Released from Job after Disability

Back in August I was a victim of crime and my ankle ended getting broken.

I was set to return back to work on Nov. 18th. On November 17th my Doctor released me for part time work.

My job required me to work 40 hrs. per week as I was a salaried manager.

I was told to wait until a full release. I kept in contact with my HR rep throughout all of this, updating her on my situation.

At the beginning of December I was told that I either could take a demotion to a part time position or apply for an extension to my LoA. I was given one day to make that decision, when my follow up appointment with my Docor was in 1 week.

I chose to wait until my scheduled Doctor appointment. Upon visiting my Doctor, he issued me a full return to work.

I left a Voicemail with my HR rep and did not recieve a response until Dec 27th.

I was told to submit all of my medical documentation for my LoA extension. I faxed in all the paperwork on Dec 29th.

Just today I call my Benefits center and am informed that I have been fired and to contact my HR rep for further instructions.

I am not sure if there is anything I can do about this, but it just seems wrong to me. I did everything they asked of me and still was terminated. Help?

Disability Law (CA)

I am an employer, and one of my emlployees is out on short term disability. Her disabilty is no work related, and is ongoing. I have two questions:

1. )Can I terminate her while she is off on disability?

2.) When she returns, does she have to have the same job as she had before?

Interview Discrimination

I was given a medical exam before the interview, after the interview they claimed I failed the medical. i challenged this than they said i failed the interview. i challenged the medical and have been succesful, as it is discrimination. how much information aboutt he interview do they have to provide for me to challenge the process and outcome? is a score and sketch notes sufficent without a rating scheme to show what you need to achieve to reach certain scores? This is for Federal Employment

Student rights under IDEA

Does a student or their family have the right to obtain a student parking pass to park on school grounds simply because the student has an IEP (for a mood disorder)? The family believes the student is entitled to the parking pass and the student is somehow being excluded from obtaining a pass. There are a limited number of spots available and they are awarded on academics, behavior, and attendance. We do not discriminate nor do we factor in someone's disabilities in either awarding or denying the parking pass.

Possible disability discrimination

I started working for a company in 4/07, started having back problems almost immediately, in 12/07 my neurologist limited my work schedule to no more than 2-3 hours a day, I believe the company I worked for set a presadent by accomodating my reduced hours for the Christmas rush, I wasn't even scheduled for Valentine's Day, but Mother's Day 08, the company wanted me to work 55 hours a week, and I couldn't and they fired me, is this legal?

puppy lemon law versus private contract

if you sell a puppy with a health guarantee that says you are not responsible for any accidents, ailments or conditions in the one year guarantee or the pups lifetime but you do guarantee against hip dysplasia and eye problems and they buyer signs it and then the pup gets sick 5 days later and he wants to sue for 4 times what he paid for the dog. i offered a full refund but he wanted the outrageous vet bill which was double the sales price. in small claims court, would the private health gurarantee he signed which states '' i have read, understand and agree to the above terms'' stand up or would the lemon law prevail that says he can keep the dog( he wants to) and get 150% of the selling price. he then added $2500 in punitive damages which the deputy who served the supeona said he was not going to get as she spoke to me for half and hour and believed me when i told her the pup was more than healthy at 12 weeks old when it went home.

medical question asked; is it legal to ask?

I am a high school teacher and was asked by my superintendent (during a recent meeting regarding my health needs) when I had to last have a shot of insulin

( I am diabetic). I was taken aback and told him I was not sure but would ask my dr. about this. I did not think it was legal for him to ask me a question like this; please advise.

do i have a case under a.d.a.

I was out of work for 6 months with a work related back injury,went back to work under restrictions and worked for another 6 months with alot of pain.I returned to w/c doctor,he sent me back to work and said to take it easy,yet with the same restrictions as before.Now my employer will not let me return,was forced to take vacation and fmla,which have both run out,but still no answer on my employment status and they also will no longer alow me to pay my health insurance premiums...My boss has told me that he doesn't want me to hurt myself any more...The injury is a year and a half old now and i have not been allowed to work for 5 months,but have a modified duty release from the doc. With restrictions...I have tried to suggest alternate job duties and positions that would more suit my restictions with no answer and the dead line for filing a complaint is in another month...What can i do??????

Ramp

I rented a place in WA. The landlords knew that my husband who is disabled would be joining me. Who is responsible to build the ramp? My landlords told me they would take care of it before I signed the lease, but are now backing out.

Teacher with bi-polar diagnosis

I was not permitted to return to work after an involuntary hospitalization with the diagnosis bi-polar disorder. I was not permitted to return to work with psychiatriast form which stated I could return to work without restrictions, because the nurse who was assigned to approve return demanded that I prove I was taking psychiatric medication for my condition. As a condition to return to work I released all my psychiatric records. After being put through the run around for several months, I finally did return to work but only for a short time. I was falsely accused of being incompetent to perform my duties, and placed on suspension pursuant to CA Education Code 44942. I have since been evaluated by a panel of psychiatrists and even though I have a 100% clean record of postive performance evaluations, I am been officially been determined incompetent based upon the fact that I am not sufficiently caring for my condition. Basically that means I'm not taking medication or receiving psychotherapy. I demanded that the decision be reviewed by Superior Court, but have not heard of any action for about a month. I don't think I have been asking for legal help in best way. I am having difficulty finding representation.

Discrimination at the movies

While going to the movies I went to the guest service area to purchase my ticket. I have never had a problem before, and they have even helped me into the theatre before the movie to find a seat. I went to purchase, the person behind the counter said he wouldnt sell to me, and to walk outside. After twenty minutes of arguing telling me why he wouldnt sell to me I asked him when he does sell tickets there? He told me to disabled people. I told him I was and said he could see my scars from brain and spinal surgery if he didnt beleive me. A random worker next to him yells at me that im not disabled and i walked just fine up to the counter. I asked her if she knew what disability ment, and she told me people in wheel chairs who cant walk. She told me to go outside and they wouldnt help me. What should I do, if anything??

Depression as a disability

I recently informed my employer of a few instances of what I believed to be sexual harrasment by someone who while not technically my supervisor is someone ''higher up the ladder'' then me at the office. HR stated that the unwanted and inappropriate instance of touching I stated had occured was not done in a sexual way but rather out of sympathy for an accident I had been in even though there had been other instances of inappropriate behavior by this woman. I have started seeking counseling for depression because of this and have started taking meds. I find it extremely difficult to go into work. If they say I must come in rather then work from home is this legal? Also what if they say my depression is from the accident I was in rather then the harrasment? The harrasment started well before the accident. I was hired as a disabled veteran due to a knee injury. Am I in a protective category because of this? Thank you.

Tenant on disability

Do landlords have to allow a dog in an apt. if the tenant 's Dr. states due to her depression a service dog is needed for her well-being?
