not paid wages

i was hired to work for my apartment complex as a part time leasing agent. was told that i would get a discount and wages. i worked there for a month and was not paid. i was told corporate was handling my paper work. i was then told at the end of june not to worry about my june rent because i had not been paid and they were still working on it. At the beinning of july a new manager was hired and i was told by the assistant to come in one day to meet her. she began interviewing me and asking about my rent. when i told her i was confused because how can i be interviewing for a job i already have and i was told not to worry about my rent. now they say i need to pay and plus late fees or be evicted. what can be done if i have proof of the job offer, days i worked and signed statements from tenants that saw me work there? i feel i should be owed for the time i worked and get my discount. they have currently now hired someone for the position i had. so was i fired? can i get unemployment wages? what labor laws have they broken?

wages withheld

my x-employer willnot give me my last weeks wages,she says i owe her for education expenses. but there was no money spent on the education because we used earned salon points. she desided to charge me for hotel accomodations for which she chose. when i asked for my check stub. i was told that the employer called my and a co-workers weeks wages in as zero. like we didn't work, she paid herself under the table with our last pay. Nothing was turned in to taxes that we worked. and we do have proof. what can we do about this, HELP!!!

Accident at workplace

My friend dislocated her knee in the bathroom during her lunch hour and she had already punched out. She was told that she couldn't receive any compensation because she didn't have

workman's comp and because the accident didn't happen on actual working hours. Is this true or should she have received any compensation becuase it happened in Marshall's TJX Inc.'s property?

Further, after three years of working at Marshall's full-time she assumed that she would have at the most two weeks of vacation time. However, one week before she went on vacation she was told that she was not going to get paid for vacation because the hours from her vacation were used towards the three months that she was out from the accident. Yet, she was not paid for the three months she was out , so how do they figure this out and is it right because it sounds sketchy to me?

She also had the position of Women's Department supervisor and was promised a raise after her training and official position was given to her. But when all of these was done, she was stuck with the stress and responsibilities of the position, yet after four months of talking with the manager, she has not recieved a raise. Is this right?

Was discharged but company saying quit

My husband was discharged from his job. He filed unemployment and it was approved. He had an interview for another company and had his physical and drug test and they where ready to go but when they got back a employment history check from the agency they deal with, the company that he was discharged from, is stating that he quit with no notice, so now he can not go to work for this company. Even unemployment states that he was discharged. Can the company that he worked for discharge him and then state to employment background check agency that he quit with no notice? The company is even appealing the unemployments decision and we are awaiting a hearing, which the company keeps delaying. Unemployment stated that the company did not provide sufficient information for the discharge.

Employer not following labor law

I work for an Insurance District Manager. He is considered an independent contractor. My employer paid me on a salaried basis, gave me a Management title, but did not pay me the 2 times minumum wage to justify the salaried position and the lack of overtime pay! When I brought this to his attention,and asked that he comply with the law, he retaliated by putting me on hourly wage and a wage cut! I also have 5 days sick leave per earned year. I started in April 06. In April 07 I took my 2 week vacation to have surgery. While I was out, he decided to BACKDATE the sick leave policy to go from January to January instead of earned. He backdated it to the prior January, which means I now have no sick leave for the next 8 months!! It seem like no coincidence that he did this on my one year employment date! He was angry that I missed 2 days of work for the surgery right before my vacation date.

I have not been paid overtime for the last year, I now am hourly as retaliation, and he is still trying to get me to work overtime without paying me by asking me to take comp time instead of getting money!!

I'm 56 years old, live in a city that does not have a vibrant job market, and he knows that I need the job.

What can I do?

I am a 17 year old high school student. When I began working at a jewelry store I was 16. I encountered many things I look back at and know that there must be some laws against it & basically is there anything I can do?

-I worked 7 days a week at times.

-There was no schedule, many times solely a call before the day you work

-No time clock or way of knowing hours unless you wrote them down

-Constantly changing pay day, half the time I didn't even receive a check but cash

-No breaks/lunches were guaranteed..worked 10.5 hour days without a break

-Worked over 7 hours days before school

-Manager deducted hours I worked for miscellaneous reasons

The list goes on. Those are the things that bothered me most, so I turned in my 2 weeks notice and by the 8th day I was told I was no longer needed.

I didn't have a work permit, my boss told me not to get one.

Dumb...I know.

but even if I can't get anything out of everything that I did, is there anyway I can help my other former coworkers in having rights?

Employer Overpayment

My employer recently overpaid almost all of it's employees through a glitch in the payroll system. Now they are asking for their money back. Do I legally have to repay the money that I was overpaid?

Pension

I retired from NY telephone company in 1970 after working for 18 years. I would like to know if I am entitled to a pension. They told me I was not 'legally' retired from the phone company and was not eligible for pension. What are my options?

Vacation Approval Reversal

Let me first say that this is a preemptive measure. My employer has a tendency to reverse decisions about things. I am going to request a 2 week vacation (having earned the paid time off via their written policy). This vacation will cost me about $4,000 which obviously needs to be paid in advance. I need to submit a request to my employer in writing for the time frame of the vacation. Is there any way to request this vacation such that a written request becomes legally binding? Teaching

I have been a full time teacher for 11 years. Before I was hired permanently, I was a long term substitute for the same school district for 2 full years. When I was hired full time I was put on step one of the pay scale. I have since found out that teachers hired before me and after me who also did long term sub work were given credit for the time worked and started at step 2. I have lost about 58,000 in salary by not being put on the correct step like everyone else. I was told they would now move me to the correct step but not compensate me for all the monies lost. Can they legally do this?

false criminal charges

i was terminated from my employment for what i believed to be age/gender discrimination. when i filed charges with nys i was brought up on a petit theft charge. after filing my rebuttel, i was charged with 4 more! i could not have possibly done the crimes, and they infact point to another worker.9The charges have me falsifying paperwork on my days off!) i did stand trial and was found not guilty. the eeoc has issued a right to sue, i have 80 days remaining to file. what are the chances i can file independently in federal court and actually win. i am in complete financial ruin

I have a fmla paper filed with my employer due to having fibromyalgia. They said that this form needed to be filed so that I coud not lose my job due to sick time. I have currently lost 5 days due to my medical problems. My employer called to day and said that this would require new forms, that flma only covers a few days at a time, not a full week.

Forced to work at home by employer.

I agreed to work for my current employer and began back on January 8th of this year and at that time he stated to me that he would get me an office to work from if I could work from home for the first two weeks and I agreed. It has been 5 months and still no office and I am paying higher utility bills because of this and I want to be reimbursed, what can I charge to the company for each month if at all?

Fired - Separation agreement?

I was hired 4 months ago, following a hiring process of 4 months. The job description clearly outlined their expectations and I pursued them in good faith, despite the cultural hurdles placed before me. After a few months, I was told that they did not view it as a ''good fit'' and it was decided to terminate me. No one disputes performance, it is simply a ''fit'' issue. After some discussions, I volunteered to stay on to complete some projects (and help them save face) and they offered a month's severance following the month I stayed on. They also offered a letter of recommendation and I think cordial overall. When I met with HR, they presented me with a document to sign describing the separation as a resignation (which I believe would disqualify me from unemployment) and releasing them from liability. I was given 21 days to review the document and return it. I don't see any benefit to signing it (other then the possible one month severance - though I think they would give this anyway).

1. Am I right not to sign this form?

2. Is this a reasonable separation? I feel as if it was a bait and switch hiring situation and wonder if I shouldn't negotiate for a greater severance (though within their ''probationary'' period)?
