The preliminary issue in this case is whether the South Florida Water Management District (District) has jurisdiction over the Petition for Formal Administrative Hearing (Petition) filed by the Save the Manatee Club (Club)--i.e., whether the Petition was timely or, if not, if the District has jurisdiction under principles of equitable tolling or excusable neglect.Petitioner missed deadline to file. Equitable tolling did not apply because it was not reasonable for Petitioner to be misled or lulled by rules or anything else, petition was three weeks late, and applicant was prejudiced.
