Bankruptcy- Joint owned vehicle

I bought a volvo about 3 yrs ago. I was then with the father of my kids(we never married) and the car title was issued under both our names. He has now filed bankruptcy chapter 7, we separated I am now married to someone else but his name still shows in my car title and is being told the court will take both his car and mine. Is that possible although my name is in the title and I have not filed bankruptcy, can I lose my car?

I had my car repossessed due to economy. The bank has sold it however they are stating that I still owe them approx. $8000. Can I file this claim in a bankruptcy???

Automatic Stay Bankruptcy

I filed for a Chapter 7 bankruptcy. One of my creditors is refusing to co-operate with the �automatic stay�. She states that she does not have to abide by the stay since she has a UCC -1 filed with the state. Is this true? I thought she had to wait until the court date to ask for relief from the stay? According to language of the contract, she is entitled to my ENITRE paycheck until the debt is paid. This has had a paralyzing effect on my personal finances. I obviously did not anticipate a market crash when I signed over my rights to my future commissions to repay the debt. The creditor is a commission advance company. As of now, my broker is holding my checks in escrow until the court date or a letter from an attorney stating how the monies should be disbursed. I will be forced out of business, since I cannot pay for my association dues, tools of the trade, and my business vehicle without the funds from my commission checks that are being held. Not to mention, I have two small children to provide for and I am the head of the house hold. Any advice is greatly appreciated. Note: I borrowed against a deal in which my client lied about his ability to purchase. He even went so far as to create false documents.

My landlord had declared Chapter 7, is my security deposit protected?

I have moved out at the expiration of the lease and gave the required notice, but he has not reurned my money or given any reason.

Pay cosigned loan before bankruptcy

I lost my job approx. 18 months ago and received a severence check. I kept the severence in the bank because I was fortunate enough to find another job. Eventually I took 75% of the severence and paid it towards my childs college loans which I have always paid. I just wanted to bring down the monthly payments and obviously pay down the principal. I still have a little severence left but now my dilemma is that I have been laid off again, only a few weeks after I used this money to pay the student loans. I was contemplating chap. 7 bankruptcy because things are getting tight but a friend advised me that she thinks that since I paid my childs loan down (which has always been agreed that I would pay for college) that I can't file because it will cause problems. Is it true that I have to wait a long time even though I am unemployed and probably meet all the other criteria such as income, equity in home, etc. Thanks for any guidance.

Did Attorney Look Out for My Best Interest?

Filed ch 13 in 2004 to keep family home. Had to sell home paid off all debts except auto loan @ 22,000 reduced to 13, 805. Paid 31,000 into plan (including 13,500 to auto loan) but fell behind and needed to have plan modified. Attorney would not modify and converted to chaper 7. have paid almost all of the car loan (300 remaining while I was in chapter 13) but now I have to pay 2,100 or the car gets repossesed? I have another meeting of the creditors soon. I don--name removed--agree with my attorney at all. Can I state my concerns to the judge in that meeting? Please advise.

I filed chapter 13, for the 3rd times this year the others were dismissed, I am in the state of Georgia, my home was being forclosed on and I applied again to stop the sherriffs sale, I applied before the sherriffs sale on my property and the Mortgage companies Attorney's was informed of chapter my 13 filing, they still forclosed on my property is this legal ? after filing chapter 13, What can I do to get my property back?

Bankrupcy 13 and foreclosure

I filed bankruptcy 13 and after the court figured out my payments, and I made 4 payments to the court, I decided to filed a ''walk out'' from my home, instead of keeping it. The court used my payments to pay all my credit cards and notified me that I was now in foreclosure. I have not heard anything from nobody. I haven't paid to the lender for 14 months.

I just ran my credit report and the only pending payment is my mortgage.

What is happening?

I still would like to keep my house, but not at the price owed and I don't want to pay all the money behind.

Do I still have hope to keep it or should I expect to leave it soon????

how much do you need to be in debt to apply for bankruptcy (chapter 13 or 7)? does it go by your debt to income or no? I have alot of debt that is in collections and i cannot afford to pay it. I know its not over 10000.00 - is that to little of a amount to apply? help!

Bankruptcy issue

We rec'd bankruptcy Chap 7 discharge in Jan 08. Since that time I have made several calls to the bank that holds the loan on my commercial truck to try to work out a settlement whereby I could keep the truck. They are holding a $50K CD and I have requested many times, as well as my attorney, that they send us copy of the paperwork effecting that hold. To date, they have not sent it. They have made no move to settle on truck either and I am not making payments. Why would they do this? What should I do? (Trustee exempted $11K of the CD.)

We may be filing Chapter 7, but the problem is our vehicles were lumped into one loan with American General, with my daughter as a cosigner because her Nissan was included. Will American General file a judgement against her for all vehicles if we purse the bk? thank you
