Lawyers sell their services through Guru and similar sites. If an attorney is licensed in one jurisdiction, how can he/she provide services for individuals and organizations throughout the country? Are attorneys who sell their services on Guru and similar sites practicing law without a license whenever they provide a service for individuals or entitites outside of the jurisdiction(s) in which they are admitted?

attorney won't release settlement

I had an attorney on contingency. He should have kept 33.3 and release the remainder to me. The settlement was much smaller than had been expected. Two months later now he won't take my calls nor release the remainder of the settlement to me. What can be done in this situation.

can a company you worked for hold your last check until you send in uniform shirts? My son left a job in Florida to move back home to Ohio. He was not advised he needed to turn in his shirts when he left. THe shirts have since been discarded. THe company (Pizza Hut) refuses to send his last check until he returns the shirts. This has been going on since April. Is it legal to withhold this check? If so can they just deduct what the shirts are worth from the check?

We have a Corporation and the Corporation is paying the bills for a certain lawyer. The unaffiliated shareholders of the Corporation are using the same lawyer to cause problems with the Executives of the Corporation even though the Executives of the Corporation are bankrolling the company. Can we ask the Lawyer not to correspond with the Shareholders anymore?

Currently we are have a mayoral race recounted because of a time. I want to know if a person wins and their wife is the secretatry, her cousin is the assistant treasurer, the assistant treaser brother is the code enforcer plus there are blood relatives on council. Is there something that prohibits multiple relatives in the same family. This makes it very hard for the rest of the officials and employees. I think the mayor or secretary has to make a choice of which will be in office.

Legal Malpractice and State Bar Memberhip

I am attepmting to get reinstated to the State Bar of California. I have several malpractice judgments against me from a previous point in time when I was practicing law - which have been discharged in bankruptcy.

Can the State Bar of California require me to pay off the judgments - contrary to the Bankruptcy Act - in order to be reinstated?

Breech of Confidentiality

I am in a chapter 13. I am having deductions coming out of my check every 2 weeks. I was told by my lawyers and my payroll office that this is very confidential information. On yesterday a coworker of mine told me that My Director (the head of the company where I work)told her that I was being garnished, there is no reason why this information should have been released to her/my supervisor she does not need to know. What can I do about this I was told that this is called Breech of Confidentiality Awaiting your response.

Telemarketer Question

Situation:

Telemarketer calls a house and asks for a person whom no longer lives there.

House owner asks to take his name off the list, but his name is not on the list because of a previous owner linking his number to it.

If the owner of the house threatens the telemarketer physically through the phone, if the telemarketing company records phone calls, could this be pursued in the court of law?

can i sue for liable or what is my recourse?

I, as well as fellow exhibitors who exhibit and sell merchandise within a trade show circuit which travels and shows throughout the country have been struggling with a vendor who states negative or false information to customers about her competitors who approach her booth holding our business cards. In other words, she will say anything to kill sales or get business and is very successful in doing so. We have approached our tradeshow organization with this problem and she has been warned on several occasions by the promoters as well as vendors, but after many years of this same problem, it appears that she is going no where. What legal rights do we have against slander? Should I and my fellow exhibitors hire secret shoppers and attempt to record negative comments as evidence and possibly sue for slander? Most of us are jewelers and rely soley on our tradeshow business to make a living and this problem needs to be finally resolved. thanks.

Corporation by-laws vs ''state'' laws

My grandparents set up a corporation for our family in the early 1900's for tax purposes among other reasons. Approximately 400 acres of land and several rental properties were owned by the family ''corporation''. The corporation by-laws were put in place in which it states clearly who the Board of Directors are to be, how decisions are to be made, etc.

Now that only 2 of the original children (one being my father) are remaining alive- the other children of the deceased (my cousins) are saying that state laws (VA) override corporation by-laws. They have teamed up together and have overthrown the Board of Directors and are now making policies- still claiming that state law overrides corporation by-laws. There is quite a lot of land and money at stake, but the principle of it is what matters most. Are they legally entitled to do this? Do state laws override corporation by-laws? Also, when shareholders of a corporation vote on matters is it by head count or by number of shares?

it is quite heartbreaking to watch as descendents change everything to suit their selfish greedy needs.
