Injury and Malpractice

I had a serious fall of over 20 feet. I went to the emergency room where they examined me, took X-Rays, and said that I just had a sprained ankle and basically sent me on my way with a small plastic air cast. They also said it would be OK for me to go back to work in 3 days. I waited 8 days to try to go back to work, but was in too much pain. After 10 days I went to another Dr. who did more X-Rays and ordered an MRI. My ankle is severly fractured. I got the original X-Ray films from the ER and he showed me the fracture clearly on those also. I am now facing a serious condition because I continued to bear weight on that ankle. Do I have a case?

Injured, Not sure who is responsible

I was recently injured (bit by a bat that had managed to find its way into my apartment through cracks in the building) and now have a substantial bill for the ER costs. My landlord (fearing a lawsuit) told me to bring to him any costs I might have incurred because of this but before in the mean time has sold the building to new owners. Are either of the owners responsible, even if they told me to bring them the bill? Would the original owner still be on the hook for the costs or does that somehow transfer to the new owners of the building? Thank you for your help.

Bike injury by traffic pole and divider

One weekend in August, my daughter fell off her bike trying to avoid the sudden traffic pole (to warn people about the sudden concrete divider), while riding with her colleagues for the first time in the new city she just relocated to less than two months ago, she was taken by ambulance to the emergency room, and was treated with multiple stiches on the left knee (lost too much flesh will need plastic surgery), bruises on both arms, back and waist.

She was very lucky, no car hit her after she tumbled on to the busy street. Looking at the photos her colleagues took right after her fall, it's obvious the city needs to remove the raised concrete divider and the warning pole ASAP, before getting any unknowing biker killed.

How much time and money will it cost to bring a suit against the city? My daughter is concerned about the time she may have to take off her new job, especially after she had to take some days off after the injury.

Fell and hurt back

I fell a few months ago in a rut my lanlord had dug to drain rain water. Three people saw me fall. I complained to my landlord about the rut and he filled it in with dirt. However, 1 week later he came to do some work on the foundation and dug two new trenches along the side of the house and didnt bother telling me about it. When I took out my trash can one night, I fell in the new trench and hurt my back. I thought it was muscular, but its been over a month and I still have pain making it hard to sit at work for 8 hours and also making it difficult to sleep at night. I have no health insurance and wonder if I can sue either the landlord or their insurance to get medical treatment? Is it too late after 4-6 weeks? Does it matter that there wasnt a witness to the second fall?

daughter fell and hit her head in school

my daughter fell in school and hit her head, no teacher or adult came to help her, only a student. vice principle told me that is she was a car and went off the side of a mountain and no one saw it, then no one would be there to help her.

Son hit by car while on bike

My son was hit and the driver was not cited. At least one witness and my say she actually hit him twice and then witnesses jumped in front of her because she kept moving forward after he was on the ground. What can I do?

Out of state auto injury

I am a Pa resident with limited tort on my auto insurance. A drunk driver hit a car I was a passenger in. This happened in New Jersey.I was taken to the hospital and checked out. My family physician ordered additional testing and I was found to have a crack in my pelvic bone. Do I have any rights to be able to sue this driver for my injuries? If I have additional medical expenses, not covered by auto and personal health insurance, would I be able to sue this driver?

is my attorney slacking?

In Dec. of last year I had a car accident. Some ran a stop sign and hit my daughters car and totaled it. I broke my arm in 3 places, bruised some ribs and screwed up my shoulder. Now i need surgery but I have no ins. I got a lawyer the beginning of Jan. and he doesnt tell me anything. He has called me once about 2 weeks ago and said its not going to be long now and havent heard from him since. His secretery always says he is with a client and he never returns my calls. Its been almost a year and I cant work again because of the pain in my shoulder. How long should I wait to hear from him?

We would like to sue a German manufacturer in the US. How do we go about getting jurisdiction? Medical device was implanted in Germany(US citizen) and broke a year later (in the US) with severe consequences for patient. We need jurisdiction in the US because German law offeres little to no compensation.

Golf cart accident

I was run over by a golf cart at the Briarwood golf course near York PA. The gentleman in the golf cart backed over me in the parking lot. There were witnesses. My question is '' does the golf course have any liability for this accident?'' My medical expenses, including knee sugery, were slightly inexcess of $4200. I previously asked a question wrt this accident but did not inquire as to the golf course's liability

Dog bite premises liability

I work in a retail store in a mall and the mall policy states that pets are not allowed in stores. My district director made me aware that a customer complained that we told her she could not have her dog in the store and that we should be allowing small dogs that could be held in the store. Here's my question then, could we be sued for discriminating against people who have larger dogs that we don't allow in the store and if one of the dogs that someone brought in bit someone, would we be liable for not providing a pet-free environment? Hurt by Alzehimer's Patient

I took a caregiver position I found through the local paper to take care of 87 yr old Alzheimer woman and her 92 old husband recovering from broken hip. the woman tried to set fire to some trash underneath her wooden carport with 2 cars full of gas in it and the containers she was trying to set on fire had aresol cans and fingernail polish remover bottle in there. In the process of getting the matches away from her she pushed me down the cement steps.

Now I have to have a Meniscus Allograft Transplant by an Ortho surgeon. this will probably be paid by blue-cross blue shield on my husband's insurance. But what about my loss of pay during this time? Of course I no longer work there, but my surgeon says I may not be able out of work for 2 months I have big big bills to pay. I have a payment of $500 I have to make by December 15th, 2007 or we stand a chance of losing our home! Someone told me I need a premesis liability attorney but is there a case since the lady is

legally crazy ? Her son is saying nobody saw mother push me down that I probably just tripped over my own 2 feet. Attorneys are turning me away left and right. Will anybody be able to help

Getting Married

I am currently involved in a Personal Injury suit for something that happened almost 2 years ago. I am getting married soon but the suit is still being worked out. If I get married before it is settled is there any way my spouse can be brought into it? Liability or anything else.

Is this slander if I said that the person is a deadbeat buyer. did not pay or respond. owns 1,000,000 home and did not pay? I find the home on google, public knowledge, a real estate listing and he did not pay in the 7 day guidelines.

Is there a statute of limitations regarding seeking payment of a vet bill that was incurred as a result of a pit bull coming into my yard and attacking my two chihuahua's (killing one of them)...The owner SAID he would pay it, however, it is now 6 months later and the balance is still 695$$...thanks
