Can an employer force his employees to sign a document waiving overtime pay, and force them to work a shift for free, or get fired, to make up for a cash shortage? My daughter's boss wants her, and a coworker, to each work a 6 hour shift, at $7.40 per hour, to repay a $55 shortage that the other girl has already offered to repay in cash.

business partner buyout

Three years ago my parnter and I split our business, and I took a $100000 buyout. Since we don't speak anymore, all was done via e-mail, where he sent me a breakdown of payments I would recieve via our payroll company. I only have 6 months left on the buyout, but he has now missed a payment. Is this e-mail contract legally bidning, and if so, how do I go after it if he doesnt pay... I live in Georgia, he lives in Tennessee

I was recently hired by a company.But one of the requirements is that you have a clear background.I was wrongfully arrested and my case got dropped and I'm in the process of getting it expunge.However the company that hired me wants me to give them details as to what happened .Do I need to explain to them what happened in details if I have documentation stating that my charges where dropped.And do they have the right to deny me employment because of that?

Business Law

I am an American citizen and I live in NY. I have a small family owned business that I own with my wife's family in South America where we sell glassware, china and other kitchen products. I also have a small internet site here in the USA where I also sell these products. I am registered with the IRS with EIN tax number and I pay taxes as a sole proprietor for all income made in the USA. I sell about 80% my products in the USA and I send 20% to South America that are sold by my wife's family in thier store.

When I contact venders here in the USA to buy my products, I never tell them about my internet business that sells here in the USA, and I only tell them about my business is in South America. The reason I do this is because some of the companies offer lower wholesale prices for overseas accounts than for stores that sell in the USA.

My question is, am I breaking any law or commiting any type of fraud by not telling these companies about my USA business in order to get cheaper wholesale prices? Also, if in the future they find out that I am also selling in the United States, can they prosecute me for anything?

I gave my notice to my company in Sioux Falls SD. My notice was for April 16th, 2006. Because I was going to a competitor they walked me out last Thursday. When I got home I connected to my worksite computer and sent myself/hr the letter of resignation and I deleted my personal emails. Today I got a letter from the company requesting what my intentions were. They wanted me to clarify what drives I accessed and why and any deleted emails. Can I be in trouble for doing this?

I heard it's ''illegal'' for a merchant to add your CA Drivers License number to a personal check for acceptance.

It supposedly assists those interested in identity theft.

Possible Contract Breach?

I was terminated on my first day of employment, 5 minutes in. I was forced to sign a 90-day ''agreement'' that stated all of the usual BS like what I was expected to do, etc. The girl who fired me clearly said that I would be paid for the following 3 weeks. There is a specific clause in the contract that states that I am to receive 3 weeks written notice of termination prior to the term date - I clearly did not receive such a notice. Now this employer is saying that they have NO intention of paying me at all for the next 3 weeks. Is this a clear breach of contract or am misunderstanding? Your input is greatly appreciated.

trademark

If I have a company name that is similar to another companies name but not exactly the same can there be any problems with that? An example would be if I had a company named My Concierge and there is another company called My Personal Home Concierge. Right now there is a company in the UK with a similar name as I want for my company and my company and that company will provide a similar service. Any advice on this would greatly help. Thanks!

i bought in my brothers company in 2004,with 10,000,to become vested at 25% starting at 10% first year 20% second and 5&the next.we drew up small aggrement on paper but we never signed it.know after irs came in because of his cpa fuged the taxes.the company ended up oweing about 225,000.the problem know is he is saying i am no longer partner.and that he is gona give me back my ten grand we he can.but in the last 4 years we have bought a lot of stuff ,like a warehouse ,3 trucks,&trailers and so on.he says i lose all that i have invested building this company what are my right if any. thanks

Terminate a contract

I signed a Credit card contract with a company in CO. Nov 2004. in big letters it said no Cancelation fees.

When I called to cancel 04-2007 they said I am not allowed to do so. Reading the ''fine print '' it said The Agreement is for one year , thereafter the agreement will automaticly renew for an add one year term unless merchant noties acquire of it's attention no to renew the agrement at least 90 days prior to the end of the agremmen term. Can i legally cancel my contract since the since the inital term is over. Is there any way I can get ot of this?

Extortion or should I refund

Recently a customer is requesting a refund for sixty dollars. I do Paintless Dent Removal. The customer had backed into her husband's truck and called requesting my immediate attention. She met me at a local used car dealer. I looked at the dent and told her if she wanted it done well she should take it to a body shop. She insisted on me giving it a try. I worked on the Dent for an hour an then told her it was to difficult and that I would charge her nothing if she wanted me to stop. I said I could take the door dings out of the front door and charge her my minimum of $50. She said great and paid me $50 plus a $10 tip when the work was finished.

A couple of hours later I get a call and her husband is irate about the first dent I tried to fix. She is now demanding a full refund of $60. I've never had this happen after doing well over 10,000 cars. I'm confused does she have the right to money back --should I feel obligated, is this some strange form of extortion. Trip Liability Release Form

I am taking a group of 13 people to Sweden to study folk music this summer. The group consists of 9 students between ages of 13-17, another teacher and 3 parents. I will have notarized written permission for the minors to travel with me. However, I would like to have everyone sign a trip liability release form to protect myself from any possible lawsuits etc. should an accident happen on the trip. I have looked at some forms on findlegalforms but am not sure which form I need. What would you recommend and where might I find that form? Thank you, Sandra

I am wondering what the law says about where responsibility lies when a customer walks out on a tab at a bar/resturant. Also I am questioning how much of a percentage of tips should be tipped to the Bartenders from the waitress'. Are there any laws that outline these things specifically?

Lease

If a lease is contingeny upon lessee obtaining a liquor license within a specified period which expires. Lessee may terminate lease or lease may be extended with mutual consent. The lease is extended with mutual consent, What is the nature of the lease? Lease at will , etc. ?

Termination of Contract

In 2005 I signed a ''Distribution Agreement'' where I am able to perform a business using the parent companies name, logo and vendors. I paid $110K for the business plus $110K for a truck that is needed. In return I pay a 10% surcharge on all purchases I make for resale. In the agreement it states that the Parent company will do certain things such as developing a website with catalog and market basket for website sales. The terms of the agreement state that the Authorized Distributorship agreement ''shall be in full force and effect, assuming all of its terms and conditions are met, for a period of 10 years from the date of it's execution.'' I was informed on 12/15/07 that ''Our Authorized Distributor agreement'' will expire on 12/31/07 since he is disolving the corporation. I paid for an agreement lasting at least 10 years and the Owner cancelled it after less than 3 years. Do I have a case to be reimbursed for the cost of the business ( or at least a portion)?

Non payment

I am in what amounts to a fractional ownership of an airplane (it's an old Cessna and has an aprox. value of $30,000). The plane is owned by a Delaware corporation and each of the three partners is an equal share holder in the corporation. We all share the cost of ownership equally and pay expenses into a corporate bank account. Unfortunately one of my partners has failed to pay any of his expenses in over a year he has also failed to pay a third party for services provided for the aircraft and now a lean may be filed. Is it possible to seize his share for failure to pay?

Business Liablility and Contracts

My boss is closing down his shop and opening another one. He is not an American Citizen. I am, and he wants me to sign on the corporation contract with him. He says i don't have to put forth any money and I will sign a waiver that rids me of all liability. He just needs my name on there for the citizenship. He also said he will pay me 500 dollars a month for being on the contract with him. Is this in any way possible. Can i sign a legal contract and a waiver that gives me part in a company that does not affect my credit and will have me as not responsible if anything legal or bankruptcy should occur?
