At the meeting of creditors, I forgot my schedules which are needed to answer questions appropriately. Can the trustee continue the meeting or should it have been rescheduled?

My husband filed bankruptcy in 2005 before we were married. We now have a house that we cannot make payments on. Our attorney said our best bet would be to stop making payments until they kick us out. My husband can't file bankruptcy after we walk out but I could so that they couldn't come after us on the house. Is this true? and what would become of my credit if I only filed the house under the bankruptcy?

Abstract of Judgement

My dad had this order placed against his home due to credit card debt. He filed for chapter 7 and all his debts were forgiven. He passed away a few days ago and I went to check on the status of his home at the recorders office only to find out that this creditor has not removed the lien from his property yet, he filed for chapter seven in 2005 after the lien was placed against the home. How do I go about getting this lien released. Thank you

After a self-storage tenant has had a chapter 7 bankruptcy discharged, what is the procedure for the self-storage co. in vacating the space? Does the lien prior to the discharge remain valid? Can the storage co. sell the property in the space in a lien sale auction? There is a very large balance due and the discharge of debtor came two years ago. There has been no contact with the tenant. Is any other legal procedure required different than a non-bankruptcy lien sale at this point?

canceling chapter 7 proceeding

i mistakenly prepared a pro se chapter 7 filing online. They made an error regarding a property listed as exempt . the trustee at the 341 meeting gave me a month extension to seek counsul after informing me of the error. I have a motion in to see a judge in two weeks pleading to cancel all proceedings with the idea that I proceeded with innaccurate information that I trusted as true. ( a chapter 13 will not apply since my total income for the year is $10,000 on $40,000 debt. Isn't this similar to self-incrimination in a way ? Will they have sympathy for poor judgement on my part . Can I appeal if they do not dismiss the proceedings.????? The person who I have been living with will no longer support me . Technically .....I am homeless as of a week ago . The inherited property will have to become my primary residence now. I know how it looks........but if true .... they can't take away what would now be my only legal property can they ?

My parents filed for bankruptcy for credit card debt. They then got money from a class action private settlement. They had to wait 90 days to let creditors claim their money. They were told they would get it after 90 days. Now it's been 160 days and they are still being told to wait b/c of paper work. The money left is the surplus from the debt they had. The settlement was higher than their original debt. When should they have gotten the remaining money from the settlement?

Q1: By filing Ch 7, could my wages be garnished?

I earn slightly above min wage. I have 6K in credit card debt. I also have a $9.8K balance towards a timeshare at 17.9% interest.

Q2: If a Ch 13 was filed, what is the likelihood of a reduction in the balance and interest rate of the timeshare? From past experience, what have you seen? If a reduction, is it slight or drastic?

Timeshare: starting balance $12.8K, now same propery being offered for $22K, current balance $9.8K.

Bankruptcy and housing/vehicle

I'd like to ask a couple of questions about filing chapter 7. I have unsecured debt of about 60K. I just went through a divorce and have a small sum to buy a little cheap house and pay off my truck. I'm disabled, though I don't draw SSDI. I am unable to work and the only funds I have coming in are from the divorce and are barely enough to pay monthly expenses. If I file, is it possible to keep my house and vehicle, or do these end up having to be sold to pay the unsecured debt? Thank you very much!

Reorganization of the company

I am a real estate developer. I took construction loan of $30 million from a commercial bank and $5million from a mezz lender. Both the loans have personal guarantees.

We started construction and have borrowed around $15million from the commercial bank and $5million from the mezz lender.

Construction got delayed due to reasons beyond our control. The market conditions changed and both the commercial lender and mezz lender have started a legal action to collect money.

Question: can we take the company through reorganization or any other legal action without declaring personal bankruptacy?

my husband was involve in a car accident. A car hit him, our insurance decline the claim because my husband's insurance had lapse. Now the other person's insurance has filed a judgement against him and he is thinking of filing bankruptcy, can this be included in a bankruptcy?
