Legal ownership of a game

I recently went to install my own legitimate copy of a certain game. I had purchased this a while back and the disc had been scratched beyond all belief and would no longer work.

Since I paid for this game it was my understanding that I could make a backup copy. I assumed this also meant that I could download a copy of the exact game I have, because I havn't a clue in the world as how to make a backup copy.

After downloading a replacement I receive an email from my ISP which was a warning letting me know the owner or representative of the game said that my account was violating copyright laws.

There was no mention of legal action, just that I was somehow violating the terms of use policy.

I looked up this issue online and according to everyone out there it is just a warning and I should just ignore it.

I wanted to know if I did anything wrong and if I did, what can I do to remedy it?

References on a Website

I'm building a website for a company that does constructing-type work. The owner of the company wants me to show how much credibility he has by posting the past clients and their information on the website--like a list of previous clients as references. This isn't legal unless I have each person's permission, right?

Unauthorized email access

I am 19 years old. My father married 4 years ago after my mother skipped out on us. I've never gotten along with my stepmother , and as such, I have lived with my older sister for the past 3 years. My stepmother recently filed a complaint against one of my high school teachers stating that our relationship was inappropriate. Those accusations were dismissed, however, she submitted emails obtained via unauthorized access of my hotmail account as ''evidence'' in her complaint. I want to know if I have any legal options to persue for her hacking into my email?

Use of my name on internet sites

I have a colleague who has found her name on ratemyteacher website. This site seems to be where students can rate their teachers subjectively. Though the posting is not bad she feels allowing juveniles to post about teachers could be defamatory and could cause her or other teachers professional issues. Is there a law that says she can demand her name removed from this site and not ever posted there again?

Selling on the Internet

We are a local golf shop that has been selling golf equipment in our store and on the internet over the past 18 months.

We were always upfront about our selling on the internet and complied with the manufactuer minimum advertised price and other internet requirements.

A few days ago one our the major manufaturers told us we could no longer market on the internet because we did not meet the terms of their internet retailer agreement leavin us with $20,000 in unsold inventory.

Meanwhile they have allowed us to sell on the internet and told us we needed to increase the amount of inventory we carry to do so. In the last several months they have developed thir own internet site and know tell us we can not sell on the internet and stick us with the equipment.

My two questions are 1) Given the prevelance of the internet, can they legally restrcit us from selling on it if we are adhearing to the internet policies and 2) Do we have a case to return the equipment to the manufacturer since they sold it to us knowin we were going to sell it on the internet?

My name is not on the account which is T-Mobile. Aside from why or what it would prove after the fact I want to know under what cicumstances could someone legally subpena those records.

UDRP and Trademarks

I have owned a small business for a little over three years. I originally just registered one domain name, but recently realized that people may misspell part of the name (e.g. ''Dollie'' instead of ''Dolly''). I went to register the other name, but a local competitor, with a completely different name, had already registered it and had it forward to her web site. I've read about typosquatting on this site, but I have no Service Mark (I've since applied, but it was after the fact). I think demonstrating she was using the name in bad faith would be straightforward. There are thousands of companies similar to ours throughout the country, so it seems a coincidence that she happened to register a name almost identical to a local competitor, especially since I can't find evidence of any other company in the country with a similar name to mine. I've read responses saying a registered mark wasn't necessary for the UDRP to be used, but what other things would come into play then? It seems like the UDRP mentions registered marks throughout. Do I possibly have Common Law Service Mark rights? If a registered mark IS usually necessary for the UDRP route, what are my best alternatives? I appreciate any ideas.

Internet libel

Hello,

I understand that U.S.C. � 230 and a 2006 ruling by the California supreme court (case: S122953) determined that websites cannot be sued for libel when slanderous comments appear on that website, but are written by a third party (a user of the site).

What I'd like to have clarified is what if the website in question encourages its users to post the slanderous comments due to the very nature of the site (e.g. the site is a forum for identifying inept doctors for instance and therefore most/all user generated content on the site may be construed as libel). Would the site still be immune to prosecution?

Is the website obligated to remove the libelous content once identified? Or to identify the original creator of the content? The California ruling would lead me to believe this is not the case.

First, if someone posts something offensive on my site, am I liable for that?

Second, if someone made a phpBB skin called Vista, which is also based on Windows Vista colors, can they do that?

Third, what kind of copyright notice should I have if I have free games embedded (from Kewlbox. com, and I have permission to do so and use the exact code they provide to me) in the site, and external links to flash videos (from FreeOnlineGames. com), and misc. service names and awards on my site. I also have a phpBB forum, reviews of websites (like Powweb. com and others).

Fourth, if I write a negative review for a site or service, am I liable for any damages? (The statements were made based on my experience with the service.)

Fifth, what kind of notice should I put to show that I am not affiliated or related to in any way with the services I am reviewing?

Sixth, if you know anything about phpBB, does the COPPA software on it protect me?

Seventh, if I write a review, and information in that review has changed since the writing, am I liable for anything?

Finally, is there such thing as anti-libel, where I write a review about a great service that rates it very highly and I praise it and make it seem good (it is good)

Question on meta-searches
