The issue for determination is whether Respondent was overpaid by the Medicaid program as set forth in Petitioner's Final Audit Report dated May 18, 2009, for the period July 1, 2004, through June 30, 2006.Petitioner established (1) a case of overpayment, and (2) overpayment computation is proper and accurate; and demonstrated a fine should be imposed. Recommend repayment of overpayment, plus a fine.
