Whether Respondent Whispering Oaks Estates Home Owners’ Association, Inc. (Whispering Oaks Estates HOA), failed to provide a reasonable accommodation for the late Charles A. Tipton’s disability in violation of Florida’s Fair Housing Act; and, if so, the relief that is appropriate.The Petitioner established that the Respondent failed to provide a reasonable accommodation. However, the person prosecuting this case failed to demonstrate that she had the legal authority to act on the Estate's behalf.
