Whether a final order dismissing the Petitioner's rule challenge should be entered because Respondent, United Safety Council, Inc., doing business as Florida Safety Council (United Safety Council), is not an "agency" within the Florida Administrative Procedures Act (APA), and there is no claim challenging a rule enacted by Respondent, Department of Highway Safety and Motor Vehicles (Department).APA does not provide for a rule challenge against a private entity, who has been contracted to provide a governmental service, because the private entity does not meet the statutory definition of an "agency."
