The issue is whether Respondent, Ben A. Leasure, should have a $3,000.00 administrative penalty imposed, take corrective action, and pay investigative costs for allegedly illegally filling 0.17 acres of wetlands contiguous with the Withlacoochee River (River), a Class III water, on land located in unincorporated Hernando County, Florida.Landowner was found guilty of illegally filling wetlands without a permit. Because of no mitigating circumstances present, a statutory fine was imposed.
