The issue is whether Carl J. Ekblom's (Ekblom's) application to install a boatlift at an existing dock in a man- made body of water in Islamorada is exempt from the need for an Environmental Resource Permit (ERP).Ekblom's application to install a boat lift on an existing dock was exempt from DEP permitting requirements, and did not create a navigational hazard; a cradle lift need not be physically attached to the dock.
