The Issue Whether Petitioner is handicapped within the meaning of the Florida Fair Housing Act (Sections 760.20 – 760.37, Florida Statutes) or the Federal Fair Housing Act (42 USCA § 3601 et seq.).1 Whether Respondent discriminated against Petitioner in violation of either Act by refusing to waive its no pets policy, which would require Petitioner to remove his “emotional support animals” (two cats) from his condominium unit. Whether Respondent retaliated against Petitioner for his refusal to remove his cats from his condominium unit.

Findings Of Fact At all times relevant to this proceeding, Petitioner owned and resided in Unit 206 of the condominium building managed by Respondent. Petitioner is a male, born February 5, 1951. Respondent is the Board of Directors of the condominium building in which Petitioner resides. At all times relevant to this proceeding, Respondent had the following written policy (the no pets policy), which it routinely enforced2: 12. No Unit [sic] owner or lessee shall acquire a pet to be maintained in his or her unit, or shall such persons already possessing pets replace them when such pets die or are otherwise disposed of. No unit owner or lessee shall keep visiting pets in their unit. Petitioner bought Unit 206 in January 1999 and has since then lived alone in that unit with two cats. These cats have received no special training and have no special attributes. These cats were born to a cat that Petitioner and his late mother kept as a pet. Since his mother’s death in 1996, Petitioner has viewed these cats as his surrogate family. Respondent and Petitioner have engaged in a dispute regarding Petitioner’s alleged violation of its no pets policy that began in 1999 and is on-going. This dispute has involved multiple forums, with the current proceeding being the latest development. Respondent has received complaints from other residents of the condominium building that an unpleasant odor comes from Petitioner’s unit and that fleas have been found in the vicinity of his unit. On December 23, 2003, Dr. Seth Gottlieb, Petitioner’s physician, wrote the following: “To: Whom It May Concern:” William Kleinschmidt is a patient of mine. Mr. Kleinschmidt has a long-time severe physical disability and it is medically necessary that he his [sic] emotional support companion animals – his cats, to control the frequency and severity of his physical disability. By letter to Respondent’s president dated January 10, 2004, Petitioner asserted the following: While I realize that the Board and I disagree as to the interpretation of the condominium rules regarding pets, as my interpretation is based on the plain reading of the language within the common meaning of the said words, is that if a potential unit owner already has pets, they are acceptable and that no replacement pets will be brought in after the purchase. I may add that as a pre-condition to purchase of my unit, the board DID [sic] agree to my companion animals for my physical disability – the witnesses are both the buyer and the seller real estate brokers and others. I am requesting a special waiver of the pet rules as the board currently views them be made in my situation due to my disability. Please find attached a letter from my physician Seth Gottlieb, M.D., certifying that my companion animals are “medically necessary” for my disability. Please advise me in writing whether or not we have a special waiver as a reasonable accommodation. Although Respondent had been trying to force Petitioner to remove his cats from his unit since 1999, the letter of January 10, 2004, was the first time that Petitioner asserted that he was disabled and it was the first time he requested a waiver of the no pets policy to accommodate his disability. Prior to that letter, Respondent did not know and had no reason to know that Petitioner believed himself to be disabled. On April 19, 2004, Dr. Gottlieb wrote the following: “To: Whom It May Concern:” William Kleinschmidt is my patient, who has a significant emotional disability, as well as a long history of significant asthma. His asthma unfortunately has not been currently under good control. William clearly has a significant emotional component to his asthma, that is, his asthma is easily exacerbated by emotional triggers. William has companion animals which greatly help his emotional status. If he is not able to keep these companion animals there is a great likelihood that the emotional distress this will bring will significantly worsen his asthma. Therefore, it is medically necessary for William to have these emotional support animals to control the severity and frequency of his asthmatic disability. Dr. Gottlieb has no special training in psychiatry or psychology, and he did not treat or diagnose Petitioner’s anxiety. Dr. Gottlieb recommended to Petitioner that Petitioner seek professional help from a clinical psychologist or a psychiatrist. Petitioner refused to follow that recommendation. Petitioner has multiple allergens, one of which is cat dander. Dr. Gottlieb recommended to Petitioner that Petitioner seek professional help from an allergist. Petitioner refused to follow that recommendation. Dr. Gottlieb’s letters of December 23, 2003, and April 19, 2004, were written at Petitioner’s request and were based on statements made to him by Petitioner and on his observations of Petitioner. Dr. Gottlieb testified that he had never known Petitioner to be without his cats and he had no way of knowing what the consequences would be if Petitioner was unable to keep his cats. Dr. Gottlieb’s testimony does not establish that it is medically necessary for Respondent to waive its no pets policy as a reasonable accommodation of Petitioner’s handicapping conditions. Petitioner is a person with a handicap within the meaning of the Acts.3 At all times relevant to this proceeding, Petitioner has suffered from persistent asthma and emotional problems. There was no expert testimony as to the nature and extent of Petitioner’s emotional problems, but it is clear from the evidence that his emotional problems are debilitating. Petitioner is receiving no treatment for his emotional problems. Petitioner is receiving treatment from Dr. Gottlieb for his asthma. His asthma responds to medication prescribed by Dr. Gottlieb, but his asthma is not controlled by that medication and he suffers periodic asthma attacks of undetermined frequency and severity. Petitioner failed to establish that his two untrained cats are necessary for him to have equal opportunity to use and enjoy his dwelling within the meaning of either of the Acts. Petitioner’s cats are pets and while they undoubtedly provide emotional support as any pet should, they are not service animals4 and they have no special training that would enable them to assist Petitioner to overcome limitations imposed by his handicaps. Whether Petitioner’s cats help him avoid anxiety attacks, which could, in turn, trigger an asthma attack, is speculative. Petitioner asserts that two incidents prove that Respondent harassed him and retaliated against him because of his refusal to remove his cats from his unit. The first incident occurred in 2001 while Respondent was attempting to serve Petitioner with a subpoena during an arbitration proceeding. Because Respondent had difficulty serving a subpoena on Petitioner, Respondent had the arbitrator issue an order authorizing Respondent to have a locksmith open the door to Petitioner’s unit so the subpoena could be left in the unit. On September 21, 2001, Respondent hired a locksmith who unlocked the front door to Petitioner’s unit by drilling the lock on the door. A representative of Respondent thereafter entered Petitioner’s unit and left the subpoena for Petitioner inside the unit. An armed police officer was present when the door was opened and when Respondent’s representative entered the unit, left the subpoena, and exited the unit. These events occurred before Respondent had any reason to believe that Petitioner considered himself disabled or that he considered his cats to be emotional support animals. Respondent established that it was acting on advice of counsel and pursuant to the arbitrator’s order on September 21, 2001. Petitioner failed to establish that the events of September 21, 2001, were done to harass him or retaliate against him for asserting his rights under either Act. The second incident occurred in October 2003, when Respondent failed to give Petitioner proper credit for a maintenance assessment Petitioner had made. As a result of the error, Respondent wrote Petitioner a dun letter which reminded Petitioner that the failure to pay maintenance assessments could result in the imposition of a lien against his unit. Respondent failed to properly credit Petitioner’s payment as the result of a bookkeeping error. Respondent corrected the error as soon as Respondent’s bookkeeper discovered it. Soon thereafter, Respondent provided a written explanation of the error to Petitioner and apologized to him for the error. Petitioner failed to establish that the events of October 23, 2003, were done to harass him or retaliate against him for asserting his rights under either Act.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the FCHR enter a final order dismissing Petitioner’s Petition for Relief. The Issue Whether Respondents engaged in a discriminatory housing practice in violation of the Florida Fair Housing Act, as amended, sections 760.20 through 760.37, Florida Statutes (2011)1/.

Findings Of Fact Background Respondents Hoyt and Nancy Davis (the Davises) own a residential property located at 1856 Cross Pointe Way, St. Augustine, Florida (the Property). The Property is utilized exclusively as a rental. Respondent Florida Coastal Jacksonville Realty, Inc. ("Florida Coastal") and its principal John McMenamy ("McMenamy") acted as listing agents for the Property (collectively, the "Broker Respondents"). Mr. McMenamy and his company have managed the rental of the Property for approximately six years. In association with their listing of the Property, the Broker Respondents were responsible for advertising, showing, accepting applications for and assisting in the selection of tenants for the Property. At the time of the events in question, the Property was being offered for lease at a rate of $1,450 per month. Generally, due to its location within a St. Johns County golf community and proximity to good schools, the Property rents easily and quickly. The Rental Applications On May 14, 2010, Petitioner Jaime Terry (Mrs. Terry) contacted McMenamy regarding the Property. McMenamy instructed Mrs. Terry on the rental application process. On the afternoon of Sunday, May 16, 2010, Petitioners submitted via e-mail their rental application, dated May 15, 2010. On their application, the Petitioners disclosed that they had previously declared bankruptcy. The bankruptcy was entered in December 2007 and discharged in January 2009. Petitioners also disclosed that they were currently living with Mrs. Terry's parents. The application included a statement of the Terrys' monthly income, and also disclosed that they had three children residing with them -- aged eleven, five and two at the time. A memo attached to the application elaborated on the bankruptcy and other details of their employment and financial situation. Mrs. Terry testified that during the application process the Respondents did not solicit additional information concerning her employment history. On May 18, 2010, McMenamy ran a credit check on the Terrys using the "Online Rental Exchange." The credit report for Jaime Terry reflected a credit score of 664, while Steven Terry's assigned score was 649. However, both reports noted "conditional" approval because of the bankruptcy filing. Although the exact date is unknown, at approximately the same time that the Terrys submitted their application, another couple, Rick and Jessica Egger (the Eggers) contacted McMenamy regarding their interest in possibly renting the Property. On the evening of Thursday, May 20, 2010, the Eggers formally submitted an application to rent the Property. The Eggers' application disclosed that, unlike the Terrys', they did not have a bankruptcy in their history. In addition, the Eggers' combined monthly income was higher than the Terrys'2/ and the younger of their two children was nine years old. The credit report obtained for the Eggers reflected a credit score of 672 for Jessica Egger and 696 for Rick Egger, with an unconditional approval rating. Respondents' Tenant Selection Process McMenamy testified that in evaluating applications, potential tenants must meet certain minimum criteria. Factors he considers in assessing applicants include credit checks, criminal background checks, employment status, and rental history. However, he agreed that the evaluation process he uses is subjective. McMenamy acknowledged that bankruptcy would not automatically disqualify a potential tenant, and in fact, confirmed that he has rented to tenants who have a bankruptcy in their history. With regard to credit scores, McMenamy testified that he considered a score below 500 to be unacceptable. Mrs. Davis testified that McMenamy manages the entire process of renting the Property on behalf of herself and her husband. Once McMenamy determines the suitability of a prospective tenant, he discusses that tenant with the Davises. McMenamy does not discuss applicants with the Davises that he does not consider eligible. The Davises do not participate in the background screening process and they do not review applicants' credit ratings. However, Mrs. Davis was aware of McMenamy's process for selecting tenants, and she confirmed her understanding that applicants must meet certain minimum requirements. In selecting a tenant, McMenamy looks not only for a candidate that is financially qualified, but also one who will rent the property for a significant period of time, will take good care of the property, and will make monthly rent payments in a timely manner, according to Mrs. Davis. Denial of Petitioners' Lease Application Mr. Davis testified that he and Mrs. Davis discussed the Petitioners' application with McMenamy. At hearing, Mr. Davis recounted that conversation as follows: Cross-examination by Mr. Organes: Q. Mr. Davis, you stated that you had discussed with Mr. McMenamy the application of Steven and Jaime Terry? A. Yes. Q. And that’s a common practice with Mr. McMenamy as when he receives reasonably qualified applicants, he discusses them with you? A. Yes. Q. And that’s what he did with the Terrys? A. Yes. Q. And you said you did not tell him not to rent to them because of their children? A. That is true, we did not tell him. Q. The issue of children wasn’t discussed at all? A. No. Q. What reason did you give him to tell them why their application was being denied? A. Because of their past rental history and their bankruptcy foreclosure. Q. In general if you don’t approve of an applicant, what reason would you give for denying that applicant? A. I would give that reason, that we didn’t feel that, you know, we probably would get a better applicant and the reason we turned them down is because we didn’t feel that they were suitable for our rental. There is no evidence in this record as to precisely when the above conversation between the Respondents took place, although based upon Mr. Davis's statement that "we probably would get a better applicant" it is reasonable to infer that it was prior to the Eggers submitting their application on the evening of Thursday, May 20, 2010.3/ Early on the morning of Friday, May 21, 2010, McMenamy sent an e-mail to Ms. Terry, which read: Jaime I left a message yesterday but did not hear from you. I spoke to the owner about the application and she was concerned about not really having any rental history and the number of small children. She is a perfectionist and just had the home professionally painted. The one family who lived there had small children and there were handprints all over the walls so that it needed to be repainted. So this was her main concern and therefore does not want to rent to you and the family. If you have any questions please call. Sincerely, John At hearing, Mrs. Davis maintained that the Petitioners' children were not the determining factor in the decision to deny their application. Rather, it was based on their finances and lack of rental history. Consistent with Mr. Davis's testimony, Mrs. Davis also testified that she and her husband did not instruct McMenamy to reject the Petitioners' application because of their children. After being informed that their application was denied, Petitioners immediately began searching for alternate housing. Mrs. Terry testified that their primary concern was to locate a rental in a high quality school district. Within a couple of weeks of receiving the denial e-mail from McMenamy, the Terrys located a home at 983 Lilac Loop, St. Johns, Florida. Petitioners entered into a lease for this property on June 6, 2010; the rent was $ 1,200 per month. Although the Lilac Loop home was acceptable, the Terrys considered it to be inferior to the Property, and Petitioners paid to have the home repainted and wired for cable access. The cable installation fee was $150.00. On September 22, 2010, Petitioners were notified that the Lilac Loop house was in foreclosure. Petitioners appealed to a default-law organization in an attempt to enforce their one-year lease, but were ultimately unsuccessful. As a result of the foreclosure, Petitioners were forced to seek alternative housing within the same school district, and in November 2010, leased a property at 1528 Summerdown Way, Fruit Cove, Florida, 32259. The monthly rent at 1528 Summerdown Way was $1,600 monthly. Petitioners also incurred additional expenses necessitated by hiring a moving service, in the amount of $773.50. At of the hearing, Petitioners continued to reside in the Summerdown Way rental. The Commission Investigation On August 16, 2010, the Terrys filed a Housing Discrimination Complaint with HUD alleging they had been unlawfully discriminated against by Respondents based upon their familial status. Thereafter, the Commission opened an investigation of the allegation. As part of that investigation, Respondents were invited to submit written statements setting forth their version of the events at issue, and any defenses to the allegation they wished to raise. On August 19, 2010, the Davises submitted a written statement to the FCHR. In the first paragraph of that submittal the Davises stated: To Whom it May Concern: We enlisted realtor John MaMenamy to find a new tenant for our rental house at 1856 Cross Pointe Way, St. Augustine, FL 32092. Mr. McMenamy was told that we preferred not to rent to someone with more than one, if any, very small children at this particular time. The reason being we just had to have the interior of the house professionally repainted and repairs made to several areas, the walls in particular. Additionally, in light of the fact there were several highly qualified persons interested in and looking at the house concurrently. The submittal continued by identifying four former tenants of the Property, as well as the current tenants (the Eggers), all of whom had children living with them. It is found that McMenamy's e-mail of May 21, 2010, and the Davises' letter of August 19, 2010, constitute direct evidence that Respondents' decision not to rent to Petitioners was based upon their familial status. The testimony of McMenamy and the Davises that familial status was not the reason for refusing to rent to Petitioners is rejected as not credible.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order finding Respondents guilty of a discriminatory housing practice against the Terrys in violation of section 760.23(1) and (2), and prohibiting further unlawful housing practices by Respondents. The Issue The issue is whether Respondent is guilty of housing discrimination against Respondent based on her race and disabilities, in violation of the Florida Fair Housing Act, Sections 760.20-760.37, Florida Statutes.

Findings Of Fact Petitioner is African-American, although the record fails to disclose any physical or mental disability. Due to her pending eviction at an apartment complex known as the Tennis Club in Fort Lauderdale, Petitioner visited the Venice Cove apartment complex, also in Fort Lauderdale, in the summer of 2002. Deciding that she liked Venice Cove, Petitioner applied for a one bedroom apartment on September 16, 2002. In accordance with its customary practice, Respondent obtained a credit report and learned that Petitioner owed a utility payment, possibly a cable television box. Respondent advised Petitioner that she would have to satisfy this debt to rent an apartment, and Petitioner did so. At some point, Petitioner decided that she wanted a two bedroom/two bathroom apartment, and Respondent tentatively assigned her a unit of this type, pending final approval of her application to lease. Petitioner changed her preferences for type of apartment several times. Respondent was able to accommodate immediately all but one of these preferences. In early December, Petitioner mentioned to Respondent's representative that she was being evicted from the Tennis Club. This is the first time that Petitioner disclosed any eviction to Respondent. Examining the file, Respondent's representative realized that she had failed to order the more thorough credit report that Respondent had been using since November 2002. This report would reveal evictions, among other things. Respondent's representative ordered the more thorough credit report, which revealed that Respondent had been evicted three times. Respondent's policy precluded renting to a person with this rental history, and Respondent's representative promptly informed Petitioner that she was denying Petitioner's application. There is no evidence whatsoever that Respondent denied Petitioner's application on the basis of Petitioner's race or any disability from which she may suffer.

Recommendation It is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing Petitioner's Housing Discrimination Complaint. The Issue The issue to be determined is whether Respondents engaged in prohibited conduct against Petitioner by discriminating against him based on his race and/or national origin in the terms and conditions, privileges, or provision of services or facilities in the sale or rental of real property in violation of Section 760.23, Florida Statutes (2009).

Findings Of Fact Based on the oral and documentary evidence adduced at the final hearing and the entire record in this proceeding, the following Findings of Fact are made: The Florida Commission on Human Relations is the state agency charged with investigating complaints of discriminatory housing practices and enforcing the Fair Housing Act. It is also charged with investigating fair housing complaints filed with the federal Department of Housing and Urban Development under the Federal Fair Housing Act, 42 U.S.C. Section 3601, et seq. Petitioner, Emmanuel Agbara, is an adult, black male, who is of Nigerian decent. On or about September 18, 2008, Petitioner submitted an offer to purchase Condominium 406 in Orchid Springs Village. Because the real property sought to be purchased was a part of a condominium, there were several contingencies imposed by the declaration of condominium and associated house rules. Respondent, Orchid Springs Condominium, No. 200, Inc., is a non-profit corporation charged with the management of the condominium. Incidental to this responsibility, in conjunction with Bay Tree Management Company, the board of directors has the responsibility to approve or disapprove of the sale of a condominium to a third party. In the event the board of directors or Bay Tree Management Company disapproves of the sale, the condominium documents outline a procedure wherein the proposed sale can be pursued by the property owner and prospective buyer (Petitioner herein). After Orchid Springs advised Petitioner that it had not approved his sale, this alternative was not pursued. Orchid Springs is a part of a mixed-use development of condominiums, patio homes, and private [single-family] residences and is diverse in terms of religion, national origin and income. Prospective buyers, and the Petitioner herein, were required to complete an application that inquired into the prospective buyer's background, intended use of the property, and required three character references. In addition, prospective buyers were required to pay for a "background" check. On September 20, 2008, Petitioner traveled from his home in Maryland to meet with Respondent, John Carroll, president of the condominium board of directors. As they met, an inspection of the condominium unit was being conducted by a home inspection professional. Petitioner anticipated that he would meet with Carroll and two other board members for the personal interview required by the condominium documents as a prerequisite for board approval. The two board members were not available to meet with Petitioner during his September 20, 2008, visit. During the course of the discussion between Petitioner and Carroll, it became apparent that Petitioner anticipated being an "absentee landlord." Carroll advised Petitioner that the owner/residents had various problems with renters, including recent police activity incidental to a drug laboratory in one of the rented condominium units. Carroll also related that four of the absentee owner units were in foreclosure and that placed an economic burden on the remaining owners. During the discussion between Petitioner and Carroll, Petitioner inquired as to whether he could do the three-board member interview by telephone. Mr. Carroll advised him that a telephone conference might be arranged, but that one board member could not do it alone. On October 8, 2008, Petitioner submitted his Association Application. As a part of the application process, Petitioner certified that he had been supplied copies of the Articles of Declaration of Condominium Ownership and By-Laws of Orchid Springs Village, No. 200, Inc.; the Service and Maintenance Agreement; and the manual, "Condominium Living--The Seville." The Association Application includes the following language: "[A]pplicant purchasing Condominium certifies that he/she has . . . read [and] agrees to abide by" the foregoing documents. The Association Application states that "[i]mmediately after submission of the application, Applicant is requested to arrange with the President for a personal interview with at least [three] Board Members present. Such personal interview is a firm requirement [and] may not be waived." Following receipt of a prospective buyer or renter's Association Application, the tasks of conducting the customary background and criminal checks are divided among board members. In this instance, Mrs. Thibodaux, now deceased, did the background check; and Mrs. Douglas did the criminal background check, which, apparently, was a local records check utilizing the county records available through the internet. Testimony reveals that Mrs. Thibodaux reported that she had some problems with two of Petitioner's character references and that the Social Security number he provided was incorrect. This testimony is discounted as Mrs. Thibodaux is dead and not available to testify, and there is no indication that Petitioner's Social security number is incorrect. In addition, two of Petitioner's character references testified at the final hearing. Mrs. Douglas' local criminal background check revealed a January 13, 1997, arrest for battery--domestic violence. The case was "nolle prossed" after the Petitioner was placed in pre-trial diversion. Orchid Spring's critical examination and appraisal of prospective buyers and renters is apparently "slipshod," but not atypical when the prospective cost of a thorough examination that would involve an investigation of an individual's credit history and a thorough criminal and background check. Concern raised by the background and criminal check prompted Carroll to contact Petitioner and request that he come to Florida and meet with three board members for the interview required by the condominium documents. Petitioner was unable to meet with the interview committee. On November 7, 2008, Petitioner was advised by Respondents that his application had been denied. No evidence of damages was advanced by Petitioner.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief. The Issue The issue in this case is whether Respondent, Hardin Hammock Estates (hereinafter referred to as "Hardin"), discriminated against Petitioner, Ms. Celeste Washington (hereinafter referred to as Ms. Washington), on the basis of her race in violation of the Florida Fair Housing Act, Sections through 760.37, Florida Statutes.

Findings Of Fact The Parties. Celeste Washington is a black adult. Hardin is a housing rental complex with 200 single- family residences. Hardin is located in Miami-Dade County, Florida. Hardin provides "affordable housing" to lower-income individuals and, therefore, its residents are required to meet certain income requirements in order to be eligible for a residence at Hardin. At the times material to this proceeding, Hardin was managed by Reliance Management Incorporated (hereinafter referred to as "Reliance"). At the times material to this proceeding, Salah Youssif, an employee of Reliance, acted as the property manager at Hardin. Mr. Youssif is himself black, having been born in Sudan. Ms. Washington's Charge. On or about August 29, 2002, Ms. Washington filed a Complaint with the Commission. After investigation of the Complaint, the Commission issued a Determination of No Reasonable Cause, concluding that "reasonable cause does not exist to believe that a discriminatory housing practice has occurred" and dismissing the Complaint. On or about May 5, 2003, Ms. Washington filed a Petition with the Commission. Ms. Washington alleged in the Petition that Hardin had violated the Florida Fair Housing Act, Sections 760.20 through 760.36, Florida Statutes. In particular, Ms. Washington alleged that Hardin had "violated the Florida Fair Housing Act, as amended, in the manner described below": Washington was told that the waiting list at Hardin Hammock Estates was closed. She visited this development twice and was told the waiting [sic] was close [sic]. At that time she viewed the wating [sic] list and the majority of the names are [sic] Hispanic. Islanders do not consider themselves as Black Americans. The "ultimate facts alleged & entitlement to relief" asserted in the Petition are as follows: Hardin Hammocks has willful [sic] and [knowingly] practice [sic] discrimination in there [sic] selection practice and a strong possibility that the same incomes for Blacks & others [sic]. Black Americans rent is [sic] higher than others living in these [sic] developments. At hearing, Ms. Washington testified that Hardin had discriminated against her when an unidentified person refused to give her an application and that she believes the refusal was based upon her race. Management of Hardin; General Anti-Discrimination Policies. The residence selection policy established by Reliance specifically precludes discrimination based upon race. A human resource manual which describes the policy has been adopted by Reliance and all employees of Reliance working at Hardin have attended a workshop conducted by Reliances' human resource manager at which the anti-discrimination policy was addressed. An explanation of the Federal Fair Housing Law of the United States Department of Housing and Urban Development is prominently displayed in the public area of Hardin's offices in both English and Spanish. As of July 1, 2002, approximately 52 of Hardin's 200 units were rented to African-American families. Hardin's Application Policy. When Mr. Youssif became the property manager at Hardin, there were no vacancies and he found a disorganized, outdated waiting list of questionable accuracy. Mr. Youssif undertook the task of updating the list and organizing it. He determined that there were approximately 70 to 80 individuals or families waiting for vacancies at Hardin. Due to the rate of families moving out of Hardin, approximately one to two families a month, Mr. Youssif realized that if he maintained a waiting list of 50 individuals it would still take approximately two years for a residence to become available for all 50 individuals on the list. Mr. Youssif also realized that, over a two-year or longer period, the individuals on a waiting list of 50 or more individuals could change drastically: their incomes could change; they could find other affordable housing before a residence became available at Hardin; or they could move out of the area. Mr. Youssif decided that it would be best for Hardin and for individuals interested in finding affordable housing that Hardin would maintain a waiting list of only 50 individuals and that applications would not be given to any person, regardless of their race, while there were 50 individuals on the waiting list. Mr. Youssif instituted the new waiting list policy and applied it regardless of the race of an applicant. If there were less than 50 names on the waiting list, applications were accepted regardless of an individual's race; and if there were 50 or more names on the waiting list, no application was accepted regardless of an individual's race. Lack of Evidence of Discrimination. The only evidence Ms. Washington presented concerning her allegations of discriminatory treatment is that she is black. Although Ms. Washington was refused an application for housing at Hardin,3 the evidence failed to prove that Ms. Washington's race played any part in the decision not to give her an application.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that a final order be entered by the Florida Commission on Human Relations dismissing Celeste Washington's Petition for Relief. The Issue Whether Petitioner was the subject of discriminatory housing practices based on his race or his handicap, in violation of the Florida Fair Housing Act, chapter 760, Part II, Florida Statutes.

Findings Of Fact At all times relevant to this cause, Petitioner was a tenant of a rental apartment located at 284 South First Street, Apartment 6, Macclenny, Florida (the Apartment). Petitioner?s tenancy was established by a lease agreement with a final effective date of November 24, 2009. Petitioner moved out of the apartment on May 3, 2012. Respondent is a Florida Limited Liability Company. Among its other holdings, Respondent owns four 4-plex units located on First Street, Second Street, and Third Street in Macclenny, one of which includes the Apartment. The racial make-up of the tenants occupying Respondent?s apartments in the vicinity is roughly 50 percent African-American and 50 percent Caucasian. Petitioner is African-American. Petitioner has an unspecified mental condition. He takes medications for management of his symptoms, and receives periodic visits from Ms. Gadsby to ensure that he is complying with his medication regimen. Petitioner does not receive disability benefits from the Social Security Administration. Petitioner holds a bachelor?s degree in criminal justice from Benedict College in South Carolina. As part of the application for rental of the Apartment, Petitioner was asked “[h]ave you been arrested or had criminal charges filed against you? (If yes, please list them).” In response to the application question, Petitioner answered “yes Trepass [sic.].” The trespass charge was related to a misdemeanor incident that occurred at an unspecified time in Fort Lauderdale, Florida. Petitioner failed to disclose a felony conviction for an incident that had occurred in South Carolina. Petitioner stated that he thought the requirement to disclose criminal charges applied only to charges arising from incidents having occurred in Florida. However, nothing in the application can be read to support that limitation. As such, Petitioner materially falsified his lease application. Petitioner cut hair for members of his church, neighbors, family, and friends at the Apartment, and had done so for the two-and-one-half years of his tenancy. He equipped the Apartment with a barber chair and a small waiting area. He accepted “donations” of food, clothes, and cash for his services. The cash receipts were used to pay his electric and water bills, among other things. Thus, despite its small scale and limited clientele, Petitioner operated what can only be described as a barbershop from the Apartment. The Lease Agreement between Petitioner and Respondent provides that the Apartment was not to be used “for any other purpose than as a private dwelling unit.” The Lease Agreement also provides that Petitioner was to comply with all applicable building and housing codes. The Macclenny Code of Ordinances, Part III, Section 4-105, provides that home occupations are subordinate and incidental to a residential neighborhood, but that certain occupations, including barbershops, “shall not be considered as home occupations under any circumstance.” Thus, Petitioner?s operation of a barbershop from the Apartment was a violation of the Lease Agreement. There were no apparent landlord/tenant disputes involving Petitioner?s tenancy until late 2011. Mr. Stivender testified that he began to receive periodic complaints from tenants in the area regarding the Apartment, including cars being parked on the grass and in the road, loud music, and people milling about the premises. He testified that at least one tenant advised Respondent that she was afraid to venture out of her apartment due to the number of people in the area. The testimony of Mr. Stivender regarding complaints of other tenants would be hearsay if taken for the truth of the matters asserted. However, the undersigned accepts his testimony as evidence, not of the facts surrounding the alleged complaints, but of a non-discriminatory reason for actions to be described herein, most notably the events of March 6, 2012. At the end of October 2011, Petitioner was cited by Respondent for having more than one car regularly parked at the Apartment. Petitioner?s car was not in running condition. The other cars parked at the Apartment belonged to friends or relatives. Petitioner subsequently sold his vehicle, and would borrow his father?s or his cousin?s car when needed. The incident caused bad feelings between the parties. On November 1, 2011, Respondent sent a notice to each of its tenants in Macclenny. Although the notice was precipitated by the complaints against Petitioner and Respondent?s observations of activities in and around the Apartment, the notice was not limited to Petitioner. The notice cited provisions of the common lease agreement regarding the use of the premises and tenant conduct, and advised that excessive noise, driving on the grass, and “loitering” would be cause for eviction. The notice further advised that the landlord would “be patrolling the area on a regular basis at night to check for violations.” On March 6, 2012, Mr. Ferreria was driving by the Apartment at approximately 10:30 p.m. There were, along with Petitioner and his daughter, three guests at the Apartment, Bianca Gaines-Givens, Jacoby Givens, and Misty Lee. They were playing music on an electronic keyboard. Mr. Ferreria stopped his car on the side of the road. He called his property manager, Mr. Stivender, and advised him that he was going to go speak with Petitioner about the noise coming from the Apartment. Mr. Stivender works for a gas company, and was at work routing gas trucks. Mr. Stivender advised that he was going to come to the Apartment, and asked Mr. Ferreria to wait for him before speaking with Petitioner. Ms. Gaines-Givens and Mr. Jacoby Givens left the Apartment after Mr. Ferreria?s arrival in the neighborhood, and noticed Mr. Ferreria sitting in his vehicle. They drove away from the Apartment, but decided to return shortly thereafter. By the time they returned, Mr. Ferreria and Mr. Stivender were leaving. Thus, they did not witness the confrontation described herein. After Ms. Gaines-Givens and Mr. Jacoby Givens drove off, Mr. Ferreria, disregarding Mr. Stivender?s request, went to the Apartment and knocked on the door. It was, by then, approximately 10:45 p.m. When Petitioner answered the door, the two immediately began a heated discussion over the music and the cars. Ms. Lee went to the back of the Apartment when Mr. Ferreria arrived. She heard yelling, but heard nothing of a racial nature. Shortly after Mr. Ferreria arrived at the Apartment, Mr. Stivender arrived on the scene. Mr. Stivender is a solidly built man, and could be an intimidating presence under the right circumstances. These were the right circumstances. Mr. Stivender physically moved Mr. Ferreria out of the way, and came between Mr. Ferreria and Petitioner. He was primed for a confrontation. He had his hand in his pocket, but testified convincingly that he was not armed.1/ He and Petitioner had a loud and angry exchange of words, and Mr. Stivender forcefully suggested to Petitioner that it would probably be best if he moved out of the Apartment. After Mr. Stivender appeared on the scene, Ms. Lee came out from the back of the Apartment. She recognized Mr. Stivender as Respondent?s “office manager.” She noted that Mr. Stivender had his hand in his pocket, and was talking loudly and pointing his finger in Petitioner?s face. Ms. Lee went outside and spoke with Mr. Ferreria. She testified that Mr. Ferreria indicated that some of the neighbors were afraid of Petitioner because of the noise and the number of people who hung around the Apartment. The confrontation ended with Mr. Ferreria and Mr. Stivender leaving the premises. The police were not called. The next morning, Petitioner called Ms. Gadsby. Petitioner frequently called Ms. Gadsby when he was feeling “stressed.” She went to see him that morning, and testified that he was very upset over the events of the previous evening. She returned that afternoon for a “well-check,” and he was doing better. On March 15, 2012, Petitioner called the Baker County Sheriff?s Office to report the March 6, 2012, incident. A deputy went to the Apartment, spoke with Petitioner and Ms. Lee, took their sworn statements, and prepared an offense report. The description of the incident as reflected in the report, including statements made by Petitioner and Ms. Lee, did not contain any account of racial threats or epithets, or any allegation of discriminatory intent based on race or handicap.2/ Other than Mr. Stivender?s statement made in the heat of the March 6 argument, Respondent made no effort to evict or otherwise remove Petitioner from the Apartment. On March 31, 2012, Petitioner noticed water coming from behind a wall of the Apartment. He called Respondent, and Mr. Stivender came to the Apartment to inspect. Mr. Stivender first suspected that the air-conditioning unit was leaking. The air conditioner was turned off and Mr. Stivender left, intending to contact an air-conditioning repair service. By 6:00 p.m. on March 31, 2012, the rate of the leak was such that it was determined that a water pipe had burst under the foundation of the Apartment. Petitioner did not know where the shut-off valve was located, and was unable to stop the flow, which began to cover the floor in several rooms of the Apartment. Mr. Stivender returned to the Apartment, and determined that a car owned by one of Petitioner?s guests was parked on the grass, and was over the meter box with the shut- off valve. The car was moved, and the water turned off. Respondent called a plumber to fix the pipe. Since the pipe was under the foundation, and in order to avoid breaking up the slab, the repair was accomplished by re-routing the pipe in the wall of the Apartment. The repair entailed cutting an access hole in the drywall. That hole was not immediately repaired. Respondent also called Servpro to perform water cleanup services. The standing water was vacuumed up, and large fans and dehumidifiers were placed in the Apartment to dry it out. While the repairs and drying activities were ongoing, Respondent paid for Petitioner and his daughter to stay in a motel in Macclenny. They were there for three to four days. Respondent paid Petitioner?s power bill for the days that Petitioner was unable to use the Apartment. Petitioner returned to the Apartment, and stayed there for some time. He was upset that the access hole for the pipe repair had not been closed up, and that the baseboards had not been replaced in some areas. On April 9, 2012, Petitioner wrote to Respondent about the effects of the water leak. After thanking Respondent for the “compassion” shown to Petitioner and his family during the event, he complained about the damage to his personal property resulting from the water leak, and an odor “suggesting the presence of mold.” He stated his belief that his daughter?s preexisting asthma was aggravated by the smell in the Apartment. In his April 9, 2012, letter, Petitioner also stated that “due to my mental health condition, I am on prescribed medicine that has now been adjusted to assist me through this stressful situation.” Petitioner?s statement, which was not accompanied by any form of medical evidence, was not sufficient to place Respondent on notice that Petitioner had a record of having, or was regarded as having, any form of mental disability. Mr. Stivender testified that no one ever advised Respondent that Petitioner had a mental disability, and that Respondent had no such knowledge. The April 9, 2012, letter being insufficient on its own to convey such information, Mr. Stivender?s testimony is credited. On May 3, 2012, Petitioner moved out of the Apartment. He had been served with no eviction notice or other written request to vacate. Petitioner gave no notice to Respondent, but dropped off his key at Mr. Ferreria?s business on the day he moved out. Mr. Stivender testified that Petitioner left the Apartment in a filthy, deplorable condition. As a result, Respondent withheld Petitioner?s $400.00 security deposit to offset the costs of returning the Apartment to rentable condition. Petitioner testified that the Apartment was not in poor condition when he moved out, and that some of the damage was the result of the pipe leak. However, Petitioner did not testify, or even suggest, that the decision to withhold the deposit was the result of any racial hostility or animus, or of any reaction to his handicap. Petitioner failed to introduce any evidence that he was treated differently under similar circumstances than were tenants of Respondent who were not African-American, or who did not have comparable mental disabilities. Ultimate Findings of Fact There was no competent, substantial evidence adduced at the hearing that Respondent undertook any act pertaining to Petitioner?s occupancy of the Apartment based on Petitioner?s race. Petitioner failed to prove that Respondent knew of Petitioner?s mental disability or handicap, or that Respondent regarded Petitioner as having any such mental disability or handicap. Petitioner failed to prove that Petitioner?s race or handicap caused or contributed to the March 6, 2012, confrontation. Rather, the evidence demonstrates that the confrontation resulted from noise, issues with cars and parking, and complaints directed to Petitioner by other tenants. Petitioner failed to prove that he was ready, willing, and able to continue to rent the Apartment, but that Respondent refused to allow him to do so. Petitioner failed to prove that Respondent took any action to evict him from the Apartment, or to otherwise intentionally interfere with Petitioner?s occupancy of the premises. To the contrary, the evidence supports a finding that Respondent took reasonable and appropriate steps to repair and remediate the Apartment after the water line break, and provided no-cost accommodations to Petitioner while the Apartment was not habitable. The repairs may not have been completed to Petitioner?s satisfaction, but any such deficiency was not the result of discrimination against Petitioner based on his race or his handicap. Petitioner failed to prove that Respondent?s decision to withhold his security deposit was based on Petitioner?s race or handicap. In sum, the evidence did not establish that Petitioner was the subject of unlawful discrimination in the provision of services or facilities in connection with his dwelling based on his race or his handicap.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order dismissing the Petition for Relief filed in FCHR No. 2013H0034. The Issue Whether Petitioner was the subject of unlawful discrimination in the provision of services or facilities in connection with his dwelling based on his handicap, and whether Respondent refused to make reasonable accommodations in its rules, policies, practices, or services necessary to afford Petitioner equal opportunity to use and enjoy a dwelling in violation of the Florida Fair Housing Act, chapter 760, Part II, Florida Statutes.

Findings Of Fact Petitioner is a homeowner in the Royal Highlands community in Leesburg, Florida, and has been a member of the RHPOA since moving into his home in April 2001.1/ From September 2010, through February 2011, Petitioner served on the RHPOA Board of Directors. Respondent is a property owners? association, membership in which is limited to property owners in the Royal Highlands residential community in Leesburg, Florida. There are 1,499 homes in the Royal Highlands community. The community is divided into twelve “districts.” Respondent?s Board of Directors (Board) consists of one representative from each of the twelve districts. Meetings of the Board are held monthly, except for August when community activities are typically sparsely attended. Leland Management is a community association management company that provides management services to the RHPOA along with other community associations. Petitioner alleged that he suffers from a disability because he walks with the use of a cane, and that his ability to speak is impaired as a lingering effect of a 2004 neck surgery that involved insertion of an endotracheal tube during and immediately after the procedure. During the month of February 2011, Petitioner was running for reelection to the RHPOA Board of Directors. On the day of the election, and prior to the vote of the membership, Petitioner appeared at the RHPOA meeting to make a final statement and thank his supporters. He walked to the front of the community meeting room, known as the Great Hall, but did not want to take the steps up to the elevated stage for fear that he might lose his balance and fall off. Petitioner was given a microphone and he thanked his supporters from the base of the stage. Afterwards, he walked back to his seat. Petitioner was not reelected to the Board, but continued to attend meetings as a member of the RHPOA. A monthly meeting of the RHPOA was held on July 13, 2011. The agenda included four items, including an item that would authorize the Board of Directors to retain legal counsel in the event a threatened lawsuit was filed against Bob Fitzpatrick, who was then the president of the RHPOA. The nature of the potential lawsuit was not in evidence, except that it involved a complaint filed with the Lake County Sheriff by Petitioner against Mr. Fitzpatrick. Mr. Fitzpatrick recused himself from the vote, since any legal fees would be expended on his behalf as president. John Banahan, then the vice-president of the RHPOA, acted as chair during the consideration and vote on the agenda item. The RHPOA allows members to speak regarding any issue on the agenda. Members must sign a “Sign-Up Sheet to Speak to Agenda Item” for each item on which they wish to be heard. Members are allowed three minutes to speak on each issue for which they have signed up. The minutes regarding a particular agenda item typically reflect only whether a motion was made, who seconded the motion, who voted, and the results of the vote. When there is a significant amount of discussion, the minutes may, as did the minutes for the legal counsel agenda item of the July 13, 2011 meeting, include something no more detailed than “[m]uch discussion, residents and Board Members.” Neither the comments of property owners nor the discussions of the Board members as to an agenda item are recorded in the minutes of meetings of the RHPOA. When Petitioner was on the Board, he would routinely take notes at meetings, and then destroy the notes after the meeting was concluded. That was consistent with the practice described by other testifying members of the Board. Petitioner attended the July 13, 2011 meeting of the RHPOA with his wife. He entered the meeting room on his own power and without difficulty, though he used a cane, signed up at the door to speak on the agenda item regarding the Board?s proposal to retain legal counsel, and took a seat at one of the tables. Petitioner made no request for assistance of any kind at the time he signed up to speak. Stacey Peach attended the July 13, 2012 meeting as a representative of Leland Management. Ms. Peach periodically attends meetings of the various associations served by Leland Management. Her attendance at the July 13, 2012 RHPOA meeting was coincidental. Ms. Peach was seated at a table in front of Petitioner. When it was his turn to speak on the legal counsel agenda item, Petitioner was recognized by Mr. Banahan. Petitioner announced, without assistance of a microphone, that he could not go to the podium. Mr. Banahan noted “confusion” in the audience, but did not realize what was going on with regard to Petitioner?s request to speak on the agenda item, though he understood that Petitioner was unable to come to the podium at the front of the room. Mr. Banahan testified convincingly that he had no problem with Petitioner speaking from his seat. He was aware of at least two other instances in which a microphone was taken to an attendee of a Board meeting so as to allow them to speak while seated, one of which occurred when he was a member of the Board. Ms. Peach heard Petitioner state that he was not able to go to the podium to offer his comments. She thereupon got a portable microphone and handed it to Petitioner. Petitioner asked Ms. Peach if she would speak on his behalf. Petitioner had not spoken with Ms. Peach earlier, and his request caught her off guard. Not knowing what Petitioner wanted her to say, she declined to speak for him. Her refusal was based on surprise and uncertainty, and not on any discriminatory motive. After Ms. Peach declined to speak on Petitioner?s behalf, Petitioner took the microphone provided to him, and offered his comments on the agenda item from his seat. Petitioner testified that as long as the microphone was working, he saw no reason why he would not have been heard. Except for Ms. Hoffman, whose testimony is discussed below, the witnesses who were asked indicated they had no problem hearing what Petitioner had to say, though none could remember the substance. Petitioner testified that he made a specific request of Mr. Banahan to allow someone to speak on his behalf, and that Mr. Banahan refused the request. Petitioner?s testimony was contradicted by Ms. Peach, who was directly involved in the incident; Mr. Norden, who was seated next to Petitioner; Mr. Reichel, who attended the meeting as a Board member; and Mr. Banahan. The greater weight of the evidence establishes that no request for another person to speak on Petitioner?s behalf was made to any member of the Board, and that the only such request was made, without prior notice, to Ms. Peach. Petitioner?s claim that his request was denied by Mr. Banahan was supported only by the testimony of Ms. Hoffman. However, Ms. Hoffman?s testimony was undermined by the fact that her overall account of the incident differed in several significant and material respects from the testimony of other witnesses, including that of Petitioner. For example, Ms. Hoffman indicated that Ms. Peach was not asked to speak for Petitioner, that Petitioner asked someone seated next to him to speak, that Petitioner had difficulty reading his notes, that Petitioner was unable to complete his comments, and that Petitioner?s speech was, at best, marginal. Whether Ms. Hoffman?s description of events was the result of a poor vantage point or of poor memory, it is not credited. Mr. Banahan testified that if Petitioner had been unable to speak, he would have allowed someone to read a statement on his behalf.2/ However, Mr. Banahan testified that he was not asked to make such an accommodation, and that Petitioner was able to comment on the agenda item from his seat. Mr. Banahan?s testimony is credible and is accepted. Mr. Banahan testified that he has known Petitioner from his service as a member of the Board and never perceived him as having a handicap. Mr. Banahan knew that Petitioner walked with a cane. However, Mr. Banahan?s wife walks with a cane and he does not consider her to have a handicap. Petitioner provided Respondent with no medical records, letters from his physicians, or competent evidence of any kind to establish that he had a disability or that he required an accommodation in order to participate in the July 13, 2011 meeting, nor did he produce any such evidence at the hearing. At the hearing, based upon the undersigned's observation, Petitioner had little or no difficulty walking or speaking. Petitioner failed to prove that he has a physical impairment that substantially limits one or more major life activities, or that he was regarded by any director or member of the RHPOA as having any such physical impairment. To the contrary, the greater weight of the evidence demonstrates that Petitioner does not suffer from a handicap as defined in the Fair Housing Act. Ultimate Findings of Fact There was no competent, substantial evidence adduced at the hearing that Petitioner suffered from a handicap that hindered his ability to actively participate in the July 13, 2011 RHPOA meeting. There was no competent, substantial evidence adduced at the hearing that Respondent knew of any alleged handicap or regarded Petitioner as being handicapped. There was no competent, substantial evidence adduced at the hearing that Respondent failed to reasonably accommodate Petitioner when he asserted that he would not be able to walk to the podium. The evidence adduced at the hearing established that Petitioner made no direct request to any member of the RHPOA Board of Directors to allow someone to speak on his behalf. The evidence adduced at the hearing established that Petitioner was able to clearly state his comments on the legal representation agenda item by using the portable microphone provided to him by Ms. Peach. The evidence did not establish that Petitioner was the subject of unlawful discrimination in the provision of services or facilities in connection with his dwelling based on his handicap, or that Respondent refused to make reasonable accommodations in its rules, policies, practices or services necessary to afford Petitioner equal opportunity to use and enjoy his dwelling.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order dismissing the Petition for Relief filed in FCHR No. 2012H0158. The Issue Whether Respondent is liable to Petitioner for discrimination in the sale or rental of housing because of Petitioner’s alleged disability, in violation of the Florida Fair Housing Act.

Findings Of Fact In June 2016, Gaudina and Grand Lifestyle executed a document, entitled “GLC III/LLLP Lease – Basic Rental Agreement or Residential Lease” (lease), in which Gaudina leased from Grand Lifestyle a residence at 3346 East Dale Street, Leesburg, Florida, in the Lakeside Village mobile home park (premises). The lease provided that Gaudina pay to Grand Lifestyle $656.00 per month to lease the premises. The lease further provided that at the end of three consecutive years of living at the premises, Grand Lifestyle would provide Gaudina the option of purchasing the premises for $1,000.00. Gaudina testified that his primary residence is in Colorado, but that he wished to lease the premises so that he had a residence when he visited his wife, who lived nearby in Lake County, Florida. As he did not reside permanently at the premises in Leesburg, Gaudina subleased the premises to another individual, possibly in violation of the lease. That individual reported to Gaudina numerous issues with the premises, which Gaudina testified he brought to the attention of Grand Lifestyle.2/ Both parties testified that they sought various remedies in other courts concerning these issues. The undersigned finds that these issues are not relevant to Gaudina’s allegations concerning discrimination under the Florida FHA. Gaudina testified that he possesses a disability that requires use of an emotional support animal. The only evidence Gaudina submitted in support of this contention was a letter, dated February 24, 2015, from Emilia Ripoll, M.D. (Ripoll), located in Boulder, Colorado, and a “Health Care Provider Pet Accomodation Form,” also from Ripoll. This letter states: Mr. Jan Gaudina is currently my patient and has been under my care since 1998. I am intimately familiar with his history and with the functional limitations imposed by his medical condition. Due to his diagnosis of bladder cancer and bilateral ureter cancer, Jan has certain emotional limitations including stress which may cause his cancer to recur. In order to help alleviate these difficulties, and to enhance his ability to cope and live independently, I have prescribed Jan to obtain his pet for emotional support. The presence of this animal is necessary for the mental health of Jan. The Health Care Accomodation Form prescribed the use of Gaudina’s dog, a golden retriever, as an emotional support animal. Gaudina did not present the testimony of Ripoll or any other health care provider concerning his alleged disability. The letter and form, which are inadmissible hearsay that Gaudina failed to corroborate with admissible non-hearsay evidence, attempt to establish that Gaudina required an emotional support animal to prevent a recurrence of cancer. The undersigned cannot consider these documents to support a finding that Gaudina is disabled and in need of an emotional support animal. See Fla. Admin. Code R. 28-106.213(3).3/ Therefore, the undersigned finds that Gaudina has failed to establish that he suffers from a disability that requires the accommodation of his golden retriever as an emotional support animal. Principe, the owner of Grand Lifestyle, testified that the prospectus for the premises restricted pet ownership to pets that weigh less than 20 pounds. The parties acknowledged that a golden retriever weighs in excess of 20 pounds. Principe testified that, during a telephone conversation, Gaudina asked whether he could bring his golden retriever to the premises, but never mentioned his alleged disability. Principe also testified that he asked Gaudina whether Gaudina’s golden retriever was a trained service dog. Gaudina testified that his golden retriever was not a “service dog,” as defined under section 413.08, Florida Statutes.4/ Principe further testified that Gaudina rarely visited the premises. Gaudina testified that, in total, he visited the premises in Leesburg three or four times over the period of approximately one year. Gaudina presented no credible evidence that he qualifies as a person who is disabled for the purposes of the Florida FHA. Further, there is no competent, persuasive evidence in the record upon which the undersigned could make a finding of discrimination in the sale or rental of housing because of Petitioner’s alleged disability, in violation of the Florida FHA.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order finding that Petitioner, Jan Gaudina, did not prove that Respondent, Grand Lifestyle Communities III/IV, LLLP, committed discrimination in the sale or rental of housing because of Petitioner’s alleged disability, in violation of the Florida Fair Housing Act, and dismissing his Petition for Relief. The Issue Whether Respondents discriminated against Petitioner in the provision of housing, or services in connection therewith, in violation of the Florida Fair Housing Act (“the Act”).

Findings Of Fact Petitioner, Pedro Tamayo, suffers from anxiety, depression, memory loss, and complex regional pain syndrome (“RPD”). Respondent, Avtec, is a residential construction contractor, doing business in Palm Bay, Florida. On November 10, 2018, Petitioner executed a Contract for Sale and Purchase (“Contract”) with Avtec to construct a residential structure on property owned by Petitioner on Raleigh Road Southeast in Palm Bay, Florida. The specific floor plan chosen by Petitioner was the Citation 4 Plus. Avtec executed the Contract on November 12, 2018. The Contract covers clearing of property for construction, materials and color selections by the buyer, and the buyer’s right to reverse the floor plan, among other terms. When Petitioner entered into the Contract, he simultaneously chose many of the options available to customize the Citation 4 Plus, such as impact windows, an exterior pedestrian door in the garage, and a front septic system. Among the options Petitioner chose was 36-inch (36”) doors for the master bedroom entrance, closet, and master bathroom entrance. Petitioner has no obvious physical disability and does not require use of a wheelchair or walker. Construction Setback The Contract does not address the construction setbacks from the property lines. Setbacks are governed by local government codes and Avtec is required to follow those codes. On November 30, 2018, Petitioner met with his sales agent, Sean McCarry, at the Avtec showroom, to discuss some of the options he had chosen for his new home. They specifically discussed plumbing issues for the master bathroom, 36” wide doors in the master bedroom, placement of the septic tank, the concrete culverts for the driveway, and a 45-foot (45’) setback of the home from the property line. While the standard setback for a home with a front septic tank is 38’ to 40’, Petitioner indicated he wanted to build an aluminum carport, which required additional setback footage. Respondent Amicucci stepped into the meeting with Petitioner and Mr. McCarry to address Petitioner’s request for mitered ends on the culvert pipe. Mr. Amicucci was not present when Petitioner requested a 45’ setback. Mr. McCarry verbally agreed to “take care of” the setback requested by Petitioner. Petitioner’s selection of 36” doorways for the master bedroom, and a front septic system were reduced to writing and included in the Contract, signed by both parties, as an Option to Sales Agreement. Petitioner executed five addenda to the Contract between November 30, 2018, and May 1, 2019, including optional upgrades and a modification to the design of the sidewalk. On July 23, 2019, Petitioner and Avtec executed a change order to include the mitered ends of the culvert pipe. No part of the Contract, any addenda thereto, or any change order, addresses Petitioner’s request for a 45’ setback. Section 28 of the Contract provides that “NO OTHER AGREEMENTS exist between the BUYER and SELLER except as set forth in this Agreement. This Agreement shall not be modified except by an instrument in writing executed by both BUYER and SELLER.” Section 29 of the Contract contains the following statement in red underlined text: No representative of Seller has authority to make any verbal statements that modify or change the terms or conditions of this contract. Buyer represents that buyer has read and understands this entire contract. Buyer also represents that buyer is not relying on any verbal statement, promise, or condition not specifically set forth in this contract. It is acknowledged that builder is relying on these representations and would not enter into this contract without this understanding. Section 20 of the Contract specifically provides, “Once the rough plumbing is installed, absolutely NO CHANGES will be allowed.” Petitioner’s new home was built 40’ from the property line, rather than 45’ as Petitioner requested. Sometime after the rough plumbing was installed and the foundation was poured, Petitioner complained to Avtec that his home was not built with a 45’ setback as promised by Mr. McCarry. On August 22, 2019, Avtec, through its Director of Corporate Development, responded in writing to Petitioner’s complaint. Avtec apologized that the home was not built to the setback he had communicated to Mr. McCarry, and referred to the Contract terms that exclude any verbal agreements. Avtec offered to release Petitioner from his contract, refund his deposit of $6,250, and give Petitioner $30,000 for the property after selling it to another buyer. On November 13, 2019, Petitioner signed a “Final Acceptance of Completion” of the construction of his home. Fill Dirt On March 8, 2019, Petitioner drove by the construction site and noted that the fill dirt being used was “contaminated” with tree branches and other material. He drove to the model home to discuss the issue with Mr. McCarry. Mr. McCarry contacted Mr. Amicucci, who agreed to meet Petitioner at the property to inspect the fill and address Petitioner’s concerns. Petitioner and Mr. Amicucci testified to two very different versions of the events at the construction site that day. Petitioner testified that, when Mr. Amicucci arrived, he got out of his vehicle, visibly upset, and raised his voice and cursed at Petitioner regarding his lack of knowledge of proper fill material. Petitioner testified, specifically that: I feared that [Mr. Amicucci] would physically attack me by his aggressive demeanor and I immediately froze. I could not comprehend how a paying customer could be treated this way by raising concerns for the foundation of my home. I am not a builder. [Mr. Amicucci] simply needed to explain the common practice of standard fill. Since March 8th, 2019, my quality of life has not been the same. I have severe anxiety due to the memories of that day and suffer constant nightmares. I feel as [sic] my life can be in danger and, therefore, live in a state of high alert. My daily life has been disrupted. Simply having to drive by Avtec showroom due to my normal routine routes triggers flashbacks of that day. Mr. Amicucci testified that when he arrived at the property, Petitioner was upset and aggressive toward him, demanding that the fill be removed from his property. Mr. Amicucci reassured Petitioner that the fill was all good soil and that it would be root-raked before it was spread for the foundation. Mr. Amicucci explained the root-raking process and the equipment used therefor. Nevertheless, Petitioner insisted that Mr. Amicucci go with him to another construction site to show him the type of fill he wanted used on his property. Mr. Amicucci accompanied Petitioner to the specific construction site, which was not an Avtec project, and Mr. Amicucci identified the fill being used there as a hard white shell material. Mr. Amicucci assured Petitioner that the brown sandy soil imported to his property would be better for the sod and plants Petitioner would be using to landscape the property. Mr. Amicucci testified that, at the end of the meeting, Petitioner extended his hand and said, “[l]ook, that all sounds good. I just want to start back over. Are we good?” Mr. Amicucci shook Petitioner’s hand and assured him that they “were good.” Mr. Amicucci’s testimony regarding the events that occurred on March 8, 2019, is accepted as more credible and reliable than Petitioner’s. Knowledge of Petitioner’s Disability Mr. Amicucci testified that he was not aware that Petitioner had any kind of disability until the Complaint was filed against him and Avtec. Petitioner testified that his disability was revealed to Mr. Amicucci on November 30, 2018, during a meeting at the Avtec showroom to discuss the various options selected by Petitioner when he signed the contract. Petitioner testified that Mr. Amicucci asked him what he did for a living and Petitioner told him that he was retired and disabled from the City of Hialeah. He testified that Mr. Amicucci was further on notice because Petitioner always wears a glove to improve circulation in his right hand and that he can hardly sign his name, which would have been apparent to Mr. Amicucci at the November 30, 2018 meeting. Finally, Petitioner alleges Mr. Amicucci should have been aware of his disability because he requested 36” ADA-compliant door widths for the master bedroom. Mr. Amicucci did not recall Petitioner telling him he was disabled or seeing Petitioner wearing a glove. He did recall seeing Petitioner wearing a sling of some sort and inquiring whether he had been injured. He recalled Petitioner telling him it was related to an old injury. Mr. Amicucci was not present for any discussion about the 36” doorways. Assuming, arguendo, that he was present for that discussion, a request for 36” doorways alone is not proof of a disability. Many buyers upgrade to larger doorways to accommodate larger furniture or in anticipation of needing a walker or wheelchair access in the future. Furthermore, requesting ADA-compliant doorways is irrelevant to Petitioner’s claim that he has emotional disabilities and chronic pain. The evidence does not support a finding that Mr. Amicucci knew of Petitioner’s disabilities of anxiety, depression, memory loss, and RPD. No other witness was offered on behalf of Avtec. There is no evidence to support a finding that Avtec had knowledge of Petitioner’s disability through any other employee.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order dismissing Petition for Relief from a Discriminatory Housing Practice No. 202022149. The Issue The issue is whether Respondent, The Pines at Warrington, LP, et al., and Pinnacle, and American Management Service Company (The Pines), discriminated against Petitioner, Susan M. Walters (Ms. Walters), because of her disability and gender in violation of the Florida Fair Housing Act, Sections 760.20- 760.37, Florida Statutes.

Findings Of Fact Ms. Walters, during times pertinent, suffered from schizophrenia, chronic differentiated type alcohol abuse, and a personality disorder. The Pines is an apartment community consisting of 160 units. The community is managed by Pinnacle, a subsidiary of American Management Services, LLC. Approximately 90 percent of the residents at The Pines are women. Ms. Walters completed a detailed application for residency in The Pines with Joy John (Ms. John), the facility's leasing specialist. Ms. Walters signed the application on October 24, 2007. She entered into a lease for a term of one year on October 31, 2007. During the course of these events, Ms. Walters did not claim a disability or mention that she was disabled. No one in management at The Pines perceived Ms. Walters to be disabled. During the application and contract process, Ms. Walters was provided with copies of the rules and regulations governing residents of The Pines. The lease required Ms. Walters to provide management at The Pines 60 day's notice, if she wanted to vacate the premises. In or around February 2008, Ms. Walters acquired a dog. She informed management at The Pines, and in accordance with the lease agreement, began making payments toward the required pet deposit. During April 2008, Ms. John and Dawn Chapman, Property Manager, received complaints about Ms. Walters' dog. The dog's barking was disturbing residents of The Pines. Four to five complaints were received each week during April. Ms. John and Ms. Chapman advised Ms. Walters of the complaints and provided her with suggestions as to how to ameliorate the problem. Nevertheless, the barking continued. On May 13, 2008, Ms. Walters was provided a "Seven Day Notice of Noncompliance with Opportunity to Cure," addressing the dog issue. It informed Ms. Walters that she must prevent the dog from disturbing other tenants. It further informed her that if the problem continued, she might be evicted. Another week of barking precipitated a "Seven Day Notice of Noncompliance with Possible Lease Termination Following." This was dated May 21, 2008, and signed by Dawn Chapman. The notice again made clear to Ms. Walters that if the barking continued she might be evicted. These notices were often given to other residents of The Pines when their barking dogs annoyed other tenants. Many of the residents of The Pines were minorities. One of them, Rhonda Lavender, complained about Ms. Walters because she put up a sign in a stairwell that included the word "nigger." Another resident, a disabled man who lived in the unit above her, complained that she "lambasted him" because he dropped a boot and it made a loud noise. Others complained about her coming out of the door to her apartment and screaming. None of the residents, who complained about Ms. Walters' barking dog, or her other offensive actions, mentioned her gender or that she was disabled. At no time during the residency of Ms. Walters at The Pines did she provide Ms. John or Ms. Chapman information with regard to having a disability. The only evidence of a disability presented at the hearing was a form Ms. Walters referred to as "a doctor's release for medical records," signed by an unidentified "physician." It was also agreed that Ms. Walters received payments based on a disability from the U.S. Social Security Administration. However, no evidence was adduced that indicated Ms. Walters was limited in one or more major life activities. Ms. Walters' rent payment for June was due June 5, 2008, but was not paid. On June 6, 2008, a "Three Day Notice- Demand for Payment of Rent or Possession" was affixed to the door of her apartment. The notice demanded payment of the sum of $518.00 or delivery of possession of the premises. The notice informed Ms. Walters that eviction proceedings would ensue if she did not pay in three days. By June 6, 2008, however, Ms. Walters had determined that she was going to vacate the premises. She told Ms. Chapman that she would pay her June rent on June 20, 2008, but this was a prevarication because Ms. Walters had no intention of paying any more rent. On or about July 4, 2008, Petitioner vacated her apartment. She placed her keys in the drop box designated for rental payments. The rent for June was never paid. Ms. Walters testified under oath that during her occupancy of the dwelling her bank card went missing. She stated that on another occasion $20 went missing from her apartment and that subsequently $10 disappeared. She said the fire alarm rang once for two hours. She said she was disturbed by noisy neighbors and a loud maintenance man. She said that once after returning from her job she discovered a glass plate in her apartment that had been shattered. She did not reveal any of these allegations to management at The Pines when they occurred, if they did occur. Ms. Walters claimed that someone entered her apartment in May and sprayed a chemical that encouraged her dog to defecate inside the apartment. She said she could not check her mail because management at The Pines had locked her out of her mailbox. She said someone came in and scratched her Teflon frying pan and burned up her microwave oven. She did not make these allegations to management at The Pines when they occurred, if they did occur. Even if one believes that her property was violated, and evidence to that effect was thin, there is no indication at all that anyone involved in managing The Pines was involved. Moreover, no adverse action was taken toward Ms. Walters. Two notices about barking dogs and a written demand that she pay rent do not amount to an adverse action.

Recommendation Based upon the Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Petition for Relief of Susan M. Walters be dismissed.
