Age Discrimination

I have been looking for employment and hitting a brick wall. I can't believe how many ads say things like ''young'' right in their job descriptions. And I have even had interviewers that have attacked my age with statements such as, ''you have been out of school for a long time. Are you even current in your knowledge?'' I have managed and owned several businesses and would never ask questions like that in an interview. Can people like that be sued and how about the ones writing those ads?

Employment Discrimination

My daughter has Autism & requires up to 5 doctor's appt a year (during work hours). My boss recently told me that I need to find another doctor for her (she's been seeing him for three years) that has ''outside of work hours'' or ''you will need to go back to a part time status.'' I went full time in January after being part time for two years. The company has less than 50 employees so FMLA is not an option. Before making appts I check with my director as to what time/day is best. The only exceptions have been a speech eval that took several weeks to get (my director was made aware of the appt as soon as it was made - giving her at least 5 weeks notice) & a psych eval that was scheduled at a time/date comfirmed by my director but was found out that the doctor was on vacation that week (he failed to mention that to the scheduling dept) I did discuss the new appt with my director in early June (providing 4 weeks notice - the company requires 2)

Can my boss do this? I spoke to someone at the ADA info line & they say no she can't. My director feels bad (she knows how hard I try) but her hands are tied.

I admit taking a day off to attend a school function & a court date (her dad won't pay support) but both of those days were approved!

Power of Attorney

My father lives in Texas and my grand father has power of attorney, he has agreed to sign the power over to me in GA. I dont know what needs to be done to do this, do i need to go to court here or in Tx to change it.

Disability Discrimination in the work place

The company I work for is advising me that I need to use my FMLA to take every Wednesday off to seek care for a mental illness I suffer from, without pay. My doctor has requested ADA accommodations for a 4 day/10 hour work week to get the care I need without losing pay. 4 day/10 hour work schedules are available in the company and are currently being worked by other employees without disabilities. I was also removed from a position I had been training in since January just a few days after the ADA request was submitted to my employer. Would this qualify as discrimination?

Small Claims Contract Dispute

Through a settlement with a former employer I agreed to a specific amount of dollars following termination and an agreement not to sue under an ERISA violation. The company had 15 days to provide the sum and shorted me over 6000 dollars. They are in Michigan, I currently live in VA but am about to move to North Carolina. In order to file in small claims do I have to file in Virginia and if I do can I also sue them for my travel expenses when it comes time for trial?

The original settlement was agreed to so that I would not file a suit because they dismissed me on the morning I was going to file for disability.

Alcoholics/Addicts being prohibited from store

There is a convenience store next to a half-way house that is prohibiting the recovering addicts from the facility from entering his store. The men have committed no crimes at this store or on it's property. This was sparked because one woman inside the store felt threatened by men that were being dropped off in the parking lot. It is lawful for the store owner to prohibit these men from entering this store simply because they are residing next door, working on their recovery?

termination

I received notification from my health insurance that the request for termination of my insurance was received on the 15th from my employer. I was terminated on the 18th for 3 reasons that occured on the 16th. I do not have any write ups or verbal only 2 raises and a excellent review in personnel file. I am a employee with a disability which employer was informed 2 weeks prior to my termination. Are they going though great lengths to terminate a employee at will, and ignoring that I am not a at will employee?

I own a franchise that sales beauty supplies to salons who have a cosmetogogy liesences. I live in the border of texas and for 50 years I have been saleing to mexican liesencs salons. Our company know said that we can no longer sale to mexicans, they have to be americans. So when they come into my store I need to ask them if they are mexican or american. If they are from mexico and live in mexico I can no longer sale to them ! can they legaly do that ?

turned down and must file merit systems protection board or civil action U S District court. Cant find attorney. My MSPB form said I may request the court to appoint without payment of fees? How do I find attorney or get one appointed by the court.

Special Needs Inheritance from father

My son, 39 years old (Down's Syndrome) will receive his father's pension and life insurance shortly. He receives SSI & Social Security. He would like to buy his own home in Massachusetts or New Hampshire. Would he at the time of his death need to pay back Medicare/Medicaid or SSI? Would they take his home? He is receiving $123. a month from pension but that will go up to $2,300 a month shortly. SSI has stopped this month. We want to protect the insurance & pension. I am legal guardian and should I buy the house in my name or jointly for him? Confused by all this. Can't seem to find the answer. I am learing of the trusts I read online. There are things he wants to buy that do not have anything to do with everyday expenses. He wants furniture and a vacation which he deserves more than anyone/ He also works in a workshop and receives a paycheck which is less than $90.00 a week. We filed his taxes for the first time last year and plan to file them again as I was including him in my taxes since he was born. He has always lived at home with me.

I was wondering is it legal if you are medically disabled and on medical leave for your employer to fire you and drop your insurance?

disability and SSI

My husband has triple by-pass surgery on Nov 4, 2005. Everyone expected him to return to work 6 weeks later. He finally returned in late Feb or '06. By, March 15th he was out again. When is started he was getting his vacation pay. After he went out in March and that it was going to be a long time his company put hin on long tern disability. This May the disability ran out, so he decided to sign up for early retirement. He received a check in the mail and we think that the company who paid for the long term disability want to be paid back. SSI retro-ed his check back to Nov 5, 2005. My question to you. Do we have to pay this back? We though that it was under his company benifit plan. The company decided to put him on the long term because if he came back and went back out he would receive no money because he used all his sick and vacation leave. We have no idea what to do. We have 4 children and there is no was he will ever be able to return to work for anyone. Thank you very much, Donna
