Do I have to follow through on Bancruptcy ?

Must I receive a bankruptcy judgment first before I can have my file checked out of the federal archives?

Or can I start the process of bankruptcy and change my mind a long the way?

Because bankruptcy is overseen by federal courts, bankruptcy files are kept in the federal archives.

Before I apply for credit can I have my attorney request to have my file ''checked-out'' from the federal archives??

Is a judgment dischargable in a chapter 7 in VA

I am working on a refinance and the borrower has a judgment which was filed against him from a credit card company in 06/04. He filed chapter 7 bko 12-04 which was discharged 03/05. Was this judgement discharged in the bko or can it still attach to the home? It is currently not against his home now.

Can I sign on a morgage with my husband while I only is in Chapter 13. We would like to buy a house and his income is not enough. I want to use my income also. I have never been late. I've paying for 2 years now.

BK Chp 7 - Is It Legit

I filed the paperwork in CT jointly w/wife at the cut-off date Oct 2005(?)

The application fee was never paid in full and I never attended any of the court dates or hired an attorney.

I believe it was ''dismissed'' or whatever the term they use is.

What I want to know is if I go back to the court house - is there something I can get to show that the case never happened? Right now it is on my credit report as me filing a BK 7 and never really doing it....

Hello,

someone and I entered into a partnership and formed an s-corporation in california. We needed to lease a piece of equipement. The company that offered us the lease needed both of us to sign a personal gurentee forms as part of the process to getting the lease approved and they did. We were not fully comfertable after all taking on such large liability. However, two months later my partner without my full agreement signed the lease alone by himself being the president of the corporation. Also, there was no written board meeting minutes to approve such lease. Now is he the only one liable for the lease if the corporation defaults? Thank you in advance,

My husband and I filed BK Chapter 7 Aug. 2005. We were asked by the Judge if we wanted to keep our home, and we said yes. Discharged was Nov. 2005.Checking my husbands credit 3 weeks ago realized that the mortgage was filed on. Credit reports ''Included in Bankruptcy'', we have been paying payments of $705.60 for almost 3 years without any knowledge of this. I also called the U.S. Bankruptcy Court and they confirmed it was filed on and no reaffirmation was signed and filed. We were behind 2 months when we recieved a default letter on the home, good to July 30, 2008 *yesterday*. I have told Green Tree we were letting it go back to them, then they tell us it was bankrupted on *now they tell us* and they said they were going to do ''Deed of Lieu''. We were suppose to have recieved it last week and still nothing yet. I have talked to this company 3 times within the past 2 weeks and yet for the past 2 weeks and yesterday I found out they are calling family members looking for us instead of calling us.My husband *not in my name* borrowed $68,400 and default letter says $78,988.21 , since the 11 years we have been here. Of course this isn't all of the story with Green Tree.Does something seem stange, and can anything be done about it?

Filing Chapter 7- Co-signer question

My hubby is filing, but my father is co-signer on my car. We do not plan to include it in the BK, as it is in good standing and we are filing it as ''exempt''. But the attorney says I still have to include and he ''thinks'' he will not be affected! I do not want my father to be a affected. Will he?

After Ch 7 BK Vehicle Repo

I have a question. We filed Chapter 7 in 8/2005 and it was discharged in 11/2005 and our vehicle was included but we did not have to reaffirm since we were up to date on payments. In the last few months we have fallen behind because my husband lost his job and was without work for a couple months and is now making quite a bit less than before. Anyway, I called the lender and they said they could not work out any plans to catch up with us since it had been included in bankruptcy and they are not allowed to do anything like that and that we should pay as much as we can even if it is a little each week. Now I am worried (we are sending them some money, but we are 3 to 4 mos. behind). This is coming down as we pay extra. They did mention that our account might pop up for review and then something could happen. What could happen? Would the BK case have to be reopened before they could repossess since it is protected (I guess) by the BK we filed. I am just wondering if we will get some kind of warning before they repossess or it would show up in Pacer Online so we could have an idea that it is going to happen? We do plan on continuing to pay every extra cent to them.

Lien on Car Title

I've paid off my car loan from Nissan Motor Acceptance Corp (NMAC) in Nov 2005. Never received title to the car of which I still own. Learned recently that I will get a copy of the title with ''NMAC'' listed also as the owner, and then must go to the Dept of Motor Vehicles and pay a fee to remove ''NMAC'' from the title, leaving me the title free and clean. NMAC rep said this is standard procedure when you secure financing through the auto corporation. Is this right? If not, what should I do?
