Unjust Layoff

My daughter is 18 years old, works at a Coldstone Creamery that was taken over by Kahala a few monthsa ago.

She's been an excellent worker bringing the same work ethic that won her 4 scholarships to college from her civic volunteering. She doesn't sit around, go for food at other places on the clock, or never show for work. She was told she was going to be promoted to shift leader.

She questioned why another 18 year old was being rude to her at work, asking if she had done something wrong - she has never been written up. This other girl is very friendly with the manager who is in her 30s. About 5 weeks ago she started getting few hours. She has requested a meeting in writing 3 times to the manager, and 4 times by phone. The manager simply hasn't made time to talk with her.

She got a call today from the manager telling her to look for another job, that they are ''downsizing''.

Is there any recourse from here? She is an excellent worker, doesn't steal (as she has seen others do), doesn't waste time, fills in whereever needed, etc.

I was recently in an auto accident and my orthopedic doctor gave me a work release for several days as he wanted me to stay off my feet and allow my back to heal some from the trauma of a rear end collision. I have damage in my L2 thru L5 Discs.

My employer has said that if I don't come in he will have to replace me...and that Florida is a right to fire state.??? Can he fire me for not coming in when I have been given instructions from my doctor?

Employment, wages

My employer reversed a paycheck from my bank account (paid wages through direct deposit and then took the wages back from my bank account when the funds were available). He did this after I resigned from the job. I do not owe him anything and I do not have any written agreements/contracts of any sort with them.

I was employed under him rightfully. Aren't his actions illegal? Could anyone tell me my legal rights as an employee?

I work as a manager for a pizza store. We were recently bought out by another company. This new company has informed me that if I do not get a liscence by december 1st, I am going to be laid off. I feel I am being discriminated against for not driving. Do I have any basis for this claim?

Severance package as regards to sexaual harrasment.

Do I have a right to to ask for a severance pay if I voluntarily leave a job that I was sexually harrassed by my owner? I have had no problems with the company or my job but now that this has happened I feel uncomfortable. I feel like because I have to leave my job unplanned and prepared I should get a severance package but I dont want to break any laws by asking.

Intermitent FMLA and being let go due to budgetary reasons

I have gone on Intermitent FMLA with my company within the last 2 weeks due to the medical issues with my son. My boss, who put me on a verbal warning about 4 weeks ago, has let me go due to budgetary reasons. Is this legal and do I have any reprocussion on the company.

Job offer changed after acceptance

Hello,

I recently accepted an offer of employment to work at a specific office location. I submitted my resignation and have now left my job. 1 day before beginning my new job, I was told that the location of my job is no longer at the office where I was told the position would be. Now, the position is to be at a location 30 minutes from the original location. This constitutes a significant difference in my commute. Do I have any recourse? Or must I accept the new conditions (as I have no other employment?) I have been candid with the director that had I known the position would be at the new location, I would not have accepted the position. Is this a bait and switch?

Payments to 401K plan

What can I do about payments that were deducted from my payrole check for my 401k plan loans but were never sent to the plan administrators and now that I've been laidoff since July 17 the company still has not sent the funds in and I've gotten a lump sum distribution they still have not sent the funds in and now the pension fund has overpaid me and I have to send them some money back and I still don't know if they have made a payment or not, but if they have not then they owe me the money I need help to sort out my options!

false accusation / libel / defamation by former employer

i was contacted by phone by my former manager on october 16th regarding this issue. the person that took my position over (manager for a rental vehicle cleaning/fueling operation) claims that i told him and other former subordinates that it was permitted for employees to fill their gas tanks at the rental car facilities' gas pumps. knowing that this was strictly prohibited (not to mention criminal), i told my former manager that these claims were untrue and that i never told anyone that it was permitted.

i then retrieved a memo sent on october 15th (the day BEFORE this was ever brought to my attention) stating that as a FACT, i told former employees that this was acceptable behavior and that they are currently conducting an investigation into this matter (mind you, they had and still have absolutely no proof that i ever made these statements prior to sending this memo out). it also stated that my former employees would be exonerated from any fault due to the (false!) fact that i gave them incorrect information.

my question is, do i have a case for libel/defamation, seeing as these accusations may lead to possible endangerment of future employment opportunities, as well as possibly jeopardizing my claim for unemployment?

i was a manager, i was layedoff. I was the only one, and two weeks later they hired someone in my place. i have work for the company for 8 years. Can they do this? I live in Texas

driving pay

i work for a large cell phone company. my normal drive time to wor is about 30 minutes round trip. Once a month we are required to drive 4 hours round trip with no time payed for this they say we get payed mileage so that is our compensation. my question is this legal. if we drive with someone else no pay and also the mileage just takes care of wear and tear.

Employer Confidentiality Breach

A friend is negotiating with their employer of 20 years for a voluntary buyout. The specifics have not been agreed to yet, in terms of money and health care, etc. Naturally, this is supposed to be a secret between him, his boss and the HR department. Yesterday a colleague asked him when his last day was. Since the company is also laying a large number of people off at the same time, he feels that his reputation and his ability to earn future income in the industry is compromised now that it seemsv his status as voluntary is compromised and his departure is common knowledge. Does he have any advantage in the buyout negotiations? Does this suggest additional legal action on his part?

can an employer add disiplanary documents to an employees file after the file has been reviewed by the employee and they were not in there. When i asked my local HR they told me they were in a seprate file is it legal to have seprate files?

Travel Pay

Our retail company pays assistant store managers on an hourly basis.Recently it was announced that travel time to training sessions in various locations would not be paid for these assistant managers, although other hourly staff will receive travel pay to/from the same sessions. This involves travel by car up to 4.5 hours each way.Is this legal? Additionally, holiday pay of time and a half is paid to all staff working in the store on a holiday except the hourly assistant managers. Is this acceptable? Thank you.
