Affirming. Upon the first appeal (Webb v. Dixie-Ohio Express Co., 291 Ky. 692 , 165 S.W.2d 539 ), the judgment against Webb was reversed on the sole question raised, viz., the sufficiency of the evidence in proof of the alleged fact that the Dixie-Ohio Express Company's truck and agent participated in the accident.
