The issue is the amount payable to Respondent, Agency for Health Care Administration (AHCA), in satisfaction of Respondent’s Medicaid lien from a settlement received by Petitioner, James T. Stirk, from a third party pursuant to section 409.910, Florida Statutes (2015).Petitioner did not prove by clear and convincing evidence that a lesser portion of the total recovery should be allocated as reimbursement for past and future medical expenses.
