The issue presented in this proceeding is whether the Amended and Restated Petition to Amend the Boundary of the Rivers Edge Community Development District (Amended Petition) meets the applicable criteria in chapter 190, Florida Statutes, and Florida Administrative Code Chapter 42-1. The purpose of the local public hearing was to gather information in anticipation of quasi-legislative rulemaking by the Florida Land and Water Adjudicatory Commission (Commission).Petitioner satisfied all statutory criteria for amending its boundaries and reducing size of CDD by 2,500 acres.
