The issue is whether Respondent discriminated against Petitioner on the basis of race or sex in violation of Section 760.10, Florida Statutes (2006).1Termination of employment for violation of zero tolerance smoking policy was not motivated by racial bias, and previous transfer to new position was not motivated by sexual bias. Respondent is not entitled to attorney`s fees.
