This is a license discipline case in which Petitioner seeks to take disciplinary action against Respondent on the basis of allegations of misconduct set forth in an Administrative Complaint dated August 13, 2003.The Administrative Complaint was based on the illegal failure to return collteral. However, there was no proof of the delivery of the collateral. Proof of delivery is sine qua non to proof of the failure of return.
