Division of Administrative Hearings, Florida Filed: Apr. 19, 1996
As provided in an Order and Amended Notice of Hearing entered on July 18, 1996, the issue for disposition is whether Petitioner, Ms. Smith, knowingly and voluntarily, through settlement, waived her right to pursue her charge of discrimination.Petitioner waived her right to pursue the claim of discrimination when she knowingly and willingly executed a blanket settlement of all claims for $50,000.
95-005380  IVAN ROSARIO vs ORANGE COUNTY  (1995)
Division of Administrative Hearings, Florida Filed: Nov. 08, 1995
Petitioner's Charge of Discrimination and Petition for Relief allege that Respondent violated the Florida Civil Rights Act of 1992, Chapter 760, Florida Statutes, by placing false accusations in Ivan Rosario's personnel file, causing him to be denied promotional opportunity and discriminating against him on account of his national origin (Puerto Rican). The issue for resolution in this case is whether that violation occurred, and if so, what relief is appropriate. At hearing, and in his written material filed after hearing, Mr. Rosario has alluded to other grievances or complaints against his employer. The only complaint at issue here, however, is the one described above (FCHR No. 94-C954).No prima facie case when facts only established an inadvertent error by employer.
