Conclusions THIS CAUSE comes before the Agency for Health Care Administration (“the Agency") concerning the Agency’s preliminary denial of HERNANDO-PASCO HOSPICE, INC.’s (“HPH”) Certificate of Need CON") 10121 to establish a serve bed inpatient. On August 19, 2011, the Agency issued and published its State Agency Action Report reflecting its initial decision to deny HPH’s CON 10121. On September 6, 2011, HPH timely filed a Petition for a Formal Administrative Hearing with respect to the Agency’s denial. Prior to a final hearing, HPH corrected and clarified the architectural information previously submitted. The Agency and HPH entered into a Settlement Agreement (Exhibit 1) with HPH.
