The issue is whether Respondent committed an unlawful employment practice by discriminating against Petitioner on the basis of a disability or a perceived disability in violation of the Florida Civil Rights Act of 1992, as amended, Chapter 760, Florida Statutes (2010).Petitioner is not disabled solely because of a workers' compensation impairment rating that does not affect his ability to perform the same job as before, nor did he prove he was victim of discrimination based on perceived disability.
