The issue for consideration in this matter is whether Respondent, Stephen J. Otten, should be discharged from employment with the Petitioner, School Board of Sarasota County, for allegedly filing a false Worker's Compensation claim.Filing claim for workers compensation which was denied does not constitute misconduct to support discharge for filing false claim. DOAH hearing is de novo.
Whether Respondent, Linda Simmons' employment with the Petitioner, Sarasota County School Board, should be terminated based upon the charges alleged in the letter of termination dated November 20, 1992.Teacher's conduct was self-evident that her effectiveness in school system had been impaired.
