The issue to be resolved in this proceeding concerns whether the Petitioner was subjected to a discriminatory employment action based upon his having a disability and, embodied within that question, whether he has a physical impairment which meets the legal definition of disability.Petitioner failed to show that disability discrimination by harassment or employment action occurred, and no reasonable accommodation was denied. Petitioner could not perform his job duties because of absences and resigned in any event.
