First of all, thank you for all your assistance. My dad will be flying to his home country to visit his brother who has terminal cancer. In 2006 my dad was convicted of domestic violence 273.5(a) PC. He completed his DV classes, paid fines and completed his community service. He was in jail only for one day. His probation ends on 11/2009. This is his only run with the law, he's 59 yrs. old. I'm concerned that when he returns to the US he will have problems @ the airport, he's a legal resident. My mom said that he should'nt have a problem because of his previous conviction as long as they carry the court reports/documents with them. Both parents are traveling together. I told both parents that it would be easier for them to return to California through Tijuana & drive through the border. Both parents are leaving this weekend and returning on October 30. Also his legal residency will expire in 2012. Do you think by going through court & asking for an expungment will increase his chances of renewing his legal residency in 2012? Any input into this matter will be greatly appreciated, thank you so much.

will DUI affect my status?

i am an inmigtant(green card holder) from China,been living in the states for nearly 3 years. i have had impaired driving conviction 2 weeks ago i had no any other conviction before.(the prosecutor dropped my charge from DUI to impaired). i am a current student, and i am dull-time employed. i am planing going back to China for New Year. my questions are, is the impaired driving convication going to affext me from re-entry the U.S after my visiting to China? And does it affect my current green card holder status? and does it affect applying for naturalization 2 years later? or any other affections caused by this impaired driving convication? thanks for your, and i am really appreciated any advises. thanks again.

hi. My daughter is a US citizen , she is 1.5 yr old. Me and my husband were in MN. and husband was on H1 and i was on H4. We got transferred in india. and now me and my husband are living seperate. Daughter is with me. We came back to india on june 2007. Now when my daughter is US citizen, is there any way i can go back to US? wil her citizenship help me out in some way to get the permanent reside3ncy visa? what shall i do in that case? Unsatisfied with lawyer

Paid our lawyer $4000. He told judge he was pro bono. Not happy with his progress want to check his background (ethical issues). Is there a way to do that. Is there a number to call for Free legal advise in california. We are on a tight time frame.

revoke green card

my dad sponsored my uncle and his family over here not too long ago. They got their green cards about 5 months now. 1 day after they got their green cards they took off and left for another state. As it turned out they owe bunch of money from the vietnamese governement, stole from us, and now working for cash and avoiding paying taxes. Is there a way where we can revoke their green cards and deport them back to vietnam so they can pay for their debt.

federal offense

my brother was convicted of a felony in 1999 it was his first offense ever and resulted in deportation he had a permanent residence card. he has been in the US since he was about 7 yrs old and now has a family of his own here. he is now waiting to see a federal judge in court because of 3 illegal re-entries. would we be wasting our money hiring a lawyer to reduce federal time if any? also would to know how much time he's looking at and if he would ever have a chance to retain his permanent resident card again

My boyfriend is currently serving time for a prior drug conviction and violation of a parole program was also charge with escape.The escape is from leaving NJ to come to NY. He now has an INS detainer and supposely is under investigation for removal of the us can anything be done??? We have a three yr old am a us citizen should we get married? or what can be done if any???

Keeping the green car and resident status

Dear attorneys, I recently received the green card, but i do business mainly in my home country and travel to the US twice in 6 month for 2 weeks. I file tax return (but have no income in the US), and i rent a small place where my mail comes (cell phone bill, bank statement, etc). For how long can i keep this up, because i do not want to lose the residence status? I love the US, it's just my income source is attached to what I do in the homeland. Should I stay more than 2 weeks during each 6 month period? thank you.

adjustment and travel after marying US citizen

I asked before but did not give full picture of the situation. I'm foreign. I'm visiting US in December to spend my birthday with my US citizen boyfriend. He invited me for a week at Vegas so I am under impression he will propose me there. My question is: if I marry in Vegas and leave the US to spend Christmas with my parents as I do every year, I can't return to US with him before adjustment (that maybe take ages). If I marry in Vegas and applly for parole to travel immediately, I don't think it can be done in time for Christmas with my family oveseas. If I get pregnant (our plans to marry is to have children straight away because we are over 40) and we stay overseas waiting for adjustments perhaps we can't return to US t give birth to the kid there as we want. Any solution???? How long after marrying in US a couple can travel overseas?

Admin process for green Crad

My US citizen brother sponsord me for green card in 1993. In 2005, I was called for GC interview along with my family in Islamabad. All my under 21 kids got visa with me and US embassy in Islamabad are holding my Husband's visa. Every time i contact them, they say it is under admin process in US. It has been 3 years since I got visa and they are still holding my Husband's visa.

Is there any wy I can speed-up this process from US?

Adjustment of status

I came here with fiance visa on 2005 but i still didnt file for adjustment status yet (financial issue)..Am I illegal?We talk to INS over the phone and they told us that I'm not illegal as long as I'm not commit a crime..Is it true?

And Is there any place to help me with this?Are they going to deny my paper when it comes time for me to file my paper?
