The issue is whether Respondent engaged in an unlawful employment practice by discriminating in its failure to promote Petitioner on the basis of her race.Petitoner was not discriminated against because of her race. She was not selected for the job promotion because her application and interview ratings resulted in her being the second highest rated applicant.
