The issue in this de novo proceeding is whether the intended action of Respondent, University of Central Florida (University), to award a concessions and food services management contract to Ovation Food Services, L.P., d/b/a Spectra Food Services and Hospitality (Spectra), is contrary to the statutes, regulations, or policies governing the University, or contrary to competition, arbitrary, or capricious. The standard of proof for this proceeding is whether the proposed contract award is clearly erroneous, contrary to competition, arbitrary, or capricious. Petitioner, Boston Culinary Group, Inc., d/b/a Centerplate (Centerplate) bears the burden of proof.Vendor sucessfully challenging ITN award proved University participation in proceeding was for an improper purpose.
