The issues in this case are: (1) whether Petitioner is entitled to repayment for alleged Medicaid overpayments to Respondent; and, if so, the amount of the overpayment to be repaid; (2) the amount of any fine to be imposed against Respondent; and (3) the amount of any investigative, legal, and expert witness costs to be assessed against Respondent.Petitioner proved, by a preponderance of the evidence, that Respondent was overpaid for claims billed to Medicaid. Petitioner did not prove, by clear and convincing evidence, that Respondent violated the Medicaid laws, so no fine should be imposed.
