The Issue Whether an application for an outdoor advertising permit for a sign in Santa Rosa County should be granted or denied.

Findings Of Fact The Department of Transportation is the state agency responsible for the regulation of outdoor advertising signs that are located on all federal-aid primary highways. U.S. Highway 90 (U.S. 90) is a federal-aid primary highway. A permit is required prior to erecting an outdoor advertising sign on all federal-aid primary highways. Southeast- SD, LLC (Southeast) filed an application for an outdoor advertising permit, application # 57549/57550 (the application) on June 29, 2009. Southeast's proposed sign structure meets the size and height requirements of section 479.07. The parcel was commercially zoned in accordance with the provisions of section 479.11, Florida Statutes. Southeast's application site is located on U.S. 90 at milepost 3.118, approximately 550 feet east of the centerline of Woodbine Road. The Department denied Southeast's application and issued a Notice of Denied Outdoor Application (initial denial) on July 29, 2009. The reason stated in the initial denial was: Sign does not meet spacing requirements (1500' for interstates, 1000' for FAP). [s. 479.07(9)(a),1.,& 2. F.S.] In conflict with permitted sign(s), tag#(s): CC479. Held by: Bill Salter Advertising, Inc. Bill Salter Advertising, Inc. (Salter's) sign with tag CC479 was located on U.S. 90 less than 500 feet from the application site. Permit CC479 was the subject of a Department revocation proceeding.2/ On March 8, 2010, the Department issued a Clerk's Order of Dismissal on the challenge to the revocation of CC479. Thus, the revocation of the conflicting sign, CC479, was final on March 8, 2010. On August 16, 2010, the Department issued an Amended Notice of Denied Application (Amended Notice). In the Amended Notice, the Department gave a different reason for the denial. The reason given in the Amended Denial concerned a different Salter tag: Sign does not meet spacing requirements (1500' for interstates, 1000' for EAP). [s. 470.07(9)(a),1., & 2. FS] In conflict with permitted sign(s): CF793. Held by: Bill Salter Advertising, Inc." CF793 was originally permitted in 1978. At that time, an application for a sign permit was reviewed and notated by the Department, and became the actual permit. The application for CF793 contains information that is type-written on the application form, presumably by the applicant, Salter. In the portion of the application form stating "DOT DESCRIPTION OF SIGN LOCATION (DOT USE ONLY)" the following is hand-written: "Sect. 59 W- 39.95 Miles W-SR 85." Most of the application/permit was filled out by the applicant, and part of it was filled out by the Department. In 1996, the Florida Legislature amended section 479.02, directing the Department to inventory and determine the location of all signs on the state, interstate, and federal-aid primary highway systems. The Department conducted the inventory and, upon completion, sent the database information to each sign owner, giving each owner an opportunity to challenge the accuracy of the results. Salter did not file such a challenge regarding CF793. As of July 30, 2009 (the date of the initial denial), tag CF793 was shown at milepost 13.205 on U.S. 90, in a location approximately 13 miles away from the application site in the Department's database created pursuant to section 479.02(8). Tag CF793 was physically located 13 miles away from its originally permitted location. The Department acknowledges that tag CF793 was not valid in its location 13 miles away from its current location, where it was located from at least 1998 to 2010. The database reflected milepost 13.205 as the location for CF793 from 1998 until 2010. In 2004, the Department sent Salter a Notice of Non- Compliance demanding that Salter post tag CF793 at milepost 13.205. In October 2009, the Department received a letter from Salter regarding moving CF793 to the location specified in the 1978 permit. At this point, the Department investigated the original application and discovered a "huge discrepancy" between the database location and the permit location in the Department's files. The Department has no documentation regarding how tag CF793 came to be located at milepost 13.205 since the 1998 inventory. The Department decided that its database was incorrect and that it needed to be corrected. On February 1, 2010, the Department changed its database to reflect the location for CF793 as milepost 2.993 on U.S. 90. Salter posted the tag for CF793 at its current location sometime after March 22, 2010 and prior to May 3, 2010. Once Salter placed the tag for CF793, the database was changed again to reflect the physical tag location at milepost 2.950 on U.S. 90, the "current location." The Department hired Cardno TBE, an engineering firm, to conduct field work. An inspector performed field measurements on May 3, 2010, using the wheel and laser methods for field measurement. The inspector identified the stake that was in the ground on Southeast's proposed sign site. He measured along the edge of the pavement on U.S. 90 from the location marked by Southeast to the new location of Salter's CF793 tag. The inspector determined that the distance between the proposed site and the nearest permitted sign, CF793, is 890 feet. Based upon these findings, the Department then determined that Southeast's proposed sign did not meet the 1000- foot spacing requirement. By letter dated May 27, 2010, the Department notified Salter that the location of CF793 was "nonconforming" and that pursuant to Florida Administrative Code Rule 14-10.007, a completed sign must be erected within 270 days or the permit would be revoked. No sign has been built, and the permit has not been revoked. Moreover, it appears that a sign will never be built, as the Department is in possession of correspondence from Santa Rosa County to Salter indicating that a sign cannot be constructed at the current location of tag CF793 due to conflict with several local ordinances. Also on May 27, 2010, the Department sent a letter to Southeast stating that CF793 "now presents a spacing conflict" with Southeast's application location. The letter further states that the Department had advised Salter that a completed sign must be erected within 270 days and that if no sign is erected within that time frame, the permit would be revoked. On August 16, 2010, three months later, the Department amended its denial as set forth above in paragraph 8. Just prior to the hearing, the Department again sent the inspector to conduct another field measurement. This time, the inspector relied upon information regarding the location of the sign from the original application/permit that was provided by the applicant (Salter) in 1978. That is, the inspector measured from a location described by the applicant in the original permit application, then measured the distance from the location to Southeast's proposed site, and determined the distance to be 884 feet. In making these measurements, the inspector assumed that the nearest intersection in 1978 was in the same location as today, that the original measurer started the measurement from the centerline of that intersection, and that the distance from the nearest intersection indicated by Salter on the original application/permit was measured with the same accuracy as a hand-wheel or laser.3/

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law set forth herein, it is RECOMMENDED: That the Department of Transportation enter a final order approving Southeast's sign permit application. Findings Of Fact The Respondent's sign which is the subject of this proceeding was erected on Holden Avenue, approximately 400 feet west of the intersection of Holden Avenue with U.S. 17/92/441, in Orange County, Florida. This location is approximately 4.04 miles south of SR 50, as alleged in the violation notice. The subject sign is located on the south side of Holden Avenue, facing east and west which is parallel to U.S. 17/92/441. U.S. 17/19/441 is a federal-aid primary highway. Holden Avenue is a non-controlled road. The parties stipulated that it was the position of personnel of the Fifth District of the Department of Transportation prior to May of 1985 that state permits for outdoor advertising structures were not required when such structures were to be erected on a non-controlled highway, although said structures might be within 660 feet of a federal- aid primary highway. In 1984, the Respondent had applied for a permit to erect a sign along a non-controlled road within 660 feet of a federal- aid primary highway, and had been advised by Department personnel that a state permit was not required (See Case No. 85- 3017T which was heard contemporaneously with the subject case). The sign which is the subject of this proceeding was erected in February of 1985 without a permit based on the Respondent's knowledge of the Department's position that a permit was not required, as expressed to the Respondent previously in The subject sign is visible to traffic on U.S. 17/92/441, although it is perpendicular to Holden Avenue and parallel to U.S. 17/92/441. There is another permitted sign owned by Cashi Signs located on the west side of U.S. 17/92/441, approximately 686 feet south of the Holden Avenue intersection. This sign faces north and south, not east and west and is not on Holden Avenue.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED: That the charges against the Respondent, Peterson Outdoor Advertising Corporation, in the violation notice issued on July 26, 1985, be dismissed, and that the sign which is the subject of this proceeding be given the classification of non-conforming sign. Findings Of Fact The Respondent is the State of Florida's regulatory agency for advertising along state and federal highways. On January 1, 1995, Petitioner was the holder of three State of Florida outdoor advertising sign permits (among others): AU204-35, BH947-25 and BH948- 25. The sign covered by Permit No. AU204-35 (hereinafter "Sign A") was a wooden billboard located approximately 100 yards east of a weight station on Interstate 4. As trucks leave the weight station heading east, the sign was to their right. The sign covered by Permits No. BH948-25 and BH947-25 (hereinafter "Sign B) is an electrified high-rise sign located at the interchange of Interstate 4 and State Road 39. The sign is on the south side of the interchange. The signs at issue both serviced a truck stop on the north side of the interchange at Interstate 4 and State Road 39. Sign A also serviced a fueling operation at Interstate 4 and Park Road. About 27,000 outdoor advertising permits are listed within the Respondent's outdoor advertising system. Outdoor advertising sign permit renewal fees are due on January 15 of each year for all State of Florida outdoor advertising sign permits. If a permit holder's renewal fees are not received by the Respondent on or before January 15 of any given year, its outdoor advertising sign permits expire. By November 1 of each year, the Respondent sends a billing statement to every permit holder notifying them of the fees which will become due in January of the following year. Petitioner paid its permit renewal fees in 1994. In November of 1994, the Respondent sent to Petitioner a billing statement listing the fees which would become due on January 15, 1995, for its outdoor advertising sign permits. This billing statement included, among others, Petitioner's permits numbered AU204-35, BH947-25 and BH948-25. (Hereinafter referred to collectively as "Permits"). On January 15, 1995, permit renewal fees for Petitioner's Permits became due. If an outdoor advertising sign permit holder has not paid its permit renewal fees by January 15 of a given year, then by February 1 of that year it is the Respondent's practice to mail to the holder a notice of violation for nonpayment. The Respondent sends an average of 350 notices of violation each year. The notice of violation is sent certified mail, return receipt requested, and the article number on the certified mail card is documented on the bottom of the notice of violation. The notice of violation has a copy of the affected permits attached to it indicating the permits to which it applies. The notice is folded and inserted into a window envelope so that the address shows through the window. The envelope is then sealed and a certified mail card with the vendor's name on it is attached The notice of violation notifies the permit holder that the Respondent has not received its permit renewal fees and that the listed permits will expire if the holder does not submit its permit fees, including a ten (10) percent delinquent fee, within thirty (30) days. Petitioner's permit renewal fees were not received by January 15, 1995. On February 1, 1995, the Respondent mailed to Petitioner by certified mail, return receipt requested, a Notice of Violation and Order To Show Cause- Non-payment. (Hereinafter referred to as "Notice of Violation"). The Respondent's Notice of Violation was mailed to Petitioner at Post Office Box 945140, Maitland, Florida 32751. Petitioner's correct mailing address is Post Office Box 945140, Maitland, Florida 32795-5140. The article number on the certified mail card is documented on the bottom of the Notice of Violation. The Respondent's Notice of Violation had a copy of the affected permits attached to it indicating the permits to which it applied. The Respondent's Notice of Violation notified Petitioner that the Respondent had not received its permit renewal fees for its Permits and that they would permanently expire if Petitioner did not submit its permit fees, including a ten (10) percent delinquent fee, within thirty (30) days. The Respondent's Notice of Violation notified Petitioner that failure to pay its permit fees within the thirty (30) day period would subject its signs to immediate removal by the Respondent; and that Petitioner had a right to request an administrative hearing within thirty (30) days of the date of the Notice. Petitioner did not pay its permit fees or request an administrative hearing within the time limit set out in the Respondent's Notice of Violation. On February 23, 1995, Respondent received the 1995 renewal fees for an account identified as "Texaco Star Enterprise," which covers other permits, and that account is in good standing. The Respondent returned the check submitted by Petitioner on August 29, 1995 for the Star Enterprise (Petitioner) account. Star Enterprise is an organization which refines, distributes and markets petroleum products under the Texaco brand throughout twenty-six states. In 1994 and 1995 Star Enterprise owned approximately 400 locations in the State of Florida which were operated for the purpose of selling Texaco products to the general public. Star Enterprise operates some retail locations through its own salaried employees. These salaried operated retail outlets are known by the acronym "SORO." The SORO group is responsible for maintenance on SORO locations. Star Enterprise also owns retail locations which are operated by third parties under a lease. Star Enterprise presently oversees the day to day operations of its organization in the State of Florida from its office located at 650 South North Lake Boulevard, Suite 450, Altamonte Springs, Florida. In approximately 1993, Star Enterprise began to downsize and reorganize its operations. In December 1993, Star Enterprise moved its regional office to its current location in Altamonte Springs from 555 Winderly Place, Maitland, Florida. Whereas the Maitland office had operated with approximately 130 employees, only 34 employees moved to the Altamonte Springs location. Downsizing has continued, with approximately 25 persons still employed in the Altamonte Springs office. Since moving to its Altamonte Springs office, Star Enterprise has received mail at its physical location on North Lake Boulevard and at Post Office Box 945140 at the Maitland, Florida Post Office. Mail is delivered to the North Lake Boulevard location by the postal service and through various courier services. On weekdays mail is retrieved at the Maitland Post Office by a courier service and delivered by courier to Star Enterprise at the North Lake Boulevard office. Budget Couriers of Florida, Inc. (hereinafter "Budget Couriers"), is a delivery service operating throughout the Orlando metropolitan area. Budget Couriers' business is retrieving packages and mail from the Post Office and delivering them to its clients. Star Enterprise is a client of Budget Couriers. Budget Couriers picks up the mail for Petitioner at the Maitland Post Office. The mail is not retrieved from a box with a key, but is picked up at the back door area in plastic bins. A post office employee brings the mail bin to the courier at the dock and he signs for it. Budget Courier picks up mail at the location for several clients. Each one has separate bins for their mail. Budget Couriers acts in the capacity of Petitioner's agent for purposes of the retrieval and delivery of mail sent to Petitioner at its Post Office Box 945140 in Maitland, Florida. When an article of certified mail is sent to one of Budget Couriers' clients, Budget Couriers' employee signs for the article on behalf of that client. Petitioner authorizes Budget Couriers to sign for and retrieve certified mail on behalf of Star Enterprise. The certified mail is then placed in the client's bin. After retrieving the mail bins at the post office, the courier delivers the mail to each client, including Petitioner. When the mail is delivered the courier obtains a receipt for the contents of the entire bin. The receipt does not identify specific pieces of mail, including certified mail; nor is an inventory of the mail provided. When the Respondent prepares a notice of violation to be sent to a delinquent permit holder, the article number on the certified return receipt card is documented on the bottom of the notice of violation. The Respondent's Notice of Violation was received by Petitioner at its Post Office Box 945140 in Maitland, Florida, on February 6, 1995. The certified return receipt accompanying the Respondent's Notice of Violation was signed on behalf of Petitioner by an employee of Budget Couriers, Billy Hadd. The article number on the certified return receipt accompanying the Respondent's Notice of Violation corresponds to the number documented on the bottom of the Respondent's Notice of Violation. Petitioner acknowledged its receipt of the mail delivered by Budget Couriers on February 1, 2, 3, 6, 7, 8 and 9, 1995. Star Enterprise elected to have its mail retrieved from the Post Office by a contract courier. Petitioner did not receive an inventory of the individual articles of mail retrieved from its Post Office box and delivered to it by Budget Couriers. Petitioner received the Notice of Violation on February 6, 1995. The Respondent did not receive any payment in response to the Notice of Violation sent to Petitioner regarding its delinquent permit renewal fees. Petitioner had prior knowledge of the outdoor advertising sign permit renewal process. Petitioner has been renewing its outdoor advertising sign permits as far back as 1989. The action taken by the Respondent regarding Petitioner's Permits was consistent with the action it takes regarding any other outdoor advertising sign permit holder which fails to pay its outdoor advertising sign permit renewal fees in response to a notice of violation issued by the Respondent. It is the policy of Respondent not to accept late payments for expired outdoor advertising sign permits. Respondent believes that acceptance of late payments for expired outdoor advertising sign permits would violate the agreement between the Governor and the U. S. Department of Transportation. ( Hereinafter referred to as "Agreement"). Violation of the Agreement could possibly subject the State of Florida to penalties equal to ten (10) percent of the Federal participation in transportation projects within the State of Florida, which at this time would amount to a penalty of approximately sixty (60) million dollars per year. One of the key elements of the outdoor advertising regulatory process is to treat all permittees the same. Petitioner received the same treatment from the Respondent as would any other permittee under the same circumstances. Outdoor advertising sign permit renewal is a yearly occurrence and Petitioner was no stranger to the permit renewal process including the procedure for delinquent permit renewal fee payments. Petitioner failed to pay its outdoor advertising sign permit renewal fees on two other occasions in the past. On both of these occasions Petitioner received the Respondent's notice of violation at the same address as the violation at issue. On these past occasions Petitioner paid its renewal fees within the reinstatement period and its permits were reinstated.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is recommended that a Final Order be entered finding Petitioner's outdoor advertising sign permits have permanently expired. RECOMMENDED that a Final Order be entered determining that the request for hearing filed by Petitioner was not timely filed; and denying its request to reinstate two outdoor advertising sign permits. Findings Of Fact The Petitioner, Metro Advertising Company, is a licensed outdoor advertising company doing buiness in Orlando, Florida, through a division known as Eagle Outdoor. In 1964 the Petitioner acquired two outdoor advertising signs situated side-by-side on U.S. 17-92, 1.49 miles south of SR 436, in Seminole County, Florida. Thereafter, these signs were permitted by the Department and issued permit numbers 3988-2 and 3990-2. The Petitioner has renewed these permits each year by paying the appropriate annual renewal fee to the Department, including the renewal fees for the year 1985. Some time in 1983 the Departmet's outdoor advertising inspector noticed that the two signs which are the subject of this proceeding did not have affixed to them the permit tags as required. This inspector informed a representative of the Petitioner who was a divisional manager of the company, that these signs did not display permit tags, and advised that this be corrected. Subsequently, the Department's outdoor advertising administrator also discussed the matter of the missing tags on the subject signs with the Petitioner's divisional manager. At this time the divisional manager denied that the Petitioner owned these signs, and that there was no reason to replace the tags. On December 12, 1983, violation notices were issued by the Department charging that the signs at the subject location were in violation of the statutes and rules, and that these signs would be removed unless an administrative hearing was requested within 30 days. Since the Petitioner's logo appeared on these signs, the violation notices were directed to the Petitioner, and mailed returned receipt requested. When the time afforded to request an administrative hearing expired without any response from the Petitioner, the Department issued its final order for the removal of the subject signs. Pursuant to this order, the Department caused these signs to be removed. The signs that the Deparatment removed were nonconforming signs. If they were rebuilt they would violate the statutory spacing requirements.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law it is RECOMMENDED that the Petitioner's request for replalcement tags for permit numbers 3988-2 and 3990-2 for signs on U. S. 17-92, 1.49 miles south of SR 436, in Seminole County, be DENIED, and that the fees paid by the Petitioner for the years 1984 and 1985 be REFUNDED. Findings Of Fact On October 13, 1981, Henderson Signs filed applications for four permits to erect two outdoor advertising signs in Jackson County, Florida, on the south side of Interstate 10, one approximately 2.65 miles and the other approximately 2.85 miles east of SR 276. These applications were field inspected by the Department's outdoor advertising inspector and by his supervisor, they were approved on or about November 2, 1981, and the Department issued permits for the requested locations to Henderson Signs. Subsequent to the issuance of these permits, Henderson Signs transferred to the Respondent, Tri-State Systems, Inc., all of its interest in the permits which authorized the subject signs to be erected. On or about March 23, 1983, the Respondent filed outdoor advertising permit affidavit forms requesting that the Department issue replacement tags for the subject signs because the tags previously issued had been lost. The Department replaced the older permit tags with new tags numbered AI998-10, AI999-10, AJ001-10 and AJ002-10. A business known as Brooks Construction Company is located within 800 feet of each of the subject sign locations. At various times some construction equipment can be seen parked in the vicinity of Brooks Construction Company. Although the view from 1-10 is partially obstructed by trees, this equipment might be seen from the interstate if one were looking at the right spot. Also, a small on-premise sign is located at this site, but the view of this sign is no better from 1-10 than the equipment is. The business known as Brooks Construction Company is located in a structure that resembles a brick residential building, which is used as a residence. A portion of this residential building is visible from 1-10, but is as obscured from view as the equipment and the sign are. The area where the subject signs are located is rural in nature. There is nothing about the building used by Brooks Construction Company that would indicate to a traveler on 1-10 that anything other than a residence was located at this site, even if the traveler were able to see this building from the interstate. Prior to the transfer of the permits from Henderson Signs to the Respondent, a representative of the Respondent testified that he inquired at the Department's district office in Chipley whether the permits to be purchased from Henderson Signs were valid permits. He further testified that he received assurance from the Chipley district office that these permits were legal permits. This testimony, however, is self-serving and uncorroborated, and thus is not of sufficient quality to support a finding of fact. Henderson Signs submitted the applications for the subject permits, and designated thereon that the proposed locations were in an unzoned commercial area within 800 feet of a business. These applications also certified that the signs to be erected met all of the requirements of chapter 479, Florida Statutes. During the summer of 1984, the sites were inspected by the Department's Right-of-Way Administrator who determined that the permits had been issued in error because of the absence of visible commercial activity within 800 feet of the signs. As a result, the Department issued notices of violation advising the Respondent that the subject sign permits were being revoked.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that permit numbers AI998-10, AI999-10, AJ001-10 and AJ002-10, held by the Respondent, Tri-State Systems, Inc., authorizing two signs on the south side of I-10, 2.65 miles and 2.85 miles east of SR 276 in Jackson County, Florida, be revoked, and the subject signs removed. Findings Of Fact Based on my observation of the witnesses and their demeanor while testifying, the documentary evidence received, the stipulations of fact entered into by the parties and the entire record compiled herein, I hereby make the following findings of fact: The two signs and four sign faces (hereinafter, the signs) which are the subject of these proceedings are owned by the Respondent and are outdoor advertising signs as defined in Chapter 479, Florida Statutes. One sign is located on U.S. 1, 1.35 miles north of Industrial Road, Big Pine Key (DOAH Case Numbers 86-2294T and 86- 2295T) and the other sign is located on U.S. 1, 1.25 miles north of Industrial Road, Big Pine Key (DOAH Case Numbers 86-2296T and 86-2297T) The Respondent purchased the signs from the Daley Outdoor Advertising Company in 1984. The signs are adjacent to and visible from U.S. 1 in Monroe County. U.S. 1 or State Road 5, is a federal-aid primary highway. U.S. 1 was open for public use at the time the notices of violation were placed on the signs. All of the signs are located within 660 feet of the nearest edge of the right-of-way of U.S. 1, State Road 5. The area in which the signs are located is zoned "GU". Mr. William Kenney is employed as the outdoor advertising administrator for the Department of Transportation, District VI. On May 29, 1986, Mr. Kenney inspected the signs and noticed that neither of the signs had a state outdoor advertising permit tag attached. At that time, Kenney placed a notice of violation on each sign face. After placing the notice of violation stickers on the signs, Kenney examined the Department of Transportation's office records pertaining to outdoor advertising signs and found no evidence of permit tags having ever been issued for the signs.

Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED: That a Final Order be issued declaring that the signs involved in these cases are illegal and must be immediately removed. Findings Of Fact Based upon the evidence adduced at hearing, and the record as a whole, the following Findings of Fact are made: The outdoor advertising sign that is the subject of the instant proceeding (hereinafter referred to as the "Sign") is a billboard with steel "I" beams and iron stringers which sits perpendicular to U.S. Highway 1 approximately 1,800 feet south of Hypoluxo Road and approximately 1,000 feet north of Neptune Drive in Palm Beach County. Petitioner has owned the Sign since about 1978 or 1979, when it purchased the assets of the Sign's previous owner, Outdoor Media. The Sign was originally erected in 1963 by Ferrin Signs, Inc., pursuant to a permit issued by Palm Beach County. In 1967, Ferrin Signs, Inc., obtained a permit from Palm Beach County to perform further work on the sign. Shortly thereafter, Ferrin Signs, Inc., sold the Sign to Outdoor Media. Prior to March of 1970, the land on which the Sign is located was in the unincorporated area of Palm Beach County. In March of 1970, the land was annexed by the Town of Hypoluxo and has been within the Town's jurisdictional boundaries ever since. The Town of Hypoluxo has an ordinance currently in effect that regulates signs within the Town. The ordinance, like its predecessors dating back to 1961, prohibits "off premises signs." It also contains a section dealing with "nonconforming signs," which provides as follows: Signs or sign structures made nonconforming by this sign and signage code shall be governed by the following regulations: A sign existing within the town on or before November 30, 1992, which, because of its height, square foot area, location or other characteristics, does not conform to this article is hereby declared to be a nonconforming sign. A nonconforming sign under this subsection may be allowed to remain in existence, but if destroyed or allowed to deteriorate in excess of 50 percent of the depreciated value of the structure, it may not be replaced. The status afforded signs under this section shall not be applicable to any sign for which no sign permit was ever issued; such signs are deemed illegal signs and are subject to the provisions of this article governing illegal signs. No conforming sign or sign structure shall be permitted to be erected for the same property containing an existing nonconforming sign until the nonconforming sign has been removed or made conforming. An "off premises sign" that does not qualify for "nonconforming sign" status is subject to removal under the ordinance. The Town also has a building code. Under the code, a building permit is required before a sign within the Town may be altered or repaired. No building permit has ever been issued by the Town for any work to be performed on the Sign. On December 27, 1990, the Department issued a Notice of Violation alleging that Petitioner was maintaining the Sign without a state-issued outdoor advertising sign permit, as required by Section 497.07, Florida Statutes. In response to the Notice of Violation, Petitioner advised the Department that it would be filing an application for such a permit. Petitioner filed its application on January 12, 1993. The application was accompanied by, among other things, a copy of the 1963 Palm Beach County permit referred to in Finding of Fact 3 above. The application package, however, contained neither a permit for the Sign issued by the Town of Hypoluxo, nor a statement from any Hypoluxo official indicating that the Sign was eligible for such a permit or was otherwise allowable under the Town's sign ordinance. Accordingly, after receiving the application package, the Department contacted the Mayor of the Town, the Honorable Al Merion, to ascertain the Town's position on the matter. In conjunction therewith, it provided Mayor Merion with a copy of the 1963 Palm Beach County permit that had accompanied Petitioner's application. By letter dated January 25, 1993, Mayor Merion responded to the Department's inquiry. In his letter, he wrote: Receipt is hereby acknowledged of your fax transmittal containing a permit issued by Palm Beach County to the Ferrin Signs, Inc. on January 24, 1963. The permit issued by Palm Beach County is not valid because it is not within their [sic] jurisdiction to issue sign permits for property lying within the territorial boundaries of the Town of Hypoluxo. To the best of our knowledge, the Town of Hypoluxo has no record of a permit being issued to Ferrin Signs Inc. It should be noted that, in the past years, on numerous occasions, the billboard in question has been illegally constructionally altered by virtue of no permit having been obtained from the Town. On or about February 2, 1993, the Department returned Petitioner's application to Petitioner. In the Memorandum of Returned Application that it sent to Petitioner, the Department gave the following reason for denying the application: "local permit not provided for Town of Hypoluxo." Although the Town no longer contends that Palm Beach County was without authority to issue the 1963 pre-annexation permit for construction of the Sign, the Town still takes the position that, because of unpermitted post- annexation repairs and alterations, the Sign is prohibited and subject to removal under the Town's current sign ordinance. 1/

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is hereby RECOMMENDED that the Department of Transportation enter a final order denying Petitioner's application for a state outdoor advertising sign permit. The Issue Whether the outdoor advertising signs in question are in violation of the applicable statutes and regulations and whether their permits should be revoked.

Findings Of Fact The Respondent applied to the Petitioner for outdoor advertising permits at a location on the west side of State Road 263, 674 feet north of U.S. Highway 90, with signs facing north and south. Prior to making application with the Petitioner, Mr. Mooshie contacted the Tallahassee Leon County Department and was advised that the site was located within county jurisdiction. Mr. Mooshie applied for and received a permit from Leon County whereby the county asserted jurisdiction over the area in question. The site in question is within the city limits of Tallahassee and was in the city limits of Tallahassee at the time Mr. Mooshie applied for the permit. The permit applications submitted by the Respondent indicated that the sign site was not inside the city limits. State Permit Tag Numbers BB 729-35 and BB 730-35 were issued on July 22, 1990 for the site in question. The Respondent applied to the City of Tallahassee for a city permit for the subject site on July 11, 1990 and was advised that a permit could not be issued because a city permit had been issued to Lamar Advertising for a location 600 feet north on the same street on June 21, 1990. The Petitioner issued an outdoor advertising permit to Lamar Advertising for the site for which the city had issued a building permit prior to the final hearing in this case. The City of Tallahassee sign ordinance requires 2,000 feet spacing between billboards on the same side of the street. No sign structure has been erected at the site in question.

Recommendation Having considered the foregoing Findings of Fact, Conclusions of Law, the evidence of record, the candor and demeanor of the witnesses, and the pleadings and arguments of the parties, it is therefore, RECOMMENDED that State Permit Tag Numbers BB 729-35 and BB 730-35 be revoked.
