Domain Names

We purchased domain names and now are being sued.

We recieved a letter from an attorney refrencing ICANN Rules:

Mandatory Administrative Proceeding

b. Evidence of Registration and Use in Bad Faith.

ii) you have registered the domain name in order to prevent the owner of the trademark or service mark from reflecting the mark in a corresponding domain name, provided that you have engaged in a pattern of such conduct; or

(iii) you have registered the domain name primarily for the purpose of disrupting the business of a competitor; or

(iv) by using the domain name, you have intentionally attempted to attract, for commercial gain, Internet users to your web site or other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsorship, affiliation, or endorsement of your web site or location or of a product or service on your web site or location.

Corp-to-Corp Ethics

My small consulting company is partnered with a large software company. We provide services (install and value-add business processing and more), to clients who purchase from this software company. This software company contacted my employees and helped them create a company to compete against me. THis is going to cost me thousands/millions in revenue. It has already cost me the thousands for lost revenue, training, methodolies, documents, supporting software we created for testing and implementation. My resource skills are unique in the market and I trained them. Can this software company do this? Do I have any rights? Can I bring financial liability against them? Please advice. If needed, I will retain legal representation. This software company approached my resources to create a company in direct competition against me.

Domain Name Transfer

There are 3 partners planning to start a business. They have a signed NDA. 2 of the partners discuss and come up with a Domain Name that they think would be great for the business. One of the partners communicates the name to the 3rd partner that this is what they are thinking. The 3rd partner goes and purchases the domain name. For a variety of reasons the 3rd partner decides not be part of the venture. But out of spite he is not returning the domain name. Can something be done to get the domain name back from him.

Is it ok for a recruiter to contact your employer?

I am not a candidate for any of YOUR clients so there is absolutely no need to contact any of MY references at 8:30 am. Things were awkward. then 2 weeks after this i find out i'm being laid off and beleive it may have to do with Joe calling my employer. Is this ok to do on Joe's behalf?

Internet Law Question

I don't know if anyone here practices internet law, or even if this question is relavent to internet law, but here it is anyway. A major internet company operates a public website where users can buy and sell items. If pornographic images were some how uploaded by a seller as a result of no filtering system or a malfunctioning filtering system, does the company become liable for those images? If so, can the company be sued for allowing such material to appear on their website, which has no restrictions to minors or children?

Photo posting on internet

My husband's Ex-wife asked me not to post family photo's that incuded her daughter (mystep-daughter/husband biological child) on my Myspace page. I respected her wishes & took the photos off.

Now she has an entire website devoted to photo's of her daughter that is publically accessible more easily than Myspace, and she now has posted a photo of my own Biological daughter (no relation to her) on that site.

Is there any type of legal forms/action I can take for her publically posting photos of my child without my consent?

Hello, I have a quick question. I own a company and have a website for that company. Back when I was in the process of designing the website I took a look around at competitors sites to give myself ideas. I put my site together and I've begun to receive nasty emails from a particular site owner. He says that my site is copying his and that he's going to take legal action.

Now I'll agree that the 'layout' of my site is similar to the person who is complaining but all of the 'artwork' and 'html code' for my site is original. I'm aware that images and text are protected under copywright law. But all the images and text on my website are original. So my question is this: does this person have a case against me or am I safe?

theft of photo used in an internet add

basically a photo of mine that is a modeling photo was stolen and used for an add trying to give away a free 500 dollar hot topic gift card on myspace, ive contacted myspace, hot topic, and the website responsible for the add to find out information about who is paying for the add to run but they replied with no information that i needed and i was wondering if there were any contingency lawyers willing to help me with this case i have all the proof, the original photo, the 2 adds that are running on myspace, and the website address for the company responsible.

Clip Art use

Can I legally use downloadable computer ''Clip Art'' as a source of inspiration for my own illustrations of a book that I am writing. For example, in my book I need illustrations of 1 subject (like a chair) in 85 different styles.

I am NOT ''cutting and pasting'' clip art into my book. In order to assist me with the challenge of coming up with a variety of different ''looks'' for one subject, I view ''clip art'' for ideas.

Micro soft clearly states in their legal contract (I have read it)...Clip art my not be used for images in a book....

I have been recieving an email from the netherlands saying I've won a large amount of money and was sent to someone whose email was based from this website. Is it for real or a scam.

I was terminated as an employee on the last day of March, 2007. Today, May 15th, I was forwarded an email that alarmed me. Apparently my friend mistakenly emailed me at my former work address. This email landed in my former employers in box! Furthermore, my ex employer REPLIED to the email! The email was in turn forwarded to me by my friend. I understand email is a tool and employers have the right to monitor it, but I haven't worked there in over thirty days! This feels like an invasion of my privacy, as well as some form of identity theft (or at least, identity ''misleading). What are my rights?

I have a live in gorl friend who has through watching me log into my accounts acquired my passwords. I did not provide them, she then has since logged into my computer and have deletd files and also logged into my email and has sent email identifying herself but under my email to people in my address book. Is this illegal? I have proof she sent it and she signed her name at the bottom of the email identifying herself.

Does the type of music download site have anything to do with whether it is legal or illegal? For instance, you have sites that you pay per song, per month, or a one time fee. Are any of these types of sites ALWAYS illegal, or does it depend completely on the individual site's license of the copyrighted material?

ae there any laws against a person or persons breaking into your personal acoounts and reading or adding things to your rofiles or emails. I have a friend who keeps breaking into others accounts including mine stating she has a right to know hwats being said against her. she has caused much harm to innocent people and well I feel my own privacy has been severely invaded. she says there are no laws against such things and she cannot get into trouble but i for one would like my privacy back and am getting tired of the paranonia associated with her invasion and as a result she has everyone afraid to talk. Are their laws against such things and what can i do to stop her from doing this. We have changed our passwords numerous times but she always finds a way to get to them and is in many accounts. again are there laws against such things and what are the penalties of it?
