The issue to be resolved in this proceeding concerns whether the Department of Corrections, the employer and Respondent herein (Department, Respondent) engaged in a discriminatory employment action against the Petitioner by terminating her allegedly on account of her age.1/Petitioner did not established a prima facie case of discrimination. Recommend that the petition be dismissed.
The issue in this case is whether Petitioner has been the subject of an unlawful employment practice based on gender or handicap.The evidence did not show that Petitioner was discriminated against based on gender or handicap (obesity).
