The issue to be determined is the amount to be reimbursed to Respondent, Agency for Health Care Administration (Respondent or AHCA), for medical expenses paid on behalf of Petitioner, Patrick Osmond (Petitioner), from settlement proceeds received by Petitioner from third parties.Petitioner proved by clear and convincing evidence that the portion of its third-party recovery attributable to past medical expenses as allowed by the Medicaid anti-lien statute was available for reimbursement of Respondent's Medicaid lien.
