The issues are: (1) Whether Petitioner's Amended Charge of Discrimination should be dismissed as time barred; and Whether Petitioner, Susan Indish-Militello (formerly known as Susan Indish and referred to herein as “Petitioner”) was discriminated against in violation of the Florida Civil Rights Act of 1992, as amended.Charge filed seven years after alleged discrimination is time-barred and should be dismissed. Even if claim is not time-barred, charge should be dismissed because Petitioner failed to prove that she was handicapped.
