would result from closure of the Crossing. Country Lane may also be accessed from the south by taking County Road 281A to County Road 281, traveling west and then north to either Santa Cruz Boulevard or Tinsley Road, and then east to Country Lane. There is a fire station located northeast of Country Lane on County Road 191A. The fire station is approximately 1 mile from the junction of County Road 281 and County Road 191A. It takes approximately 1 minute and 36 seconds to drive, at the posted speed, from the fire station to Country Lane. It takes approximately 2 minutes and 30 seconds to drive from the fire station to Country Lane using the Alternative Route. If the railroad crossing at County Road 281 were closed, traffic coming from the northeast may return northeast on County Road 191A, east on County Road 191B, south on County Road 281A, west and then north over Mulatto Bay on County Road 281 to Santa Cruz Boulevard or Tinsley (hereinafter referred to as the "Southern Route). From the fire station to Country Lane via this route is approximately 4.7 miles and takes approximately 6 minutes and 18 seconds to drive at the posted speed. From the north of the railroad crossing on County Road 281 via this route is approximately 6.2 miles. Emergency vehicles would not be restricted to traveling at the posted speed limits. The potential for a vehicle finding access to Country Lane and the surrounding area blocked from the north because of a train halted at the railroad crossing will be increased if the Crossing is closed. Currently, if the Crossing is blocked by a train, vehicles can use the Alternative Route and, if the crossing on County Road 281 is blocked by a train, vehicles can use the Crossing. If the Crossing is closed and the crossing at County Road 281 is blocked, vehicles may be required to use the Southern Route. The evidence failed to prove how often this happens. If the Crossing is not closed and both the Crossing and the crossing on County Road 281 are blocked by a train at the same time, there will be no access from the north and vehicles may still have to use the Southern Route. At least one of the Respondents has witnessed both crossings being blocked at the same time. Although trains may block the crossing at County Road 281 for 10 to 15 minutes, they do so rarely. It is more likely that traffic may be blocked from 5 to 10 minutes while train cars are being dropped off at a plant located on a spur of the railroad located to the west of the Crossing. If the Crossing is closed and both the crossing at County Road 281 and the bridge on County Road 281 are blocked, residents will not be able to evacuate from Country Lane or the surrounding area. The evidence, however, failed to prove the probability of such an event or the probability that residents would have to be evacuated. The evidence failed to prove that, while there may be some inconvenience to the Respondents if the Crossing is closed, the inconvenience will be significant. Two acceptable, alternative routes for access to the area exist and those routes can handle any additional traffic caused by closure of the Crossing. Safety. Railroad crossings are potentially dangerous. If an accident takes place at a railroad crossing, the adverse consequences are, more often than not, extremely severe. The evidence in this case failed to prove that there have actually been accidents at the Crossing. Comments concerning possible accidents at the Crossing were not made during sworn testimony. Because of the conditions at the Crossings (lack of warning devices, excessive vegetation causing lack of visibility, and the poor condition of the road surface), the potential for an accident at the Crossing is high. Cost Required to Improve the Crossing. It would cost in excess of $80,000.00 to add warning lights and gates to the Crossing. It would cost approximately $20,000.00 to improve and widen Country Lane. Emergency Vehicles. Emergency vehicles which may need to access the area south of the Crossings will come from the northeast toward Milton. If the Crossing is closed, emergency vehicles can use the Alternative Route or the Southern Route. The evidence failed to prove that response times will be significantly impacted by closure of the Crossings.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Department of Transportation enter a Final Order dismissing the petitions in this case and approving the application of CSX Transportation, Inc. Findings Of Fact The petitioners are in the process of constructing a rural connector road between State Road 11 and U. S. Highway 1 in Flagler County. This is to be a two-lane twenty (20) foot wide pavement secondary road with the right-of-way acquisition and construction costs being provided by secondary gasoline tax funds allocated to Flagler County. The county has provided the necessary rights-of-way for the project. The project, as designed, provides for a realignment of the existing road to afford a straight approach to its connection with U. S. Highway 1. This realignment will eliminate the existing railroad crossing that is presently signalized with passive signalization consisting of standard cross-buck signs. The closing of the crossing will also eliminate a hazardous condition due to the sharp angles involved in the highway alignment at the present crossing. The proposed crossing is to be approximately 600 feet north of the existing crossing. Provision has been allowed for ingress and egress to individuals living in the area. The proposed crossing will intersect with the railroad tracks almost perpendicularly. The railroad, at this location, consists of a single track. There are sixteen (16) freight trains scheduled per day with a maximum speed of 60 miles per hour. In the vicinity of the proposed crossing the railroad track is straight. There is a curve in the track approximately 700 feet north from the proposed crossing. As a part of the proposed crossing there is to be Type II signalization installed consisting of a train-activated cantilevered flashing lights and ringing bells. These cantilevered signals are to be mounted on roadside posts which will allow maximum shoulder clearance for a fixed object in accordance with current practice and still provide for two (2) flashing lights suspended directly over each driving lane. Traffic studies conducted by the Planning Section of the Department of Transportation reflect that at present approximately 87 vehicles per day use the existing crossing. It is anticipated that 100 vehicles per day will use the proposed crossing when it is opened and projections estimate that in twenty (20) years approximately 400 vehicles per day will use the crossing. State Road S-304 is not used as a school bus route at this time nor is it anticipated that this road will be used for school buses in the foreseeable future. Permits to open and to close the crossing as applied for should be granted.

The Issue Whether the application for an at grade vehicle railroad crossing permit should be issued to the City of Holly Hill by the Department of Transportation.

Findings Of Fact The City of Holly Hill, Florida, filed an application with DOT for an at grade railroad crossing permit on Tenth Street at Milepost 107+1513', in the city of Holly Hill. The DOT denied the City's application by letter dated November 27, 1991, which enclosed the Department's intent to deny the permit. The City petitioned and received a hearing to consider its application. The City of Holly Hill is located due north of the City of Daytona Beach on the east coast of the state of Florida. It stretches west approximately a mile from the Halifax River, and runs north for approximately two miles from the northern boundaries of the City of Daytona Beach. Tenth Street, where the proposed railroad crossing would be located, is a local street running east and west in the City of Holly Hill, Florida. West of the Florida East Coast Railroad tracks, Tenth Street connects with Center Avenue and continues further west to connect with Nova Road, both of which are major north/south connectors. To the east of the Florida East Coast Railroad tracks, Tenth Street runs less than one block and terminates at its intersection with US 1, the major north/south arterial road in Holly Hill. Immediately east of the Florida East Coast Railroad tracks in the vicinity of Tenth Street, the City of Holly Hill maintains Holly Land Park, a major recreational area in downtown Holly Hill. Immediately to the west of the Florida East Coast Railroad tracks, the City of Holly Hill maintains a nature trail and facilities related to its public works department. The City seeks the permit for an at grade crossing alleging that (1) a large number of pedestrians are illegally crossing the track and have persisted in doing so notwithstanding warnings and citations; and (2) the City feels that opening a crossing at Tenth Street would relieve bad traffic congestion existing on Eleventh Street just north of Tenth at Eleventh's intersection with US 1. Video tapes and the observations of police officers of the City of Holly Hill establish a significant level of pedestrian traffic by adults and children over the railroad tracks between the western and eastern ends of Tenth Street. This practice is very dangerous. Some of the pedestrians walk their bicycles over the railroad tracks at this location. The majority of the young people crossing the tracks in this vicinity are moving east to utilize the facilities in Holly Land Park or moving west to go to the middle school and grammar school located respectively at the intersections of Center Avenue and Walker Street and Center Avenue and Fifteenth Street. This is a popular route because of the heavy vehicle traffic on Eleventh Street and Eighth Street. Warnings, citations, and patrols have not halted the illegal crossing of the tracks. Eleventh Street is located 1300 feet to the north of Tenth Street and also runs east and west from the Halifax River westward to beyond Interstate 95. Plans call for the development of an interchange at the intersection of Interstate 95 and Eleventh Street. Eleventh Street appears to be the only street in downtown Holly Hill which moves directly west in this manner. From Nova Road east to US 1, Eleventh Street runs parallel to and north of a large drainage canal. Two shopping centers are located at the intersection of Eleventh Street and Nova Road. Eleventh Street is so close to this drainage feature that pedestrian walks on the southern side of Eleventh Street were removed. Because of this drainage structure, Eleventh Street cannot be inexpensively widened. To the south of Tenth Street 1320 feet, Eighth Street runs east and west from the Halifax River to Nova Road. Both Eleventh and Eighth Streets are two-way streets along their entire length. The City bases it petition to open the crossing upon traffic congestion caused by east bound traffic on Eleventh Street seeking to turn left on US 1, and by north bound traffic on US 1 seeking to turn left onto Eleventh Street when Eleventh Street is blocked by rail traffic. The I-95/Eleventh Street interchange will increase traffic congestion on Eleventh Street. The City asserts that opening the proposed crossing would alleviate this congestion because traffic using Eleventh Street would then use Tenth Street. The traffic count on Eleventh, Tenth, and Eighth Streets was measured by the county. The traffic on Eleventh Street was 10,744; on Tenth Street was 1,019; and on Sixth Street was 6,153. According to a traffic projection run by the county traffic operations supervisor, 1,000 vehicles would be diverted from Eleventh Street to Tenth Street if a vehicle at grade crossing were opened at Tenth Street. Although this projection is suspect because it was made without any origin and destination surveys being done, the shift of 1,000 vehicles from Eleventh Street to Tenth Street is negligible in terms of its present and projected impact on Eleventh Street. It was uncontraverted that a ground level pedestrian crossing with adequate gates and signals would permit pedestrians to cross the railroad tracks quickly and therefore reduce their exposure to train/bicycle accidents. (T- 81,135.) Opening an at grade crossing on Tenth Street would create a greater potential for car/train accidents by increasing the exposure of vehicle traffic to railroad traffic. This was also uncontraverted. The fire station is currently located in the back of City Hall which is located immediately across US 1 from Holly Land Park. Plans exist to move the fire station from its present current location to a location in the vicinity of the Public Works Department along Tenth Avenue. The public library which is currently located at Holly Land Park affronting on US 1 may be relocated to the old school building located south of the city hall. Movement from the fire- station at its proposed location would be no better or worse than it is now because Tenth Street does not extend east across US 1. Emergency equipment will have to use Eighth Street or Eleventh Street to go east, and these streets are also the best routes west. The proposed crossing is not necessary based upon the traffic studies prepared by the City. Assuming the shift of 1,000 cars from Eleventh Street to Tenth Street, this would not warrant the expense and the potential hazard generated by permitting the proposed railroad crossing. It was uncontraverted that the best way to solve the congestion problem on Eleventh Street would be to widen it. However, it was universally acknowledged that this would be very expensive. While evidence is contradictory, the most credible testimony supports using one-way pairs on Eleventh and Eighth Streets as a low cost interim measure to improve traffic flow along the arterial routes. (T-112,145 et seq., and 173.) In addition to the crossings located at Eleventh and Eighth Streets, there are also crossing located at next to through streets south of Eighth, and at Fromich Street north of Eleventh. There would be more than five public crossings located within one mile of railroad track if a crossing were opened at Tenth Street.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is, RECOMMENDED: That a Final Order be entered approving a pedestrian at grade crossing at Tenth Street in the City of Holly Hill, Volusia County, Florida; and That the Petition for a public at grade vehicular railroad crossing at Tenth Street in the City of Holly Hill, Volusia County, Florida be DENIED. The Issue Whether a permit should be granted for an at-grade crossing in the vicinity of Live Oak, Perry and South Georgia Railway Company Mile Post 1688 feet east of Mile Post 40.

Findings Of Fact Proper notice was given the parties and the hearing was delayed for thirty (30) minutes after time of notice in the event that the Respondent desired to make an appearance but was unavoidably detained. State Road 20 was relocated so that the subject crossing is necessary to the straightening and the realignment of the existing road. The average daily traffic is estimated to be 3,600 for the year 1976 and to be 4,800 in ten (10) years. The railroad is a single line trackage and is shown by the inventory to carry four (4) trains per day at 10 m.p.h. The tracks serve a local paper mill in Foley, Florida. An agreement has been worked out between the Department of Transportation and the Respondent railroad. The agreement provides for the protection and signalization at the location of the subject crossing and provides for the funding of the project. The prior or present crossing in this vicinity on State Road 20 will be open and in operation approximately 600 feet from the proposed crossing. Both crossings will have flashing lights and the existing crossing will carry primarily local traffic coming out of the county grade road. The new crossing will bear most of the traffic. The Respondent railroad is in agreement with the opening of the crossing; the Department of Transportation is in agreement that the additional crossing be permitted; the parties agree that the signalization shall be cantilevered flashing lights.

Recommendation Grant the permit to open the crossing. DONE and ORDERED this 12th day of February, 1976. DELPHENE C.
