Contract Cancellation after term expires

I am new at a company which just changed management. There is an existing contract with a service contractor dated 1986. The terms state that after the 5-yr term, the contract is automatically renewed for subsequent 5-yr terms.

Signatories no longer represent us, and their companies no longer manage this property; and the original contractor has changed (bought by new co.)

Can we cancel this contract without penalty?

family business and loans

My husband borrowed $1000 from his brother about a year ago and was told to pay it back when he was able to. About 5 months ago, my husband starting working for his brothers company full time and using his brothers truck as a work truck. My husband used about $393.30 from the $1000 to fix the work truck. About two weeks ago, my husband told his brother that he was quitting because we weren't making our bills with what his brother was paying him and the working hours were not set. So I just picked up my husbands last check, which was orginally for $771.50, but his brothers wife took out $606.70 (which was the remaining balance from the personal loan) out of his check leaving him $164.80. I just want to know if his brother was right taking out money to repay a personal loan out of his business check?

retail installment contract and security agreement

Is there a time limit on an installment contract and security agreement? I do not see anything in the contract. I have read it from top to bottom and back to front.

Removed work documents

I recently left a sales position with one company and started at another company. On my last day at the first company, I printed copies of my sales and quotes, to enable me to document my commissions owed. My commissions are not paid by my employer. Now, the first company is threatening legal action. Is there a law I have violated I never signed any non compete or non disclosure agreements.

Business registration question

Yes I have a corporation and have will be opening my second location shortly. I second location has a slightly different name so that it would not confuse customers. To be safe and legal and to make sure I am the rightful owner do I register it separately as a new business or can I somehow umbrella it under my original corporation? Or do I listed as a DBA? I just want to be legal and safe so no untrusting person tries to steal it from me. Thanks

Fraud

I ordered an expensive camera from a company who ended up sending me the wrong camera, lens, and flash that I ordered. The total gross of the products I ordered came to over $2000. They sent me cheaper flash, lens and camera and refuse to accept any returns. Is it legal for them to not accept my return and refuse to refund me. They wont send the correct products because they are ''out of stock''. My only option is to keep the less expensive products after I paid for the expensive ones. Or pay a $400 restocking fee and lose $600 of insurance. Last, I understand that in California it is illegal to charge for a product on backorder untill they send it out. I had my whole total charged and products were put on backorder. Please let me know what Legal rights I have if anyone knows anything. Thank You

I am a 1/3 partner in an LLC consulting partnership that started on a couple of months ago. I have recently terminated my employment with the partnership due to irreconcilable differences. I have not surrendered my equity. what is my exposure moving forward if i can't reach an agreement for my equity?

Is removing shopping carts from the supermarket property illegal?

Stores with shopping carts are across the street from our neighborhood of apartment houses.

Corporation and Individual in a Joint Venture

How can I obtain a copy of a joint venture agreement without the other party knowing that I lost the contract agreement? I abandoned the project and will be sought for the debt and losses the corporation accrued in the JV which we both agreed of being responsible for 50/50. Is there such of notices or letter that I can send to the corporation for proof of liability on my part to have them produce the contract agreement and that if the contract is not obtainable with in certain amount of days that any business relationships or agreement between the corporation and I are non void or no liability can not be sought after, something like that. Sorry for not knowing the legal terms.

Corporation President Theft

I helped set up a small construction corporation using my license. I had a 15% ownership but no stocks were issued, no records kept and the president stole all the money leaving me with a $10k obligation. What can I do.

Pto

Is it legeal to force an employee to utilize PTO (paid time off) hours they have accrued, yet opt not to use them? Company policy states you must maintain 64 hours of work to keep benefits, but does not state you MUST use PTO thereafter; however, the supervisor says you have to use PTO time if you have it and can not ''Bank'' it.

Fire a Partner

I currently own 20% in a company. My partner who owns 51% just came in and told me I was fired. But we have sold share for the rest of the % and 66% do not agree with this. Can I be fired?

Breached verbal agreement

had a verbal agreement to go handle my event client through a collegues company as I am not yet set up. We verball agreed on me paying her 10% for the use of her contract et al.. Now that my clients contract is signed she is cutting me out of 90% of the revenue from my client. Now offering me 10%. She says I have no recourse. I have done all procurment, research, pricing, and proposals.

What can I do to at least negotiate a 70% me 30% her split.

LLC buyout questions

I am a 1/3 owner of a 3 member LLC, and wish to get out of the business I helped build. The other two want to continue without me, possibly bringing in another to fill my spot, or just keeping the business between them. I feel I am entitled to 1/3 of all the LLC�s assets, as well as a portion of the future gains, because the others will be moving forward based on all the help I�ve contributed to get them there. I have a feeling that the other two owners do not want to give me what is fair, and I am requesting that if we do not come to an agreement, we should liquidate the business and then they can start over without my help. Can I force liquidation? Can the other two owners prevent me from getting a cut of the future income? They wouldn�t be where they are without me!!! Thank you for your time and consideration!
