The issues to be determined are whether Respondent violated the applicable standards of care in the practice of dentistry in violation of section 466.028(1)(x), Florida Statutes, and the dental record-keeping requirements in violation of section 466.028(1)(m) and (mm), and Florida Administrative Code Rule 64B5-17.002(1), as alleged in the Administrative Complaint; and, if so, the appropriate penalty.The Department failed to prove a violation of the standard of performance in the placement of an implant, but proved a record-keeping violation.
