The issue is whether, pursuant to section 409.910(17)(b), Florida Statutes (2015), Respondent's recovery of medical assistance expenditures from Petitioner's settlement proceeds of $250,000 must be reduced from the amount calculated by the statutory formula contained in section 409.910(11)(f) (Statutory Formula).Full Value Ratio (settlement or judgment proceeds divided by full value of case) multiplied by all medical assistance expenditures, but not more than portions of full value for past and future medical expenses, to generate AHCA's recovery amount.
