The issue to be determined in this case is whether the City of St. Petersburg’s amendment to its Comprehensive Plan, adopted by Ordinance No. 2009-689-L (Plan Amendment) is “in compliance,” as that term is defined in Section 163.3184(1)(b), Florida Statutes (2009).1/The City's amendment to its future land use plan is not "in compliance" due to its adverse effect on hurricane evacuation times and incompatbility with adjacent land uses.
