The issue presented is whether Petitioner Mark G. Berube has met his burden of proving his actual innocence, thereby entitling him to compensation under the Victims of Wrongful Incarceration Compensation Act.Petitioner failed to offer any evidence of actual innocence of the crime of vehicular homicide where he committed the act of intentionally turning left into oncoming traffic although his view was obstructed by three stopped left-turn lanes.
